    Spillers Contracting LLC took a $16,125.00 deposit from Cross Keys Bank to apply vegetation killer, open up all drainage ways, brush and clean entire parking lot, tack areas to be repaired, seal 113,000 sq ft of parking lot with commercial grade sealer, repair 600 sq ft of asphalt (potholes) and restripe existing painting markings including all handicap areas. Spillers Contracting say they killed vegetation, filled potholes and cracks in preparation for sealing the parking lot. Spillers has not provided Cross Keys Bank nor the Court with receipts for materials purchased for the job. Cross Keys Bank has seen no evidence that Spillers did the work he says that he did. Cross Keys Bank hired another company to do the job.

    This was all during COVID. Receipts were provided to Mr ****** and a job this size takes a long time to properly prepare to be sealed and striped. It can't be done in wet or cold weather. It's a seasonal job. We did all work when we could. I had a meeting with Babette ****** and the president at Cross Keys Bank. At that time, they had hired someone to come out and put loose asphalt just thrown in a few little holes. We had already repaired the major potholes and crackfilled the south parking lot and was ready to seal. Shook hands with the president and agreed we were going to seal that part and I explained to him the asphalt had deteriorated which is what took so long to prep it. The president, after leaving the meeting, about 15 minutes later texted me and requested not to seal the lot, but wanted a bid to repave the whole parking lot. The next thing I know, it's being torn out and replaced with concrete. So if I had done something so wrong to them, why would they want me to continue on and add a bid for over $150,000.00.
