Vehicle purchase date: 6/2023 for 2012 Nissan Rogue for approximately $16.000 with $3,000 additional purchased warranty.
3/2024 - brought in for transmission rebuild. Without Vehicle 5 days.
1/2025- brought in vehicle for transmission repair #2, general maintenance and evac valves,
2/2025- brought in vehicle #3 for engine light kicking on after service #2 about 2 weeks. Resulting in the same evac concern. No charge to the consumer. Out of vehicle for 2 days.
Mid 2/2025 Brought in vehicle #4 for service- evac valve kicking up different code for a similar concern.

Claim: ***** ******* sold a 2012 Nissan Rogue taking advantage of the consumer's desperation and need for a vehicle and selling $3,000 warranty to up the cost of the initial loan to the dealership by Credit Union of America. Knowingly selling vehicle to the customer under warranty without full understanding of the mechanical issues, nor making an effort to repair/ access accurately the mechanical concerns of the car. The company sells a potentially unsafe vehicle to the consumers under warranty.

Consumers believe that although ***** ******* did not charge them for the amount for the service for portions of the visit in #2 and #3 the vehicle was put into service too many times to warrant a safe consumer purchase under the federal Magnusson-Moss Warranty Act. Resolution Requested by the consumer: The full remaining balance of the 2012 Nissan Rogue is to be paid to Credit Union of America as well as the initial warranty charge for the out-of-pocket charge of the initial evac repair to go towards the new purchase of another vehicle not purchased from ***** ******* Dodge, Chrysler, Jeep, and Ram.

***** ******* paid out $1700 to credit union of American for a fix fee we paid to the company. We are not happy with this resolution. We have received communication that ***** ******* is requesting to purchase the vehicle back from us "above the normal rate". We are not interested in this resolution.

The purchase of a poorly running vehicle that the company did not take the proper steps to fix has caused me and my family financial hardships. We will not settle for anything less than the requested settlement of buying out the current loan amount to the bank, Credit Union of America. This has not only caused us financial hardships but has caused us difficulty by having to have numerous meetings with the management of Credit Union of America to come to some sort of agreement. They agree that the company in question, ***** *******, should buy out the loan due to the amount of distress the company has caused us. For this reason, we will not settle for the $1,700 paid to Credit Union of America. It is not nearly enough to cover the now over $11,000 loan buy out that we believe ***** ******* should be responsible for.

    Business Response

    Date: 05/09/2025

The complainant, was in the shop for a repair under warranty, they were in a loaner car and had regular issues occur after the repair was done to reset codes from the repair. But to own the car for over 9 months and no issues and several thousand miles in between time of possession of owning the vehicle from the dealership does not sustain us buying a preowned vehicle back. We have upheld our part of services and will continue to do the same.
