    The landlord **** would harass tenants and enter the property unannounced. If I didn’t respond to his texts immediately he would enter the apartment and take the modem for the cable tv and WiFi. Also refuses to return my deposit of $1200.

    Tenant has made two statements:  1. That I entered unannounced.  2. That his deposit is not being refunded.

    1. As stated in previous correspondence, management has never and will never enter a residence unannounced.  This is a false statement.

    2. Per signed lease item 16. (k), "Smoking is not permitted inside the building...  Smoking inside the premises voids the Security Deposit."  The smoke smell in the unit was significant and the tenant was requested multiple times to not smoke in the unit.  It was enough that surrounding tenants were complaining of the smell.  The unit had to be completely painted: walls, ceiling, trim and doors; to remove the odor ($960 labor + $250 in paint materials).  An ozone machine was also used to attempt to remove odor.

    Tenant left he unit with significant amount of trash requiring two full days of cleaning with two cleaners ($500).

    The thermostat was working prior to vacating property.  Upon inspection after vacating premises, the thermostat was damaged and not working.  It appears the screen was struck as the LED screen was damaged.  ($250 replacement).  

    Tenant stayed in unit for 8 days without paying rent ($1250/month is $41.67/day * 8 days = $333.33 in lost rent plus a full week of cleaning and touch ups $291.69)

    Back bathroom sink had cigarette burns in sink.  Porcelain repair ($150)

    Total amount of damages = $2,735 plus Security Deposit voided from Smoking in unit.

    This is bordering on harassment and false accusations.  If continued, legal council will be obtained.  We have a video of the unit after move out showing considerable amount of trash and unit is very dirty.

    I am rejecting this response because: obviously from prior complaints filed against this business and showing on the BBB site this landlord keeps deposits for made up reasons. Clean up of an apartment is standard for landlords. I was not given a move out inspection form or move in inspection form. Landlord constantly used that neighbors smelled smoke to enter the apartment unannounced to “check for a fire in the unit”. A “cigarette” can’t burn porcelain. The thermostat didn’t work properly upon move in. Addressing the rest of the businesses responses is a waste of time. If he wants to file a lawsuit for harassment that’s fine I’ll do the same. I have recordings of every time he entered the property unannounced and texts as well harassing me. He also ended my lease 1 month early without an eviction notice.
