    I purchased a new Fostech rifle (see accompanying documentation) on February 09, 2024. This rifle is marketed to military and security forces as well as law enforcement and the public.
    I purchased this rifle new to use on duty at my law enforcement job. Upon receiving the rifle I was checking the ammunition magazines I’m issued to make sure they fit and function. I discovered the Magpul generation 3 magazine does not work or function in the rifle.
    The Magpul generation 3 magazine is the most common magazine on the market and is currently issued to the U.S. marine Corp. this magazine was designed and marketed in 2012 and has remained unchanged.
    This magazine is designed to work on all military specifications built AR rifles. I contacted *** at fostech and she stated their receivers on their rifles are built to military specifications therefore should fit the generation 3 Magpul magazines.
    I explained my rifle then was not built to military specifications because it will not function with a generation 3 magazine. She said she would send my complaint t up to customer service. They have not called me.

    They sent me emails stating there’s not a defect with the gun and they would not exchange my receiver or whole rifle with one that works. They would send me a generation 2 magazine that will work.
    They claim the rifle is built to military spec but it will not work with a generation 3 magazine like all other mil spec rifles do. They did say they are aware of the issues. Blamed it on magpul and said their current rifles and rifle receivers work with generation 3 magpul mags but refused to exchange mine. My rifle is still new in the box and has not been shot.
    My rifle has to work with generation 2 magazines as well as generation 3 magazines because we have over 5000 various magazines in service across the state. I want fostech to exchange my rifle with a rifle that will function with both magazine generations. I can forward my email thread correspondence to you.

    Thank you for your correspondence pertaining to **** ************ complaint.  This matter has been completely resolved as a replacement rifle was provided on 3-19-2024.  The first contact that was made via email from *** ********** was on 2-9-2024.  After review of the information provided during multiple emails, phone calls and receiving his gun back into our shop, we provided a new rifle as a replacement and covered all shipping costs for the old and new rifle.  We were able to do this all within 40 days of the original complaint.  We are always disappointed when customers are not satisfied with their Fostech products and strive to rectify any quality issues with our products and/or address customer questions.  I hope *** ********** is satisfied with this timely resolution.
