************************* engaged ** for a 2020 tax preparation and we completed his 2020 Federal and State tax Preparation. The price of an original tax return does NOT included an amended tax return.

This customer never engaged ** for an amended tax return. He contacted our office during September where we assisted him with other post-filing matters on his ************************* touch with ******* throughout the process. Our response time on certain calls is slower during the 9/15 to 10/17 period.

I personally advised ******* that we would be able to start his amended tax return preparation under a new engagement about 6 weeks after 9/17. ******* began calling our office around 10/1 under the impression that the tax season ended 10/1. The tax season ends 10/17 and we were unable to respond. We had planned to begin this project the first or second week of November.

Since we were not ultimately engaged for this project, we were unable to ultimately perform it. This is not a pricing matter - we had never offered pricing for this engagement nor officially were engaged.

This webpage only permits four attachments.  I have a screenshot ******* caddy that shows that I inquired about amending returns as early as May 21.  Email 4 demonstrates that I inquired as early as June.  This does not include verbal communications as well.  At no time did anyone explain that an amendment was separate from services.  That said, Email 1 and Email 2 demonstrate at the time of filing our taxes for 2020, we indentified to the tax agency that we had moved to *****.  Therefore, the returns were not correct, though we identified this at the time of preparation.  In this instance, I would have expected that since the error occured on the business' end, that correcting this would be included.

If that is not the case, please let me know.

      Dear *******,

Per our engagement letter, it is very clearly stated, that if a return is filed and then an amended return must be filed, it is under a separate engagement.

We told you that we would begin this engagement and are still willing to do so. We have attempted to contact you several times since you filed this complaint.

Even though some of these issues were identified during the preparation process, you had signed the filing as prepared and we filed it. So we must file an amended return.

We will still prepare this without a fee but you must sign a new engagement letter for IRS Circular 230 compliance purposes. If you can simply respond to our communications and sign the EL, we can complete the amendment. This was always the case.

Stating that the amendment is "included in our return" is false, it is always a separate engagement. We are glad to engage you and do it for free.

What other resolution do you seek here?

      Thanks,

      Dmitry
