In february contracted to fence back yard. Had surveyor survey back yard. Told foreman who came and marked everything in orange wanted fence 6” inside survey line. Have had fence for two weeks just made 2nd payment of $4132.50. This week they started fence on neighbor property. I noticed theyre not digging holes for fence on neighbors adjacent property. I calledfence company. Fence company says town doesnt allow fences close together. Town says they do if fence is inside property line. Fence company says i have tosettle with neighbors to get money for fence line (which i dont want to share fence line). No where in contract or verbally did fence company tell me they were planning on shared fence line. I verbally told them overthe phone and i verbally told their foreman and i verbally told the neighbors in front of foreman idid not want to share a fence

Thank you for your feedback. We want to clarify that, as per the ***** ***** HOA bylaws, "(D) all fences (except for fences around swimming pools, hot tubs, and patio areas) must be joined to or abutting any previously existing perimeter fences on adjacent Lots."

We understand your concerns about your neighbor’s fence, and we acknowledge that you requested for your fence to be placed inside your fence line, which we have accommodated as per your request. However, please note that the HOA bylaws require fences to be abutted as stated, and it is not a requirement for your neighbor to build a steel fence along your steel fence.

Additionally, we want to remind you that while we value your input, calling our office and yelling at our office manager and owner is not acceptable. We are committed to resolving matters in a respectful manner, and we would appreciate your cooperation in that regard.

Lastly, we understand you’ve mentioned canceling your payment. Please reach out to our office directly to discuss any concerns further, and we will work to address them in a constructive way.

    Complaint: ********

I am rejecting this response because:

i feel the company was derelict in their general good faith business duties,

I have requested the hoa document referenced from the builder and have not received it. I never received it when i bought the house.

I was lied to by his office about lenexa county ordinances and then he must have confused

about who i was because he started raving about a “conversation” i had with him that i never had.  I dont think being shamed and “othered” by being told in a hostile voice that that is not how we do things “here” is good business practice.

discord in the community has been sewn by harcos business practices by them not explaning to the neighbors that by not building a third fence line they would be trespassing Every time they let their dogs out.  I never authorized them to let their dogs on my property.

the company should have to replace current fence to on the property line at no cost to me.  I paid full for current fence all within my property.

    Sincerely,

    ***** ******

    Dear *** *******
Thank you for taking the time to express your concerns. We truly regret any frustration this situation has caused and appreciate the opportunity to clarify and address the matters raised. We strive to maintain clear and respectful communication with our customers and to ensure that all work is carried out in accordance with the agreed-upon terms.

As per the terms outlined in our contract, I’d like to address the following:

Property Lines: According to Section b of our contract, the responsibility for establishing property lines lies with the purchaser, who is required to do so through a professional survey or other legal means. This is essential for ensuring the accurate placement of fences. While we understand this has caused some confusion, we want to emphasize that it is the responsibility of the purchaser to establish these lines prior to our arrival.

Fence Lines: Section c of the contract also specifies that the purchaser should indicate where the fence lines should be erected. We are committed to working with you to ensure that the fence is placed correctly according to your desired specifications. If there are discrepancies regarding the placement of the fence, we are happy to review the situation and work towards an appropriate solution.

City Ordinances and HOA Rules: As stated in Section d, it is the purchaser’s responsibility to verify city ordinances, regulations, and homeowner’s association rules for fencing. We understand that there may have been confusion surrounding these requirements, and we sincerely apologize for any miscommunication regarding this matter. We are committed to providing better clarity and support in the future.

We value your feedback and want to work with you to address any outstanding concerns. If you need assistance in clarifying property lines or any other aspect of the project, please do not hesitate to contact us. We are dedicated to ensuring that this matter is resolved to your satisfaction.
