    There is 4+ inches of water standing in our crawlspace. Under further investigation, **** did not put in any foundation drains and told me "It doesn't need foundation drains". He came over on August 20th to look at it himself and asked us to put in downspout drains as he thought this could be causing the water in the crawlspace and he would be back in a week to look at it again. My husband, who is a union carpenter, put in all of the downspout drains and ran them all 50+ feet from the house. He also pumped out all of the water under the house as the moisture is causing our floor inside to buckle. It finally rained and once again we have standing water in our crawlspace. My husband and I have both made attempts to contact **** in the last 3.5 weeks and he will not acknowledge these efforts, call us back or make plans to fix this issue. This is our home, I just want our contractor to do the right thing and fix the issue. The contract we all signed even says he will put in foundation drains or a pump and neither were done. We paid out of pocket for and put down the flooring in our home and because of the excessive moisture in our home, within the first week of living there, my husband had to take trim off the walls and rip up flooring due to it buckling so bad.

    Homeowner opted to breach original contract by doing a few contract line items themselves.  Piping and Drainage was one of the items.  Homeowner wants the contractor to address drainage issues but doesn't want to pay for them. There was as discussion about this, and the Homeowner made it very clear that they would be doing this part to save money.  We offered to do all the drainage work for the contracted amount, and they declined.  The Homeowner was always supposed to supply their own flooring and installation.  It was never a line item in the contract.  The flooring is "buckling" because the Homeowner wedged shims on all four sides of floating floor, which doesn't leave any room for expansion.  The complaint isn't valid because the Homeowner opted not pay the contractor and do the work themselves.

    It absolutely has not been resolved and the contractor has no intention to fix the issues. I sent him an email directly after I saw his reply. His reply was not concurrent with what is happening with our home and he knows this. These issues will have to be escalated.

    As stated earlier, the Homeowner opted to do their own piping and drainage.  This was as separate line item and they wanted to do this, and other contract items themselves, to save money.  The home is on a ridge and does not require a sump in the crawl space if the piping and drainage is done correctly.  The Homeowner said they put pipes on the gutter downspouts, but did not mention any curtain drains or other tile work.  They did; however, mention that there is an old well on the property near the home, which wasn't disclosed at the onset of construction.  The Homeowner did show us an old clay tile that was draining water from somewhere near the home.  If the piping and drainage was done correctly and the crawl space still has moisture, then I would suspect it is coming from this undisclosed well.  As I stated earlier, all of these issues fall under piping and drainage, which the Homeowner was addiment about doing themselves to save money.

    I am rejecting this response because: I can't stand a liar and someone so willing to take advantage of people for their own satisfaction. ***** you know everything you've replied is bull. We all know what the truth really is. Your excuses for your lack of, aren't fooling anyone. You stood here and cussed us up and down the last time you were here, so your "professionalism" in your responses is also not fooling anyone. This is not a joke to us. Fix your mistakes, be honest, do the work and this will all be over!

    Our position on this matter remains the same.  The Homeowner opted to do all of the piping and drainage themselves to save loan money that they had spent on their septic system.  Again, we offered to do this work for the contracted amount and they refused.  The only mistake was doing this job after the Homeowner boasted about not signing and returning the agreed upon contract; however, their bank had already given us verbal authorization to proceed.
