I paid 2,600 dollars deposit on polishing my concrete garage floor. Total cost was 5,200. Balance to be paid when job was complete. Job was to be completed within a week. Paid Keith enterprises, llc on July 3rd. Today is the 30th of July. I decided not to use him after he kept putting me off. I have hired another contractor to complete the job. He refuses to refund my deposit. I intend to pursue this in small claims but just wanted to file a complaint about his business practice.

Good afternoon BBB Team, Thank you for the quick notification on this matter. I have thoroughly reviewed this complaint, It appears as if *** ***** isn't relaying the entirety of the matter. While reviewing the complaint I noticed that *** ***** only included the receipt for the deposit along with the quote / invoice. It appears as if he failed to include the attachment with the service agreement which was provided via the client portal. I have provided a copy of the service agreement for reference, Please see the attached documents. I have highlighted the areas within the service agreement that clearly outlines our payment and cancellation policy. Please note that *** ***** entered into this binding contract on Wednesday July 3rd at approximately 2PM eastern time. During the quotation appointment myself and *** ***** discussed the various systems that we have to offer, as well as the process of installation for each. ***** decided on our Signature Full Broadcast System. Which is one of the most demanded systems that we offer. I presented *** ***** with a color chart, He decided on a flake blend by the name of Creekbed (FB-716), which requires what the high performance floor coatings industry considers a ''Mid tan'' base coat for best results with consideration of the flake choice as some of the base coat is often seen through the flake as flake sizes and placement may vary.

(Remainder of this description to be continued on another file as it has reached the maximum word count).

    Complaint: ********

I am rejecting this response because:

Today July 31st when I opened the email, is the first time I have seen a service agreement from Keith Enterprises, I never signed any documents. I paid him 2,600 dollars on July 3rd and the only conversation we had was he would have the job done in a week. I called and text several times and he kept putting me off, if he responded at all.
    Sincerely,

    ***** *****

At the time of contract, *** ***** was sent a link via text message to accept & sign in acceptance. ***** stated that he “didn’t do technically” as he failed to pull up the link from his text messages, ***** was then asked to sign on my IPad in which he complied by completed the above process while standing in his garage. The service agreement was directly tied to the link in which he signed in agreement to the terms and conditions. The service agreement is a document that all clients receive a copy of, as did *** *****. The agreement can be accessed anytime Via the ClientHub Portal by clicking on the link that was both text and emailed to *****. This is the first that I am hearing of the service agreement being an issues, ***** was sent a copy of the Agreement & Invoice following his cancellation Request, to which he noted that he had seen.

I am rejecting this response because:

I received a receipt via email, which I had to have someone else print it off for me because I am technologically challenged. If I signed an agreement send me a copy of it because I do not recall. We definitely did not discuss a service agreement.
    Sincerely,

    ***** *****

It’s company policy that all clients Sign the estimate / service agreement in acceptance of The terms and conditions listed on the service agreement. *** ***** receive an additional copy of this documentation via email two days after Deciding he no longer wanted to proceed with the project so that he could make an informed decision on how to proceed. The estimate & service agreement was the document that *** ***** signed on the day of contract, While standing in his garage. ***** should have a copy of this documentation as it’s been sent on several occasions, documents were emailed to him, made readily available in the Client-portal, as well as the attachment via my first response to this claim (please see the highlighted areas for reference). At this time we reserve the right to refrain from direct contact with *** ***** without a third party’s involvement, as he stated he feels it’s a legal matter now. Any contact that ***** feels we need to be notified of will need to be directed to our legal team.
