We entered into a contract with Dynamic Decksteriors to undertake a major repair and remodel of our front porch. After the job, there were some issues that needed to be addressed. In total at this point we have sent the company 7 emails about this matter from June of 2023 onwards. Some emails have been met with promises to take care of the matter and others ignored. Here is a full list of items that need to be addressed: 1. Tear in the screen of one of our windows as a result of roofing work. In an email, their employee said "We will have that taken care of". No one has addressed this yet. See the before and after photos. (Window Screen - Before 1, Window Screen - After Close-up) 2. This is the second point we sent to their employee: We had a question about the material used on our deck. In a couple places we have noticed that the material has chipped. Please see the attached pics. We wanted to know what the remedy for this is. Is there a method to fix this?" Their response was: "I guess I should have followed up after I sent someone over there for the screen... He said he forgot. Apologies on my end!! Let me see when I can get someone over to address the screen and touch up the decking. I will get back to you when I have someone scheduled." See the photos. (Front Porch Chipped - 1, Front Porch Chipped - 2, Front Porch - Board Bent) 3. We also want to bring to your notice that there is water leakage on the boards are now wet and discolored. Please see attached photo. (Water Leakage - Boards wet) 4. Also, we received a letter from the Planning and Development Services Department of Overland Park about the expiration of the permit for the work. Contracted with Dynamic Decksteriors in 2022 for deck work. At time of the construction, the city building inspector satisfactorily passed the eight 36" piers required. A sprinkler line was cut while digging the hole for one of the piers. While winterizing the sprinkler system last fall, water was being forced out of a small hole at the base of that pier. I found it was a short pier. The water has eroded a small cavern under that pier resulting in very little ground remaining to support the short pier. Erosion isn't covered by homeowner's insurance. The intent of this complaint against Dynamic Decksteriors is to have them resolve the above issues: 1. Fix & reroute the sprinkler line. 2. Remove defective pier. 3. Replace with code compliant pier. 4. Due to insurance implications and with 12.5% of the total number of piers (one out of 8) being substandard, I'm going to need the contractor to prove to me that the remaining piers are 36" deep per code. Problem Timeline: 2022 - MAR 2024: Enjoyed deck/ 16 MAR 2024: Emailed initial problem notification to contractor/ 21 MAR 2024: No response from contractor (NRFC). Sent follow up inquiry/ 22 MAR 2024: Contractor responded with a statement that he needs to inspect problem/ 22 MAR 2024: Asked when he had in mind for an onsite visit. Suggested 29 MAR 2024 if convenient NRFC/ 26 MAR 2024: Asked again when he had in mind for onsite visit. NRFC/ 28 MAR 2024: Followed up again re his inspection plans. NRFC/ 4 APR 2024 16:43: Called office. Voicemail stated to email all questions/concerns to ****************************** Their mailbox is full/ 5 APR 2024 09:02: Called the office. I am filing this complaint on Dynamic Decksteriors (DD) and owner **** ******. In July 2021, I entered into a contact with DD to build a main deck (16'x16') and an auxiliary deck (8'x8') with Deckorators cable DD began the work around the first part of December2021, and then stopped work the job on December 17th 2021. Cable railing and lower stairs and landing wasn't installed. I was told the stoppage was for Holiday break, at which time I was told that the cable railing was backordered for 6 to 8 months before they would come in. Early in that week, I was lead to believe the job would be completed during the week of the 17th . During that time, I paid $31,650 to DD (**** ******). Shortly afterward, I inspected on what was done. I found very poor workmanship, inadequate hardware, code violations, and the main deck was not squared. I conferred with Mr. ****** about the problems with deck; he said he would come out and take a look at the problems. After a few phone calls and texts, he came out. After he arrived, he inspected the problems with the deck without verbalizing resolutions to me. He said he would send the crew back out to work on it. Again, he insists that the cable railing was still on backorder. After many communications, no one showed up to work on the deck problems. Around January 2022, when no one showed up to work on the deck, I became suspicious of **** ****** and his company. I contacted the manufacturer and a couple of suppliers about the availability of the Deckorators cable railing since December 2021. I was told by all, "Once ordered, they would be delivered in two to three weeks." I confronted Mr. ****** about his dishonesty but he still insisted they are on backorder. After many communications, Mr. ****** continues to lie with excuses from "Still on backorder" to "l have the railing and will be out such and such date and time". To date, no one from Dynamic Decksteriors has shown up to repair the problems of the deck nor install Deckorators cable railing, lower stairs and concrete landing.Business Response

Dynamic Decksteriors recently received a complaint from a previous client claiming false
accusations towards our company and has been harassing our company for many months
with false online verbiage through review companies and social media outlets.
We entered a contract with Mr. **** ****** to build a new Cedar Deck with Aluminum
Cable railing. At the time we were in the height of major global material shortages and
manufacturing delays. We started his project knowing that we would do the main deck
and stairs, with the agreement to come back to install the railing. We were aware of the
backordered products and made him aware of it as well. Up to that point, we properly,
and satisfactorily constructed his deck per the plans, and all city code requirements were
met and properly inspected.
Unfortunately, the railing back order took several months. It wasn’t until he got tired of
waiting patiently, even though these were issues out of our control, he began bantering us
online amongst other things. At this point the threats were heavy, along with harassment,
soliciting other companies to badger us, and spread lies and rumors about our company.
At this point I sent him a contract termination agreement (see attached), he refused to
sign said document. Mr. ****** refused to cancel our agreement per our request, he
refused to pay us for the additional change order agreement (see attached) that is owed to
us. There is still over $10,000 owed from the contract to cover the costs of the railing that
he has not paid for, along with a change order that is outstanding and not paid to date
either.
Dynamic Decksteriors, received the railing order at our facility, we informed Mr. ******
about the railing order becoming available for installation. At this point he started barking
outlandish orders, made up estimate costs to use as leverage from fake companies, and
proceeded to demand a different color, even though we agreed per the contract that the
railing was to be black, in which was ordered per the color requested. We are now out the
cost of the railing for the project, and we are unable to complete the project at this point
and collect the remaining balance due from Mr. ******.
The harassment has become overwhelming and has negatively impacted the company in
many ways. Mr. ****** is purely trying to pray upon the system, claim victim role, and
push false information. We still offered to come out and install the railing, and even
deliver it for someone else to install, he too turned that offer down, and has continued
with threats. He has no motive other than try to take advantage of the system and try to
get majority of his project paid for, he is in no way willing to work with anything we
have offered. I do plan to recover our costs for our time, material costs, and change order
fees that we have had to eat due to him not paying his obligated contractual agreement.
