    We paid in advance for food truck catering services during a family reunion held at our home. A few weeks before the scheduled event the vendor contacted me by cell phone to inform me that he "lost the truck" in a disagreement with his investor and the "money is gone". He then offered to cater our event out of a tent rather than the food truck we hired. I emailed the vendor the following week and requested a full refund due to his situation. He has not responded. The paid invoice and email chain of correspondence between he and I has been uploaded for review.

    First off,

    Let me state that Mr. ***** is a good man and a wonderful person. However due to the situation we attempted 3 times to fulfill Mr. ******* order and he consistently canceled on us or changed the date. Upon the final time he stated he wanted his money back I was honest in advising him that at the moment the business was shut down due to restructuring and we could find other avenues to fulfill it he said he would talk to his wife and get back with me. At the current moment Mr. ***** has  filed to get his cash back through our square POS and they removed the money from us. We are in dispute. We wish him and his wife the best however we have spent several days on planning and attempting to get this order serviced. It is not us who canceled several times. We are very sympathetic to Mr. ******** situation for the first cancellation though and will not be stating the reason for it on here. We wish him the best of luck. We are truly sorry it came to this and had hoped to work out a mutually beneficial end to this, even though not in operation we were willing to fulfill the order and had the means. We never stated we would give a refund on the payment.

    I am rejecting this response because: the submitted response sounds nice but evades the primary issue being contested.  The vendor was paid 100% in advance in good faith for a service that has not been provided and, ultimately, was not provided due to internal issues between the vendor and his business associate(s).  I am simply requesting a refund due to non-performance on the part of the vendor.
