Contacted **** ****** because I was considering a pool in June 2023. Text messages attached show **** telling me the pool would be done by August 2023 if I put a 30k deposit down. Texts also show constant excuses on why the pool could not be complete. It is April 2024 and my pool is not done. Unfortunately, I found 4 other families that were told the pool would be an 8-9 week job and it took approximately the same amount of time. Constant excuses, defensive emails when a customer has to be confrontational about why the project is taking so long. I can’t even go through all of the excuses but attached texts to show how excessive they are spread over the last several months.Initial Complaint

He took $16,000 as a down payment to build a pool house and told us he couldn’t find anyone to do it but won’t give us our money back. Also installed a $15,000 pool cover incorrectly (which he admitted he will fix as it is dangerous and prevents us from entertaining at our pool) and stopped communicating with us and has not fixed itInitial Complaint

- Oct 2021- Signed contract and gave business $26000,00 depost for in ground 12/24 pool May-2021 Excavation started, then hole sat for month. He said he had pools ahead of us From May until present day the pool is finished to point of being filled with water. Between May and now he has given us excuse after excuse as to why he couldn;t work to finish pool. Can't get bags of concrete, which we were able to call and get them within a few days. They sat in garage for 2 weeks because we still had pools ahead of us. Excuses used, to hot to do Concrete. I guess they don't work before 11 when it was getting hot. It is obvious he had no intention of finishing our pool with 2 weeks of excavation. Our concrete forms have been out for 2 to 3 weeks and no concrete decking. He has told us several dates when it would be poured and it never happens. Yesterday, 08/20/2022 they were supposed to pour and they never showed up. and we never got a courtesy call. My wife texted and called and he said over the phone his concrete motorized buggy was in the shop, and all others were rented out. I called ******* rentals and they had one available all day long for rental. We have caught him in so many lies that we have don't believe anything he sys anymore. Nothing happens we he says it will. Our backyard is a disaster, dirt piles dead grass, and we have been unable to enjoy it out back. We have every written communication saved of all of his excuses and we have lost confidence in him. Everytime he asked for money we have given it to him. Called several other pool contracters and they say it is a bit harder to get supplies, but they are finishing pools from start to finish in 3 weeks. He has not once offered to compensate us for all the delays and frustrations he has caused us. He likes to attack and blame the customer for his lack of organizational skills and all his white lies so we will stand by for that. Stop stringing us along for 3 months and 2 days and finish the job.Business Response

Pool companies installing pools in a three week period are not our pools. We see those company's pools, nothing wrong with them but they are not what you ordered from us. Ours is custom and a little more complex. We would like anyone to compare. Please provide those photos. Plus most companies do not do start to finish entire jobs, pool, concrete, electical. We have done absolutely nothing wrong. We are behind but we wont finish a project just to say it was done quickly. We tell everyone weather is our biggest foe. This year everyone knows the rain and heat we have had. We have been pressured into pouring concrete in extreme heat and it resulted in some cracks. We learned from that leason and we will not repeat hurring a project. We have more than one customer who has been behind but once everything was done they realized we had their best interest and they were extremly happy. At the end of the project it will be right. We save all communications, I record EVERY single phone call that goes out or comes into our phone. Again weather has been our biggest issue as well as material delays. This customer has first hand experience in helping us with getting a cement mix and stated how long it took to even get through to someone to talk to let alone find and pay for cement mix and it had to be done in multiple orders and from multiple stores. This was time spent that we just cannot do everyday and also stay productive and profitable. We custom build our own steps and ledge systems. We learned to do this when covid hit. Manufacturers of these systems closed down prodution so orders were back logged for months. While other companies made their customers wait or change their pool layout we manufactured on site our own system. Result, HAPPY customers. Others weren't. We wont make everyone happy depending the circumstances, but we try. We have a small amount of sand and gravel to remove and the remaining dirt that is left is top soil from the original yard to grade for customer. We owe the customer their heater, an exchange on their cleaner, wrong one delivered from supplier, it was for an inground pool, and a ladder. We address entry points to a home that our equipment has to enter, once done it is the only way we bring in our heavy equipment to minamize consequential damge. In this case as with 90% of all customers it is across a sidewalk. We know its going to crack. Same as customers are responsible for sod and or grass repair. We know we will damage turf due to the process. No one is happy with delays, us included, but it happens in our business and we tell every single customer it is likley. We never know the extent. This year which is certainly verifiable, rain has been more than above average on 2 extended periods, couple that with the extreme heat that delayed concrete work of all kinds, it has been more that difficult and trying. We can only promise to finish timely as possible.
