    *** Lambie is building multiple homes in a small subdivision. He has been a poor steward of the land and the community in which he is building, neglecting serious health factors and living conditions affecting area homeowners. Topping the list is his lack of oversight regarding three, unsecured porta-pottys. Toilet paper with human fecal matter has blown out of the units and onto my yard and front porch on multiple occasions. There is well-documented disease associated with this. We have contacted him four times since September, 2022, and he fails to return the call or remediate the problem. Similarly, his crews neglect the most basic clean-up measures to care for the area, including leaving construction nails on the streets. This resulted in damage to my car tires and a costly tire replacement just a week before the Christmas holiday. Again, he will not return calls about this matter. Other trash from crew lunches and beverages as well as other construction materials routinely blow around the neighborhood. We watched as two chip bags swirled at the feet of his two crew members and neither made any effort to pick them up and properly dispose of the trash. This builder should be sanctioned for his gross negligence and failure to address homeowner concerns when presented with these concerns. We have been contacting him for four months, yet, in his response to my review, he lied and said they didn’t return our calls because of the holiday and a recent medical leave. First, a live person took our number on one of the four calls we’ve made beginning in September (not the holiday season) and they didn’t respond to any of them until they saw my BBB review. He is the primary builder in the subdivision. We have watched and noted the days that his crew is the only crew in the neighborhood when these problems occur and can trace them back to Lambie Custom Homes. The tore replacement bill is attached. We want to be reimbursed for this. We want the bathrooms remediated.

    you for forwarding the comments that were made and we are sorry that she has
    been impacted by the ongoing construction within her neighborhood.  The neighborhood that she is referring to is
    a small subdivision and has three separate builders within the community, not
    just Lambie Custom. We are all working closely together to try and get the
    neighborhood completed as quickly as possible.  The porta-potty’s that she is referring to are required by the city and
    are maintained by a service company and monitored weekly.  Unfortunately, with Kansas weather we do on
    occasion experience windy conditions and items may blow around but do not pose
    any environmental hazard. All of the three homebuilder's subcontractors do the
    best they can to alleviate any issues but cannot be monitored 24/7.  We did not build their home, but all of these
    same activities would have taken place while their home was under construction
    by their builder and the surrounding neighbors would have experienced the same
    issues.  We are doing our best to
    complete the subdivision within 8 to 9 months but living within a neighborhood
    with ongoing construction can be difficult at times. I have driven out to the neighborhood and inspected the area.  Attached are photos of another builder's job site that has a full dumpster that trash can blow out of.  We have contacted the builder for a pick up of the dumpster. We have also requested a relocation of the porta potty to be further away from the complainant's home.  Our office has been closed
    for the Holidays and I have been out on medical leave, but our office will be
    open weekly moving forward. Again, we are sorry for the inconvenience and are doing our best
    to get the area built out in a timely manner.

    I am rejecting this response because:

    Several flaws in their response:

    1. We started reaching out to Lambie in September. The holidays don’t begin until late November.

    2. We spoke with staff by phone. They offered nothing about a personal leave, not did they offer to hand the complaint over to someone else.

    3. Our complaint referenced nails and porta-potty waste, not dumpster trash. We watched as the crews from Lambie were using the porta potty on those days we found human excrement on toilet oaper on our property. No crews were working at the other builder’s homes those days. It’s unprofessional to point the finger at another company when there’s no direct tie.

    3. The nail damage to the tires occurred when Lambie was framing multiple homes. At that time, the other builder was not framing homes.

    4. Lambie spoke directly with one of us after he received the BBB review. He offered no apology, even when face-to-face with us, nor compensation for the tire damage.


    Be a professional and make it right, Lambie.

    All three home builders were in discussion yesterday and each have offered to cover 1/3 of the complainant's tire bill dated 12-44-22 for $370.36.  Once all funds have been received payment will be delivered to complainant's home.
