    I gave this business a deposit of $1,000.00 on a new pontoon boat that they did not have in their inventory but I was told that it should arrive in the next few weeks. I was told that this deposit was to hold the boat for me and that my deposit would be returned to me should I decide I did not like or want the boat once it arrived as I had not seen the actual boat nor did they have a catalog or pictures to show me. We were told multiple times that I would get my deposit returned in full. I was working with the general manager *********************** on this transaction. The following is a chronological list of events concerning this matter.05/01/24 gave Apex $1,000.00 deposit, check #**** 05/09/24 check was cashed and cleared my bank 05/21/24 ***** left voice mail stating the boat had arrived 05/24/24 went to view the boat and we did not like it telling ***** we actually preferred the layout of the 2023 model on their lot better. Was told this boat was sold but maybe the buyer was not taking it and he would check and let us know.05/29/24 ***** left voice mail stating they would sell the 2023 to me if I wanted it. 05/31/24 ***** emailed us 2 pictures of the 2023 boat with the motor now installed.06/05/24 called ***** telling him we decided against buying the boat and he told me they would mail my deposit back.06/18/24 had not yet received my deposit so I called the business asking to have ***** call me. 06/20/24 had not been contacted but ***** so i called his personal cell phone leaving a voice mail I was checking on my deposit and to please call me.06/21/24 ***** never called so I went to their business and was told by ***** the owner did not want to return my deposit as he believed the process took to long . ***** admitted to me that he had repeatedly told me I could get my deposit back at any time and he would explain all this to the owner and call me that afternoon. I have yet to hear back from this business.
