This debtor has multiple debts with multiple creditors that remain unpaid totaling over $9200. It cannot be determined which one of the debtor's past due debts she's referring to as she did not indicate which debt she's referring to. However, on all these accounts debtor never disputed the debt, requesting validation of debt within the 30 day validation period. In fact, most of the debtor's' past due accounts are 2-3+ years old.
Per 1692(g)(a), RSH can assume that the debt is valid as debtor didn't request validation within the 30 day validation period. See the following:
The FDCPA requires that an initial communication with a consumer
regarding a debt (the "validation notice") contain a statement which
includes the following information: (a) the name of the creditor and
the amount of the debt; (b) a statement that unless the consumer
disputes the validity of the debt within 30 days of the date of receipt
of the communication, the debt will be assumed to be valid by the debt
collector; (c) a statement that if the consumer disputes the debt, or a
part thereof, the debt collector will mail verification of the debt, and
(d) a statement that, upon written request, the debt collector will
provide the consumer with the name of the original creditor. See 15 U.S.C. §1692g(a).While we typically do not do this, we will remove accounts from debtor's credit bureau report, where applicable, for simply paying 70% of the balance owed. $9215.83 x 30% Discount (2674.75) = $6541.08 within 30 days from this message by credit, debit or ACH. RSH and associates made a payment plan with me for $40 a month. I was making all payments on time. On 5/12/23 they took $809.85 out of my account without discussing it with me. When I tried to talk to them about it they blamed me for not answering my phone earlier in the week and claiming it was a balloon payment plan. This was never explained to me as supposedly being a balloon payment plan. My payment was not due yet and I was dealing with my whole family being sick so I did not answer their call. Again my payment wasn't due yet and they never indicated in their messages that they were planning to take more than our agreed upon amount. When I asked for proof that I ever agreed to this charge they sent me an attachment that did not work. I tried 3 different devices. This charge was unauthorized and caused me a lot of hardship. I want them to ADMIT to doing this without my permission and to issue a refund and an apology. ******* ***** is the representative that made the $40 a month plan. ******* (last name unknown) is the one that sent the email with an attachment that didn't properly work.Business Response

Consumer agreed to monthly payments to pay off her Wellspring balance of 1209.85 with a $40 monthly plan ending in a balloon payment on 5/12/23 for the BIF of $809.85. The conversation regarding this payment arrangement, which consumer had acknowledged and agreed to, was made on Jan. 7, 2023 at 9:40AM. Per consumer's request, RSH rep ******* left multiple messages on 5/10/23 at 10:01AM, 5/11/23 at 3:54PM and on 5/12/23 at 8:54AM for any possible adjustments to the final balloon payment, but consumer never responded stating not to run the balloon payment or to make adjustments to the arrangement. Consumer never responded at all. As such, her final balloon payment of $809.85 was run on 5/12/23 as was agreed to on the Jan. 7th phone call.
After running the payment, consumer then called in wondering 'why'? We explained the situation to her and emailed her the audio recording of her agreement to the payment plan with the balloon payment. The audio recording can simply be played on Windows Media Player which most PCs have, but then consumer complained that she couldn't play the recording. She then filed the BBB complaint.
UPDATE: As of today, May 25, 2023, our payment processer informed us that consumer had them reverse the payment, falsely claiming fraud. Her account will now be charged an additional $25 fee for the costs incurred RSH making her new balance due $834.85. As she falsely claimed fraud and had her final payment backed off, her account will continue to be listed with the credit bureau and will be even after / if she finally pays her balance.
Lastly, per our agreement with Wellspring they've already pre-approved RSH to begin prepping her account for escalation to be forwarded to our attorney for suit. A notice stating this fact has been mailed to the consumer tonight and, unless in the next 14 days, consumer pays her Balance in Full or contacts our office to establish a 90 day secured payment arrangement for her balance in full, RSH will begin prepping consumer's account for final suit approval with our client.

I am rejecting this response because: their response was not accurate. Also it is my RIGHT to file a dispute with my bank and to file with BBB. They need to send me an actual working attachment of the recording where I supposedly agreed to what they claim. If what they are saying is true, my bank would have rejected my dispute.

Our client has pre-approved suit approval and has provided final authorization on other accounts. Consumer has also been notified of this in writing. If consumer wishes to halt pre-approval efforts, consumer needs to pay the money she owes our client in full. Even though consumer has reneged on the 'tax season balloon payment' plan that together we made in good faith, and included a credit bureau deletion once paid in full, RSH will allow consumer to set up an additional four month payment plan for $208.72 x 3 months + $208.69 x 1 month to satisfy the amount she owes our client of $834.85 dating back to July 22, 2019. Each payment will need to be in the form of a cashier's check or money order and mailed into our office at ** *** ***** ******* ** ***** as we will no longer accept credit, debit or ach payments from her. Upon payment in full, the credit bureau will be updated to reflect that the past due balance was paid in full.
If we do not receive the first payment of $208.72 by June 16, 2023, consumer will leave us no choice but to proceed with pre-approved, pre-legal activity. The second payment of $208.72 must be received by July 16, 2023; the third payment of $208.72 must be received by August 16, 2023 and the final payment of $208.69 must be received by September 16, 2023. Again, all payments must be made by cashier's check or money order and mailed to *** * ********** ** *** ***** ******* ** ****** Any missed payment will result in the continuation of pursuing consumer's account for final suit approval from our client in order to gain a judgment for the full amount due plus statutory interest which is allowed by law.
As a final option, consumer can honor her good faith, balloon payment arrangement and mail in a check for the full amount of $834.85 to be received by June 16, 2023 for a full credit bureau deletion.
The choice is the consumer's on how she wants to proceed.

I am rejecting this response because:The bank is still investigating the dispute. Until the dispute is finalized I will not pay anything. The provisional money is in my account and had not been touched. If the bank finds me at fault, the money will be taken back out and given back to RHS. At that time if the money is awarded to me I will resume payments and it will be what I can afford to pay. Otherwise if you win you will have the full amount. I am not paying in the meantime and then if you are awarded the money I will have to fight with you some more over paying me back any over payment. Don't do dirty business and this will not happen to you in the future.

Sent a derogatory collection report to property management firm I wished to moved into; original debt agency had no information on my report and the collection agency did not answer any of the FOUR numbers I called.

Consumer had cable or internet or phone svcs from ******** (************ **************) with a last service date of 1/18/19. He even made a payment to the client prior to this on 12/13/18. For the next 4 months, consumer refused to pay the client and was subsequently placed with RSH on 4/25/19 for his remaining balance of 71.36. In addition to consumer receiving our initial letter of demand upon assignment, we made 3 phone attempts on 4/25/19, 5/3/19 and 5/10/19 making contact with him on 5/10/19. During that communication, consumer refused payment with us and stated that he "wanted to call the client".
We never heard from consumer again. We record all calls in and out of our office. Had he actually called the FOUR times that he claimed and left a voicemail, I guarantee someone would have returned his call. He also had the option to mail in a payment from the notice we sent him, on-line via our website or over the phone with the representative that called him and he did speak with. 4 months later on 8/13/19 with no attempt to work with us his unpaid debt was reported to the credit bureau.
From consumer's complaint he is correct. He does not owe us any money. The $71.36 that he owes belongs to our client.
We will be sending this consumer another notice for the money he owes. We sometimes include a credit bureau deletion when a debtor pays their bill in full but, because of his vile words against our agency and our employees (SCAM, FRAUDULENT, ILLEGAL, LIARS), I'm inclined to not offer this courtesy to this debtor.
However, RSH & Associates is a Christian-Based collection agency. As such we will allow him to earn this same courtesy. If debtor wishes to have this removed from his credit report we would like a sincere, written apology from him to our entire staff with his payment in full of $71.36. He can simply pay from the notice that will be sent to him or he can send his check to RSH & Associates, LLC ***** *** **** ********** ** *** ***** ******* ** *****

This company is reporting erroneous, derogatory information about me which is killing my credit & my Professional image. They've refused to send any proof of their claim because they have none since this account has never even existed.
