    In March of 2022 we signed a contract for a new build, with an estimated cost of $475,000. During the build as funds were disappearing fast I was continually asking how are we doing on the budget? There was very little and sometimes no communication for weeks. His workers even ask me if I ever got an answer. Long story short at the near end of the build we were so far over budget we had to tell him we would finish it ourselves. After we put on gutters, finished paying for the **** system, had driveway done and ground work done we will be over $700,000. That is no way approximately $475,000. If I had communication with him and known this we would have fired him sooner. However we had an attorney with the *** look over papers and receipts and was told his math was not correct on figuring his percent, and he had added his builders margin on top of his own labor. She said that was not allowed. There is no way I can prove all these receipts did not go into our build, but I can prove $25,000 worth of miscalculations. The *** attorney referred me to Attorney *******************, she said we definitely were done wrong, I had a case that needed to be looked into but unfortunately she had a conflict of interest. She told me I should contact the Attorney generals office and the BBB. I have found out I am not the only one. There is even a couple that couldnt afford to keep the house after it was built and had to sell it. I have had people say I wish I had tried to do something so he wouldnt keep getting by with it, so I decided I would speak up and try. Any help will be appreciated.

      Our office has been retained by Riffey Enterprises LLC in regards to
    Case ID ******** and complaint filed by the customers against Riffey
    Enterprises LLC, and we present the following response to the customers'
    complaints/ concerns:
    1. 
    Budgeting:  The contract makes it clear that the customers are
    responsible for their own budgeting of their money.  A project
    estimate is just that, a good faith estimate of a project's costs.  Costs
    of material and services are subject to change as dictated by the market,
    particularly during a time of rising inflation.  Additionally, in regards
    to this specific project, several additional features, material upgrades, and
    design changes were implemented at the request of the customers.  The
    costs of which were disclosed to, and approved of, by the customers. 
    These changes, coupled with the increase in material costs resulted in an
    overall project cost that was higher than originally estimated.
    2. 
    Invoice Accounting:  The contract clearly and unequivocally states in
    section 6 "Payment" that there shall be a 15% builders' margin
    on all services and materials.  this applies regardless of
    whether the services were provided by a 3rd party subcontractor, the builder,or
    any other party.  If a service was provided in the construction of the
    home, it is subject to a 15% builder margin.  In review of an invoice
    referenced by the customers it appears that they customers have mistaken a 15%
    builders' margin for a 15% markup, which may account for some of the confusion.
    3. 
    Various Defamatory Statements:  Riffey Enterprises LLC has no knowledge of
    the other claim made by the customers about homes being sold due to
    construction costs or that other "people" have expressed
    dissatisfaction over their home building experience.  As the customers
    have failed to provide any details or evidence to support these anecdotal
    allegations, Riffey Enterprises LLC must conclude that they are merely
    malicious statements of a defamatory nature and reserves the right to take
    legal action against any party which makes, publicizes, or causes to be
    published such statements.  Furthermore, Riffey Enterprises LLC must
    insist that such statement that have been made/ published be retracted at once.
    Additionally,
    in reaching out to Mrs. ***, in order to verify the accuracy of the customer's
    claim, Mrs. *** stated unequivocally that she offered no legal advice or
    assessment of the customer's claims to them as she declined to represent
    them.  Furthermore, Mrs. *** stated her decline of the customers' case was
    not due to a conflict of interest.
    We
    hope that the above, may provide additional facts and clarity which may bring
    this complaint to a close.  At this time, Riffey Enterprises LLC considers
    this matter concluded and will not indulge in the adjustment of any invoices
    billed to the customers.
