I have been contacted by a collection agency for anytime fitness concerning a collection claim. Though my name is on the gym membership account because I was told by the gym manager that it was just so I could get my own key fob, my ex partner, ***********************, was the account holder and linked his bank account to the payment of the membership as it was his account. We broke up months ago, and he canceled the membership entirely. To my utter shock, I recently received an email from a collection agency that stated that I owe 160$ for a membership that was canceled months ago. They are threatening to escalate the situation and report this claim to my credit bureaus. *** tried to get in contact with my ex to obtain proof of cancellation, but he hasnt responded. I am not the account holder on the membership nor was I responsible for the financial aspect of the account, so its perplexing why Im being held liable for whatever is going on here. My card was never linked to the account because I was assured I only needed to sign paperwork to obtain a key fob as I was an addition to the original account.

I have been trying for years to cancel my membership at this gym. I have talked to employees and managers face-to-face, who have all told me several times that my membership would NOT auto-renew in August 2022. That is not the case. They continue to charge me money every month, have sent $655 against me in collections, and now claim that they have no documentation that I have ever tried to cancel my membership. *Note: I have gotten married since opening an account with Anytime Fitness. My membership will be under ***********************, not ************************* (my current legal name).

After reviewing ******************* account I do see where she made attempts to cancel her membership. Unfortunately she did not meet the requirements to terminate her agreement early as started in her contract signed in June of 2019. The membership was a 36 month contract that has been fulfilled. This agreement will not renew or continue to be charged. I can provide copies of her agreement and payments collected on request. For any further questions I can be reached via email or phone.

    Customer Answer

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    1. I was not aware I was signing a 36-month agreement; your management at the Plainfield location told me I was signing up for a 24-month contract.

    2. I was never made aware of any requirements I needed to meet in order to cancel my membership early. I would have met the requirements had I known about them. Instead, your staff at both the Plainfield and Greencastle locations told me on several occasions that my membership *had* been canceled, and that I would no longer be charged.

    3. $655 is in collections against me, and I want this fixed. I tried for multiple years to cancel my membership, due to my financial situation changing significantly. This amount in collections was a complete shock, because your staff had spent 2 years claiming I would no longer be charged.

    4. While I understand that I should have read every word in the contract before signing, I *do* think it is your responsibility to make right any miscommunication made by your staff. I have talked to several managers at both the Plainfield and Greencastle locations over the years, and evidently have been lied to every single time.

Your staff preyed on my trust and ignorance to the situation, resulting in ruining my credit score completely. This is all in spite of me doing my due diligence and making many phone calls to both clubs, *and* showing up to both clubs to speak with managers. In fact, there were several instances in which I would show up to either the Plainfield or the Greencastle location, and the manager on duty would tell me that whatever account questions I had could only be addressed at the *other* location. This seemed to flip-flop every time. Your company has completely taken advantage of me, ruined my credit score, and given me the run-around. The fact that I've had to contact you via the BBB should say enough - I've even contacted your parent company, *** Fitness, with no luck. This has been one of the most stressful experiences of my life. I have felt so helpless and taken advantage of. I want this to be made right so I can move on with my life. My credit score being ruined has made most of my goals unachievable until this is resolved. Please fix this.

    5. Lastly, why was I charged a club fee of $29.95 on October 1st?

    Regards,
