    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    [The Elks Organization states that they received the money that the riders gave to the captain of the float. The *** has **************************** through ****** and Associates; therefore, they should be responsible for giving riders a refund. Especially because the cancellation was not due to any fault of ours and it should NOT be considered a donation as stated in their response.

    Good afternoon,

    In response to the complaint that you received regarding a refund from our organization, due to the parade being cancelled, I offer the following:

    We are a non-profit organization that offers a position in the Elks, Krewe of Orleanians Parade (EKO) for the truck floats only. Each truck captain, who is independent from ***, registers their own truck float with EKO, which is a Charitable donation to our Lodge's charities.  Each truck float is either owned by an individual or krewe, which is comprised of individuals. The people who ride on these truck floats pay the truck float owner and or krewe to ride, *** does not collect any funds from the individual riders themselves. The only funds *** receives is from the truck float owner / captain. The individual truck floats sell positions on their respective truck floats, again, *** does not collect these funds from the individual riders. As far as the Event Cancellation Insurnace, each truck float is responsible for obtaining their own insurance policy and the consumer can file a claim through their truck float captain, which I understand is ****** ***** **************. Mr. ***** would be the person in possession of the insurance policy which would be needed to file said claim. In closing, *** only offers a position for the truck float in the parade, each truck float is their own separate entity which sells positions on their privately owned truck float, and they are the ones that would be responsible to offer a refund of the consumers funds.

    The only funds received from Mr. ***** totaled $600.00 (registration Fee) which every truck in the parade pays to EKO - these funds go towards the Elk's many charities including but not limited to ***********, Drug Awareness, meals for homeless Veterans, College Scholarships,- just to name a few. Each truck is their own individual krewe (club) which charges their riders to pay for their own expenses such as rental of their truck, driver, decorations, throws (if they provide them to their riders), and insurance. Each truck is required to obtain their own insurance, and the complainant needs to contact Mr. ***** and file for "event cancellation" reimbursement through the insurance which he obtained by using the funds he obtained from his riders. As the parade was not cancelled and only rescheduled - EKO is not responsible for any reimbursement to riders as the event was not cancelled but rescheduled to a different date. The responsible party for any reimbursement (if warranted) would be Mr. ****** ***** - Captain / Owner of the Truck Float.

    The 1st response from the *** said the money was forwarded to them and it was considered a donation. Now it is something else. Well, I have spoken to Mr. ***** and he says the money that the riders forwarded to him was forwarded to the **** Everyone is passing the **** in order to keep the riders money. This is absolutely awful!!!
