      Business Response

Responding specifically to the named issues:

      1. Simply requesting that a joint borrower be removed does not guarantee it will occur. In this instance, Grandmother is the "strength" of the loan and the only reason the original request was approved. We are not going to release her liability as the chances for collection remain much higher with her included as opposed to ***** alone.

      2. We are a financial institution, our interest lies solely in the financing arrangement in which **************** has failed to uphold. Service inquiries and issues are the responsibility of the dealer that sold the vehicle and/or the mechanic performing the desired repair work.

      3. I have no record of this issue, first I've heard of it. Based on the limited information provided, it seems this issue should be addressed with the repo company and law enforcement agency.

      4. Also first I've heard of this issue. There is no reason for Encompass to report to the ********** of ********** I assume this is referencing an insurance claim made against the vehicle that was denied? If that is the case, Encompass is not involved in any correspondence aside from being the lienholder and being notified of the claims status.

Encompass will not provide any of the requested resolutions made by **************** in his complaint. His loan is more than ********************************************** April, and prior to that December. He has been given more than enough time to come up with funds to keep this account in good standing, and only provided false promises to make payments.

As a result of this debt being ran as charge-off, I was legally obligated to receive a ****-C Cancellation of Debt form for the balance that they wrote off. I was never provided with a ****-C form which is a violation of 15usc 1681eb, which speaks on maximum accuracy of the consumer report. Because of that, this account is inaccurate and has to be removed.

Quite simply, this debt has not been "cancelled", it is still outstanding monies owed to Encompass Credit Union that we charged off as a loss. The act of charging a loan off does not cancel or forgive the debt, which would eliminate our opportunity to seek repayment in the future through other means such as judgements, wage garnishments, or collection agencies. We would be happy to make alternate payment arrangements on the outstanding balance of $8,179.71, but cancelling that debt is not an option. Therefore, you were not sent a Form ****-C (which would create a tax liability for you), and we will continue to report the debt legally and accurately to the credit reporting agencies as an outstanding collectable debt.
