    I had agreed to a bid for installation of 18 replacement windows and had paid Kevin $5,000 deposit. The windows were delayed due to COVID and material issues which I fully understand. When the windows became available, Kevin's subcontractor arrived to install the windows and determined the windows had been incorrectly measured by Kevin. Instead of re-ordering the windows, Kevin wanted to install the windows from the outside vs. inside. I agreed to try installing 2 of the windows to see how it looked (4 were torn out). Kevin sent a different subcontractor who tore out a lot of the framing, internal molding and sills which were damaged in the process. I stopped further installation of any windows. Kevin would not return phone calls or texts until I threatened legal action. Through my persistence, I eventually was refunded $3,377.00 on 12/13/21. We agreed I would receive the remaining dollars once the 4 windows installed by Kevin's team were removed when I had another contractor install windows. I contacted Kevin on 5/31/22 to let him know my new windows were installed and to refund me the rest of my deposit totaling $1,623.00 and pick up the 4 windows his team installed. He said he didn't have the money & would get it to me as soon as he can. Once again, having not heard from Kevin, I reached out again 11/4/22 and still have not received my $1,623. I incurred additional expenses having the window frames rebuilt and repairing molding. This issue has been left to me to resolve even though I did NOT create the issue and I'm the customer. I want to be reimbursed the remaining $1623 of my deposit.

    Hello I'm Kevin C****** owner of C****** Construction LLC. 
    I'm writing about ******* ******* 
    ID # ********. She nevered explain whole story correctly and truthfully. 
    When I replace windows,  I replace the whole window not just the shases. You pay for windows you should get whole window. That's my opinion but some contractors don't do that. Which that's between the  contractors and customer. 
    When I and ******* sign contract she nevered said anything about not replacing the whole windows.  When I ordered the windows 2 of them when installed had a 1/2 " gap at the top. So my contractor install more insulation on the top of the windows. It was sealed and trimmed out correctly. You couldn't move them  at all and it look very nicely.  We had installed total 5 windows and 2 had the 1/2 " gaps. There were a couple of scratches on the inside trim because of the install. They were mild, little sanded and little paint, you would never know it happened. I even said I'll paint all the trim around the window. The color of trim was White not a special color.  That still didn't make her happy. ******* said , " I'm to O.C.D to deal with the 2 windows that were installed with the gaps , I'm afraid of thinking I will a draft coming through. "  Which there wouldn't be any drafts because how it was sealed. I also installed a sliding door.
    I showed her the measurements of the other windows that will have a 1/4 gap or less. Which that's really good.
    It didn't matter she still kick me off the job. That was totally wrong . I could've took her to court. My lawyer wanted me too. I didn't want to , which I should've after all that has happened. I picked up the remaining windows.  I left the five windows and the sliding patio door because they were installed. I gave back most of her money. Only reason why I didn't give her all the money back because she didn't want to pay for the sliding patio door. She wanted it for free. She still made out because I didn't charge her the whole amount of the patio door or charge her for installing it.
    When she had another contractor come in installed her windows I nevered got the 5 windows that were installed.  ******* still went on BBB, ****, ****** and other sites to smear my name. She had know right to do that. I had other more important matters to take care of while this was going on.  I've would have took her to court for sure if I didn't have the matter  what I was dealing with.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

    Contractor still takes no accountability for his mistakes and is only responding to my complaint now (2 years later) because he's realized I've shared my experience in public forums to avoid other people having the same experience I had with Kevin.

    His response is inaccurate.  His original subcontractor refused to install the windows because of Kevin's measuring mistake as the subcontractor knew he couldn't install them appropriately, and he didn't want that to reflect back to him (which I don't blame him).  Kevin then hired another subcontractor to install the windows.  They installed 4 windows and were having issues installing them correctly for the same reason the first subcontractor refused to do the job.  I could tell there would be issues w/the install and I halted any further installation.   At that point with the lack of communication and issues encountered, I knew it would be best to not move forward with Kevin. 

    As I stated in the original complaint, and as all other contractors have stated, Kevin should've immediately re-ordered the windows to the correct measurements, but he didn't want to assume the loss; therefore, it became my issue. 

    Kevin fails to remember several attempts by me to contact him via text and voicemail to pick up the 4 windows and pay me the remaining money owed to me.  As was par for the course, Kevin never responded to any of my attempts to communicate because he owed me money.    The windows still sit in my garage, and I am more than happy to give them back to Kevin if he pays me what is owed to me.  However, since he knows he owes me money, I'm sure the windows will continue to sit in my garage.
