On September 1st 2022 I signed on as a real estate agent with ****************************************************** in *******************. They are an associated brokerage, meaning I needed to join a ** ********************* Since I was signing on in September it was pro-rated for the amount left in the year. I was charged $385 on September 1st to be a member. Unexpected event caused me to no longer be able to pursue my real estate career at this time. I had never even signed into my account with NorthShore Realtors. They were notified by ***************************** that I was no longer going to be a member. When I called today I was told I could not be refunded. I reminded them I was never really a member. From Sept 1st to September 8th when I was released from my contract they want to keep my $385.

    Business Response

    Date: 09/21/2022

On 9/13/22, ******************************* called the *** offices and spoke with *** Staff. A refund of the submitted prorated dues amount and application fee was requested. ******** was informed that a letter could be submitted to the *** Board of Directors for review and approval at their next scheduled meeting. Staff of the association does not have the ability or authority to approve and supply a refund of dues or application fees. A letter has yet to be received by association staff. If a letter is received it will go before the Board at their next scheduled meeting.

Attached is an image of the first page of ********'s application, which was signed by ******** over DocuSign and submitted on 9/1. The highlight is mine, showing that in the first sentence of the application it is stated that dues and any application fee is non-refundable.

Additionally, the following is stated in the *** Bylaws: "Applicants for REALTOR Membership shall be granted Provisional Membership (which shall be considered a status of, rather than a class of, membership) immediately upon submission of a completed application form and remittance of applicable association dues and any application fee. Provisional Members shall be considered REALTORS and shall be subject to all of the same privileges and obligations of Membership." It is further stated that "Dues shall be computed from the date of application and shall be non-refundable unless the Associations Board of Directors terminates the individuals membership." In this case, the Board of Directors may in fact terminate ********'s membership because of not completing "all of the requirements of membership (for example, completion of a mandatory orientation program) within ninety (90) days from the Associations receipt of their application." If that is the case the *** Bylaws outline that "In such instances, dues shall be returned to the individual less a prorated amount to cover the number of days that the individual received Association services and any application fee."

Association Staff is available to work with ******** through this process and provide any additional information necessary.
