    I traded in my previous car for a new one. The trade was for half down-payment on the new car and half in cash, so $5500 down-payment, $5500 cash. To get the check for the rest of the trade in they requested the registration which I have provided them and they still refuse to pay out the remaining balance for my trade in.

    On the 17th of July 2023 I had entered into an agreement with Briggs auto to purchase a 2022 Mitsubishi outlander. On the 18th of July I paid a down payment of 3898.00$ and both myself and Briggs signed the transfer agreement. Briggs proceeded to cash this check August 10th 2023. I also sent them the remaining balance of the vehicle in a check from **** ******* whom I had financed through.

    It was understood the vehicle had hail damage they would replace before delivering the vehicle to me. Mid August they informed me that they could not repair the vehicle. As such they cancelled the deal. Afterwards, we were unable to find a suitable replacement vehicle and I requested my money to be returned. It is now September 6th, and Briggs auto still has not returned the check from navy federal, nor have they returned the 3898.00$ from the check they had cashed for my down payment. Essentially giving them a month long loan with no interest from me. This is unacceptable from a professional business. This has caused considerable difficulty on me that would have been avoided if I never dealt with Briggs auto.

    I have tried to resolve this issue in person, however there is always some reason why they have not yet returned my money. I have since had to purchase a different vehicle from another dealer rather than the vehicle that I initially paid Briggs for. Personally at this point I don't even feel that just refunding me is sufficient action, and Briggs should be held accountable for breaking signed agreements, not honoring their deal after receiving payment, interest on how long they have had my money, and compensation for nearly two months that I went without a vehicle thanks to them.

    We remotely agreed  to sell **** ****** a vehicle that was
    still going through an extensive PDR (Paintless Dent Repair) process at a third
    party company called ****** ***** **** ******.  This vehicle had major
    hail damage and has taken over 2 months to repair at this facility (to this
    date it is still on their property and being worked on).  We communicated
    all of this weekly to **** ****** and even multiple times asked him if he still
    wanted the vehicle.  He told us yes he “has waited this long so might as
    well keep waiting.”  We never cashed his **** ******* check at all and
    therefore **** ****** never perfected a loan nor lien on this vehicle.  In
    the end, we did refund his down payment money once he decided he no longer
    wanted to keep waiting for the vehicle to be repaired from hail – he via text
    has agreed he received these funds.  We were unaware that his Navy Federal
    check (that we never cashed) was not mailed back to him so we will be doing
    that today.

    I am rejecting this response because: The business is not being entirely truthful about what happened. I will clarify. I was told it would take 2 weeks for repairs to be done. I agreed to wait. I was then told after those 2 weeks it would be another 2 weeks. I agreed to wait. I was then told it was a "no go" and that the car would take an indefinite amount of time to repair so they couldnt sell it. I did not as the business claims "decide I didnt want to wait anymore" Also when I inquired why the hail damage was taking so long to repair I was informed there were "other things" wrong, but despite my asking was never told what these "other things" were. It was bad business, it was shady, it was poorly handled and I would have been fine with just getting my money back if whoever replied to my complaint didnt try making it sound like I was just an impatient customer and they didnt do anything wrong.

    I did finally get my money back, which doesnt really make up for the time wasted, the money lost while I was out a vehicle waiting on something THEY decided wasnt going to happen, or the cost difference in the vehicle I ended up having to purchase because i had already waited too long without a vehicle because i expected Briggs Auto to honor their deal and be transparent with what was going on. They were not, and still will not take responsibility for their fault.

    Our GM got involved and spoke to the customer about 5 minutes ago.  The customer is correct and we as a team did not communicate well with him.  It was in fact Briggs that chose to not sell the vehicle to the consumer and NOT the consumer choosing to pass on the deal. Since the transaction, Briggs has refunded the funds to the consumer as requested in full and the consumer has agreed his received the check.
