      Slemco, contracted a tree company. ******** tree company to cut trees, They never let us know they would be coming. They went and told my sister at her house not us. We got up, to see they were in our yard cutting our tree, totally messed up my tree, but worst of all the truck was in my yard and collapsed my drainage. We were never notified or contacted about them coming in our yard. ****** the supervisor with ********, with tree company came out. And **** with Slemco, came out. I finally contacted them again. They both came back this morning and trying to cover up the fact that they are not going to do anything. We now are flooding when it rain because of collapsed drainage. I have a video of the flooding problem because of this. It won’t let me down load it. I have witnesses that the truck was parked over my drainage and then pulled all the way in my yard. Messed up my solar lights and my flower bed. I want my drainage fixed they are responsible and I have everything I need to prove it.

      I spoke with our Right of Way supervisor. Both companies met with Mrs. ******** husband. He was understanding of the tree-trimming process. The husband also advised us that DOTD showed up to clear the drains due to drainage issues, and Mrs. ****** stopped them and suggested that ******** would do it. We have pictures of where the truck drove in the yard; they are not over what she claims was damaged. If she wishes to pursue this further, she must contact ****** with ********.

      We have attached images that show ******** tire tracks to the left of the hole in her pictures.  The grass in the hole is much longer, which would suggest that this hole was there prior to ******** arriving to trim the trees. The white jug marks her hole and the black just marks the nearest tire tracks from ********.  The image she provided shows the truck in the yard to the right of the pole which is no where near the hole. As for the DOTD comment, we were provided that information by her husband. SLEMCO see no further action is needed.

      While receiving medical care away from home, someone unlawfully gained entry yiu home and accessed my accounts. They attempted to reconnect electricity in the name of an individual incarcerated by using an ID they found at my residence. They drafted $165 from my checking account to pay the deposit. Slemco called the landlord and confirmed there was fraud. I was notified and immediately advised Slemco that I had been hacked and the individual was incarcerated for 11 years(sent proof) and requested my money be returned to my account. Customer service (refused to tell me their name) wrote a refund check to the person's name anyway and mailed it to the address the hacker provided them with. They got the check and cashed it with the stolen ID.

      We have emailed the member to let her know that all contact on this account will have to be done in person. Multiple emails came from her email, which she is still currently emailing us from, stating that she sold the trailer to the landlord. We reached out to the landlord, and he stated that he had not issued any new leases or documents on this property.  He also confirmed that she has been living there and still is.  We emailed her, and the new party, which she was coping in the emails to SLEMCO, that the landlord stated he had not issued anything for this location and the documents were fraudulent. As soon as we did that and denied service, she started emailing from the same email, claiming fraud. We informed Ms. Richard that all communication must be done in person due to the fraudulent claims on this location and have since found theft of electricity at the location.  No check was mailed back to anyone because the check came back to SLEMCO as NSF.

       

      She is claiming fraud on her account, but she knows everything about the new party that was trying to connect.

      I am rejecting this response because:

      The information sent by Slemco is not completely accurate and misleading. I'm not sure when I'll be able to find a ride. Along with three other surgeries in the near future, I have to have a shoulder replacement.  My medical issues are the reason I applied for the assistance with my bill before it was shut off.  All of this has become so complicated, you're probably confused, too. I will try to explain from the information I've gathered together. 
      My lights were shut off and I went stay with friends bc of required medical devices. The landlord lives out of town and isn't a witness to say I do it don't live there. I pay the lot note each month. While away from home, someone began squatting in my house. While there, they found my friend, ****** ******** personal belongings sent home to me from jail when he was arrested and sentenced to 11 years in prison. Included was his wallet with his DL and soc sec card, etc. They also located the passwords to my accounts. Using my online bank account, they paid the permit and deposit to reconnect the electricity. They used my email to communicate with you. I received a phone call from my landlord questioning the contact Slemco made with him. I immediately informed y'all that I was hacked. I requested that the money from my account be refunded and included account information and also the article from the Internet detailing ****** ********* arrest and 11 yr sentence. I was told a check was mailed to ****** ******** this the reason for my complaint. I know nothing about stolen electricity. I am aware of what was sent to Slemco bc they used my account. I'm the one who reported that my account was being used.

      As a consumer who is protected under the consumer protection laws, I feel that my rights under the Truth in Lending Act have not been respected. Furthermore, I was not provided with a full disclosure of the entire credit amount on my account 4519749701. I applied for personal/ family open end of credit on 15th November 2023. My account was created a with positive status of credit. The attached remittance coupon and the bond are located at the top of my statements.
      Despite my attempts to resolve the matter amicably, both Slemco and its representative have repeatedly refused to accept my lawful form of satisfying the account.
      Instead, they insist that I overpay on the account or face the addition of late fees or junk fee penalties, both of which are prohibited by law.
      Given these circumstances, I request a FULL AUDIT of the entire financial account balance to determine the accuracy of the charges and a reinvestigation of all prepaid/extension of credit (incoming credit transactions). Additionally, I seek all refunds of the entire account balance owed to me as the consumer and invoke my rights under 12 CFR § 1026.13 - Billing error resolution, 15 U.S. Code § 1666b - Timing of payments & 15 U.S. Code § 1666d Treatment of credit balance.

      We received a payment stub in the mail on 1/5/2024 with no payment.  We reached out to Mrs* ******* to inform her that there was no payment included with her payment stub.  She stated that the stub was her payment on her account.  We advised that she could not use her stub as a form of payment on her bill.  We mailed her stub that she sent into our office along with a letter informing her that we could not accept her stub as payment on her account.  No additional fees were charged to her account and her bill was paid as of 1/10/2024 through our website.  She did reach out to us today informing us that her payment might come back, and she may need to pay it again.  At this time, no payment has been returned and no additional fees have been charged.  Should the payment come back to us, fees will be applied to the account.

      (d) Rules pending resolution. Until a billing error is resolved under paragraph (e) or (f) of this section, the following rules apply:

      Official interpretation of 13(d) Rules Pending Resolution

      (1) Consumer's right to withhold disputed amount; collection action prohibited. The consumer need not pay (and the creditor may not try to collect) any portion of any required payment that the consumer believes is related to the disputed amount (including related finance or other charges). If the cardholder has enrolled in an automatic payment plan offered by the card issuer and has agreed to pay the credit card indebtedness by periodic deductions from the cardholder's deposit account, the card issuer shall not deduct any part of the disputed amount or related finance or other charges if a billing error notice is received any time up to 3 business days before the scheduled payment date.


      I want to clarify that my request is not for a
      basic account statement summary. Instead, I require a comprehensive overview of
      the exact amount credited to my account per 18 U.S. Code § 8 - Obligation or
      other security of the United States. To be more specific, I expect a thorough
      financial audit of my account, like what would be conducted during a tax audit
      with the IRS. I insist on seeing the account books of open-end credits, which
      should contain all relevant details.
      I hope you understand the importance of addressing
      this issue promptly and in an appropriate manner. I trust you will take
      immediate action to rectify the situation. Kindly provide me with a detailed
      account audit and ensure that all discrepancies are adequately explained and
      resolved.

      name, and servicing address as stated in the attached billing error notice was
      given for locating the bookkeeping and financial balance sheet.

      company's actions have restricted my access to the credits rightfully belonging
      to me.
      This is in direct violation of 18 U.S. Code § 8 -
      Obligation or other security of the United States, according to 18 U.S.C. § 8,
      obligations of the United States include:
      All bonds, certificates of indebtedness, national bank currency, Federal
      Reserve notes, Federal Reserve bank notes, coupons, United States notes,
      Treasury notes, gold certificates, silver certificates, fractional notes,
      certificates of deposit, bills, checks, or drafts for money, drawn by or upon
      authorized officers of the United States.
      Stamps and other representatives of value, of whatever denomination, issued
      under any Act of Congress, and canceled United States stamps.
      Any security, obligation, or banknote issued by a foreign government or
      authority that is recognized by the United States.
