    Business Response

    Date: 04/02/2025

    **,

In response to your claims against ***** ******* ***** visited your home on March 17th at approximately 10am. To clarify again the stairs and railings were not part of the originally scoped estimate, and was added as requested by you during the actual working of the project, in which you were told it would take additional time meaning additional cost. This site visit was to listen to your concerns with your project. During that visit you pointed out one area of concern with the abutment of the railing to the post on one railing. You personally asked C***s if this was substandard work in his opinion. C***s responded that it is not the level of work that we expect from craftsmen. This was not an acknowledgement that all work provided was substandard. C***s did take pictures of the area of concern that I have attached here, showing that this is a small repair (consisting of approximately 2 hrs worth of labor) not constituting a demand of $5000. With that being said we can offer to waive the additional $750 owed based on the hrs provided to complete what has been done to this point with the understanding that this and any further complaints that you may have is a moot point and will be handled with whatever contractor you choose with no further liability to W******* *** ******** Services.

I am rejecting this response because admittedly I did not get all of what I paid for. To date I have spent in ex**ss of $5600 for their substandard performan**.  Contract pri** is $5600.  They do not deserve this amount. If I gave them the extra time they needed to compete the project their charge would be double what they originally wanted, if not more. They have demonstrated they lack the experien** to work efficiently - no experien**.  I need to settle this matter this week. What I am seeking is $5.000  The original offer to settle included A** paying my repla**ment contractor.  This is no longer on the table!  I am being very generous by ac**pting less than what I paid.  If A** legitimately made contract mistakes they shouild submit their loss to their insuran** carrier.  This is an errors and omision occuran** which should be covered..  So why don't they want to provide their Agents contract number.  I informed ***** that it is in the best interest  of A** to settle now, the consequen**s will be very damaging

Next week I will be contacting Overland Park to request a jobsite inspection/evaluation.  They will find that the stairs and handrails do not meet Code requirements and materials provided cannot be reused.  Additionally, I think they would be very interested in sharing my file with the inspector that justifies my opinion of being victimized by the A** scam and their employees lack of proper training in not adapting generally ac**pted work practi**s.

The following week I will be filing a claim and you will be attending a court hearing to defend your opinion that I should ac**pt substandard work.

I am rejecting this response because

    Looking forward to your response.

Their is no need "to beat a dead Horse" in this case.  I am not guilty of doing anything wrong or illegal during the negotiation phase of my case.  I can't say the same about this franchise.  They are a product of their own poor management.  They rejected several settlement offers that favored them more than me. Now I wIill only settle for two days of service at, as one their employee considers,  their unfair price.

If their franchise was dependent on "permit" level work they would no longer be in business.  They have no regard for their employees or customers, they do not use resources readily available to them that would assist their efforts to work efficiently and effectively,  they have demonstrated their inability to correct deficient work, and they have failed, when notified, to control hazardous jobsite conditions,

I have scheduled an inspections by city officials that will expose their incompetence.

Pending notification of their settlement decision I willschedule a court hearing that will assure my favorable judgement.

    Thanks again for your help.

For everyone's benefit I hope you are able to settle this case!
