      I am requesting a refund of the lot reservation fee paid to Arise Homes, as we are no longer proceeding with the purchase of the home we selected due to misrepresentation of what we were receiving.

      On 9/2/2024, we paid a fully refundable lot reservation fee of $2000 to Arise Homes in good faith as part of beginning the homebuilding process. We later discovered that critical aspects of the home, which had been communicated to us as included, were not actually part of the home as contracted. This constituted a material misrepresentation and significantly changed the value and appeal of the home.

      Due to this, we made the decision not to proceed with the purchase and contacted Arise Homes via email on June 11, 2025 to formally withdraw and request a refund of the reservation fee. We have not received any response.

      This lack of communication and refusal to address our request is unacceptable and unprofessional. We are seeking a full refund of the lot reservation fee and a written acknowledgment of our request.

      I am filing this complaint in hopes of receiving a fair and prompt resolution.

      We responded to the complainants directly via email (attached). 
      The complaint centers around allegedly false and misleading information we provided the couple, specifically regarding the HOA in Cedarcrest, a development we build in. The couple alleged to us that we informed them there was no HOA in this community - this is not true. Practically all developments in Johnson County have HOAs. We disclose this openly on a daily basis. 
      During the long decision-making process, we held a home off the market and even allowed the couple to make selections prior to signing a purchase agreement, which we did in good faith and at our own risk. However, we did communicate to the couple on several occasions that they'd need to come in and sign a contract to continue moving forward. Finally, they did. We reviewed the contract with both. However, Alyssa had to leave abruptly. Mitchell remained and signed the contract, which we countersigned. The couple also made final selections, and both signed the purchase worksheet, demonstrating intent to enter into a purchase agreement. 
      Our counsel has advised us that the actions of the complainants is sufficient for an enforceable contract. Therefore, per the terms of our agreement, the refundable lot reservation deposit was applied as non-refundable earnest money.

      My attorney has reached out. I do not do not know if I need to reject the response again as that is true. But we are not resolved and they have not responded to the attorney at this time so I do not want this to be closed. What do I need to do?

      Filing this response again. Our attorney is in communication with theirs. We have been advised that all further communication be directed through them. This complaint should be considered resolved as far as the BBB is concerned. Let me know if I'm missing anything.

      This is an on going issue regarding poor workmanship when my home was built. I live in ****** ******** which is an Arise Development.
      Since purchasing my home in June 2023, I noticed a drainage issue due to improper grading. My property sits approximately 6 feet above the house to my east (********* ******).
      I began reporting this issue to Arise management in July 2024 and have had multiple representatives as well as one of the co-owners come inspect the issue. Arise has since ignored the issue providing excuses multiple times. Due to this drainage concern, a utility enclosure has sunk into the ground creating a drowning risk to our pets. I have been told the issue needs a french drain to direct the excessive water away from the property. I have been told my fence created this issue when the sod was installed on the house to the east. Arise notoriously ignores complaints, makes excuses, or diverts responsibility to anyone but themselves. Now it is December and nothing has been done. Even an expert hired by Arise came out and looked as the issue, recommending a French drain, but Arise claims they only suggested adding fill dirt. (I have a copy of their estimate to Arise).
      The bottom line is Arise who claims “exceptional quality homes” does not stand by their homes. They do not want to spend money on claims for repairs or warranty issues which are numerous. Multiple home owners are complaining of numerous issues to include grading, drainage issues and defective workmanship. They ignore your requests, pass it off to others and stall until the homeowner gives up or fixes the issue themselves.

      We appreciate the opportunity to respond to this complaint and provide clarification.
      The homeowner purchased their property as a resale and not directly from Arise Homes. We have requested the inspection report from their purchase to determine if this issue predated their ownership, but we have not received it.
      Despite this, we have made every effort to resolve the matter amicably. ******** ********, one of our trade partners, inspected the area and recommended backfilling with dirt to address the drainage concern. When the homeowner was unsatisfied with this recommendation, we sought bids for a French drain at their request.
      While the initial bid was unusually high, we obtained a second bid and intend to install the French drain at our expense this spring when ground conditions allow.
      The referenced utility enclosure is owned and maintained by AT&T. We reached out to AT&T, which confirmed that the homeowner must directly request maintenance for their infrastructure.
      Arise Homes has acted in good faith throughout this process, despite the issue not arising from our original sale or construction. We remain committed to completing the drainage solution as outlined and respectfully assert that we have fulfilled our responsibilities appropriately.
