      As of September 6, 2023 JLM Properties has no intentions of fixing a rat infestation in my home. I have contacted them numerous times and the problem still remains. Their only intentions to fix the problem is for us to continue living in the home and to repeatedly replace rat traps and bait boxes for the current rat infestation. I have a 2 year old daughter and our home is unhabitual and unsafe to live in due to the rat infestation. The owner ***** used profanity with me when I asked her what the company intended to do about the rat infestation. I have contacted several news stations, the city of Covington and the northern Kentucky help department and no one was willing to help. JLM Properties expects for my family and I to continue living in a home that is rat infested and that is unacceptable and they have continuously failed to honor their duties a landlord.

      ***** and **** **** rented an apartment from our company in February, 2021. We received a message
      from our answering service at 6:52am on Tuesday, August 29, 2023 that said, “PLEASE
      CALL ***** **** AT ************. RE: I HAVE A RAT RUNNING AROUND IN THE LIVING
      ROOM. SOMEBODY NEEDS TO GET IT, AND SOMEBODY NEEDS TO BOARD THE SPACES THAT
      NEED TO BE BOARDED UP.” Our professional exterminator called her back around
      7:30am and arrived at the apartment at 9:00am. Our office doesn’t even open
      until 9:30am. This was their first call to us that they were seeing rats.
      We received the following
      message at 7:41am on Wednesday, August 30th, “8/30/2023 7:41
      AM-PLEASE CALL **** ***** AT ************* RE: THERE'S RAT COMING INTO THE
      SECOND FLOOR” The rat referred to in this message was in a trap the
      exterminator had set. The exterminator returned the call around 8:15am and
      explained again it takes time to catch any rats that are already inside the
      building. They told him they’d accidentally “set off” one of the traps that was
      inside a closet in the living room, which he questioned. They did not reset the
      trap. The exterminator returned to the property after hours, around 5:30pm on
      August 30th and a relative of the tenants was inside the apartment.
      He pointed out to her that they should have called sooner before the problem
      became this bad. They had just called for the first time the day before.

      pictures of the apartment before they moved in, as well as the way the
      apartment was left when they moved out September 12th without paying
      rent. Also attached, please find the email ***** sent to us and a number of
      other entities, including TV stations and city code enforcement on September 3rd.
      (Please see two highlighted sections of her email.) By her own admission, the professional
      exterminator called her back less than an hour after her message and was at her
      apartment at 9am. Her email also confirms that we paid for their family to stay
      in a nice hotel in Covington for two nights. Both ***** and her husband, Tony,
      indicated on the phone that they were “terrified” of rats and concerned for
      their two year old daughter. We did not have to do this and no other landlords
      we’ve spoken to have ever done this for their tenants. We felt it was the right
      thing to do under the circumstances. This also afforded an opportunity for the
      exterminator to use more aggressive methods to abate the rats, since the
      tenants would not be staying in the apartment. The tenants spent quite a lot of
      time sitting in their car outside the apartment, as well as inside, despite
      having a hotel to stay in and indicating they were afraid to go back into the
      apartment.
      A third party listened to
      the entire telephone conversation Mindy had with ***** and no profanity was
      used by either party at any time. ***** was upset because we couldn’t guarantee
      she would never see another rat again. She was told no professional
      exterminator or management company could every give a guarantee like that. We told
      her we will absolutely guarantee we will do everything possible to eliminate
      the problem and prevent any more rats from getting into the building, which we
      did. Her statement to the BBB that “As
      of September 6, 2023 JLM Properties has no intentions of fixing a rat
      infestation in my home.” is proven
      false by her own email. No rats were caught on any traps in their apartment or
      the apartment below theirs after Friday, September 1st. which is the
      day they checked out of the hotel and could have returned to the apartment.
      Even the Code Enforcement officer from the City of Covington told them it
      appeared the problem was being abated, when they showed him a rat on a trap on
      Wednesday, August 30th, after we paid for them to check into a local
      hotel. That is the same picture of a rat on a trap in the drawer of their stove
      the Hill’s submitted to the BBB. We’ve attached a side by side image of that
      picture and of the stove before they moved in. It is clear that they were not
      keeping their apartment clean or sanitary and have some responsibility for
      attracting this problem, and certainly were not helpful in any way to prevent
      it.
      In our experience, after
      49 years in business, when tenants refuse to allow us an opportunity to address
      their issue and call the city, report to the BBB, contact news stations, etc.,
      it is typically because they do not have their rent. The flurry of urgent calls
      began at the end of August and September rent was never paid. I’m unsure how we
      could have acted more quickly or efficiently than we did. The city code
      enforcement officer even said they consider vermin problems to be a cooperative
      effort between tenant and property manager and agreed we had absolutely done
      all we could do to abate the issue. In fact, we never even received anything in
      writing from the City of Covington because all issues reported by the tenant
      were resolved by the next business day. The tenants broke their Lease, left
      many items behind and did damage to the apartment, as seen in the attached “after”
      pictures.

      I have reviewed the response made by the business in reference to complaint ** ********* and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

       

      We contacted JLM Properties about a rat problem June 18, 2023 therefore August 29 was not the first time a rat problem was mentioned to *****. We have every rent receipt and have called every single time a mouse or rat was seen. Duke Energy turned the gas and electric off because JLM Properties needed to call a plumber and fix the gas leak in the property.  Duke energy was scared to be in our home when they saw a dead rat in our stove. The city code inspector was even scared to go in our apartment let alone take a picture. We have your exterminator on video saying that there is nothing that he can do and he doesn’t know why you(JLM Properties) keep calling him to come out to the property. You all have rats and mice in your properties. If the lies continue we will file a defamation of character lawsuit. We have proof of everything.

      Every time the Tenant called with an issue, we
      responded. We are not negligent. The problem was abated before they chose to
      move and break their Lease. I called ***** on 6/22/23 regarding a mobile
      home we had advertised in Florence that she had called about, to tell her it was not an option
      for them since it was a different owner. I called back on 7/18/22 to give her
      the rent amount for a house in Covington and she told me they were not interested
      in that house and were going to stay at Lewis St. No work orders or issues were
      mentioned during either call. Her latest response to the BBB said, “We have every rent receipt and have called
      every single time a mouse or rat was seen.” The next time we heard from this Tenant was
      August 29th at 6:52am. So, we received NO phone calls or communication
      from the Tenant for over two months.

      The gas leak was in the first floor
      apartment, having zero impact on the Duke Energy bill for this apartment. Only gas
      service needed to be temporarily disconnected, not electric. The Tenants were
      staying in a hotel during this time and the gas was turned back on the same day
      they checked out of the hotel.

      The professional exterminator was at the Property
      today 10/3/23 and there are no signs or evidence of any rats or mice. The rodent
      problem has been completely resolved.
