    In April of 2022, I dropped off my pontoon boat at Pontoon Restorations to ******************* specifically along with 50% of the estimated restoration costs as a down payment for service to be rendered. Initially I was told that the work would be completed within 6-8 weeks. When following up, ***** indicated that he had to fire his two man crew for drinking on the job which has put him significantly behind. I continue to follow-up with ***** personally on when he thought the boats would be ready and was told each time he was catching up, training new staff, and that my boat was in the que to be worked on. In August of 2022, ***** informed me that while my boat was a priority to get out, he didn't believe he would make it in time for the season. In February of 2023, ***** shared that he was fully staffed with trained folks and that my boat would be ready mid March in time for the 2023 season. Each time I spoke with *****, one of my standard questions was asking if the supplies (furniture and flooring was order and in. Each time I was told yes that the furniture was in storage and will be ready when his team was able to start working on my boat. In a call today, I spoke with an individual, *****, who indicated that he acquired the company from ***** and that the place was a mess and he was in the process of filing for bankruptcy. While I believe ******* story to be accurate, I am hoping to recover my deposit paid for services not performed.

    On March 30th, 2020 we signed a contract to have a pontoon boat built by the Pontoon Restoration company. By October of 2022 we had still not received a finished boat. We were able to find out that several parties were having difficulties with this same company and that a detective from Kosciusko county was investigating the company. The detective encouraged the Pontoon Restoration Company to work out a settlement **. We formalized a settlement which included that the company deliver all existing parts and that the Pontoon Restoration Company would be responsible for any missing or defective parts that were listed as part of the settlement (all parts were to be photographed before delivery) Upon delivery, there were $10,000+ worth of parts missing or defective. We did in good faith try to further settle the matter by reducing the amount to $6,875 if he were to pay by 02/22/23. He has not responded by the deadline, so we are now pursuing other available avenues to recoup our money and make sure others to not fall prey to his fraudulent business practices.

    My complaint is trying to have the owner ******************* at Pontoon Restoration *** give us all the money back from ($19,428.10) when we all agreed to have him build a pontoon boat back on 10/27/2020. 2 years later & $19,428.10 later NO ********* hasn't even started. Receipts attached show a payment for $7428.10 on 10/27/2020 & another payment for $12,000 on 03/24/2021. As of todays letter he did not even buy the motor which I paid him cash for 17 months ago.In an email on 06/08/2022, he released the contract & said he would refund all the money. He stated he would refund $12,000 by 08/11/2022 (never received) & the remaining in 90 days. He has been leading us on & lying since we gave him the money. It's been one excuse after the other. I'm backed into a corner & have no recourse to get our money back. I have all ************* message's for past 18 months. PLEAE help us out...a business that does this to consumers should never be in business. I am seeking all of our money back per his contract release. Thank you, *******************
