All Paths Construction signed a contract with ** on 12/8/22. All Paths was paid a total of $12,835.34. They were given a deposit totaling $6417.67 on 12/7/22 then $6417.67 on 12/20/22. They broke contract on 12/29/22 when we called the building department and discovered they did not pull the proper permits to begin electrical and plumbing work. Our property was then redtagged by the building department. We gave All Paths a couple days to figure out how to remedy the situation, which followed with no contact or response from All Paths to texts and calls. On 12/31/22 I gave them verbal notice they had til 1/4/23 to remedy the situation. On 1/4/23 there was no contact. We made multiple attempts 1/4/23-1/5-23 via texts, calls, and voicemails and did not hear back. On 1/6/23 we emailed All Paths a non-performance notice detailing ways they broke contract and options to proceed based on contract, and notify ** by 1/9/23 5pm. They were also mailed a hard copy notice. We received an email response stating theyre not going to refund via defensive language. We also asked them to leave the keys in the mailbox for new contractor that Friday 1/6/23, which they did not do so until Monday 1/9/23. We then had our new contractor walk the property and found more negligent work on the property such as using bookshelf boards to enclose windows, cracked leveling of the kitchen without drying properly, damage on new flooring, open 5 gallon paint, poorly laid subfloors, open wiring, poorly framed basement addition, and improperly installed egress window. They were paid 2/3s when their work was actually only 30% done prior to finding out about the permits. They also did not provide receipts for payment, which I had to contact and document through email. There are damages totaling $40,000 and we were attempting to be cordial and get what we paid refunded rather than asking for payment of all damages. Due to their lack of response to our attempts, this was detailed as our next steps.
