      This company claimed to be able to help me fix an erroneous entry on t credit reports. I paid them their monthly fee of $49.99/month for 10 months. They used my CreditKarma credentials to pretend to be me and made no progress against the Elan issue on my account.

      Thank you for taking the time to tell us about your experience. I am sorry that your experience did not meet your expectations; please allow me to express my sincerest apologies. According to the latest information, the **************************** and Sequium collections have been removed from your credit reports.

      Regarding the ************** account, a divorce decree can assign responsibility for a debt to one spouse, but it doesnt necessarily change the original terms of the agreement between you and the creditor. Creditors report to credit bureaus based on the accounts activity and the borrowers legal obligation as defined in the original credit agreement. Even if a divorce decree assigns the debt to your ex-spouse, the creditor can still report the account to your credit report unless it is formally discharged or settled with the creditor. This happens because, as far as the creditor is concerned, you remain liable for the debt unless you have satisfied the debt in full. Therefore, a divorce decree does not supersede the original credit agreement unless the creditor agrees to modify or discharge the debt, which is not always the case. 

      We have submitted multiple rounds of disputes, including Section 609 requests, to the credit reporting agencies, and our legal team has directly reached out to ************** to request the removal of the account. However, both the credit bureaus and ************** have declined to remove the account from your credit report.This is a common challenge in cases where divorce proceedings assign responsibility for debts but don't necessarily absolve the individual from the original contractual obligations.

      Despite not processing a payment in the last five months, we have continued to work diligently on resolving this issue on your behalf. We appreciate you sharing your concerns with us, and we sincerely hope that this matter is resolved for you soon.

      This was not explained to me during the engagement. Had I known that this could be the case, I wouldnt have engaged you beyond the first month. Multiple times your company said you were working on it. Never once did you indicate that this was a possibility. I feel misled by the very limited communications from your company and feel that I overpaid for the services received. I also fail to see how you could continue working on it after I changed the password on my CreditKarma account months ago. I see no evidence that there has been any effort beyond the initial CFPB complaints done in the initial month.

      In accordance with the Fair Credit Reporting Act (FCRA), credit bureau disputes typically require 30 to 45 days for resolution. Additionally, requests for method of verification are subject to a 15-day completion period, while Section 609 requests may take up to 30 days. Investigations initiated by the ************************************ (****) may take up to 60 days to conclude. These represent just a portion of the investigative steps we have undertaken in your case.

      Moreover, our team has engaged with ************** and the Cook County Court on multiple occasions in an effort to resolve this matter. We also worked diligently with the District 3 Court in ********************** to obtain an order compelling Elan to remove the account and eliminate the associated trade line from your credit reports. Unfortunately, the court did not grant our request.

      Please understand that each of these actions involves a considerable amount of time and effort to process. We regret that we were unable to achieve the removal of the Elan account at this time. However, we want to assure you that we exhausted all possible avenues to make this happen, and we still believe there may be a possibility for success. As a gesture of goodwill, we are prepared to continue working on the removal of the Elan account for an additional ************************************* order to complete the process.

      You would not be able to engage a court on my behalf without my involvement. I dont believe you took those actions. I do see you filed disputes on my behalf, which I had done previously on my own with the same results. There is no value in those actions. You also reported to the ****, with the same results as my actions. You did nothing unique that I didnt do myself. You charged me $500 to do exactly what I did with the same results. I want a refund. (I also question if it was legal for you to impersonate me with the credit bureaus and ****. Maybe Ill ask them.)

      I signed up for their credit repair program in November 2022 at $49.99 per month. In December, I emailed asking how many months so I have an idea how much money to pay. They email back they will work on this ASAP. In the past 10 months, there has been 0 activity on my account. The stats have remained at no changes since the first month. They have taken my money under false pretenses. I emailed them today to terminate my account. They need to reimburse me the $499.90.

      Thank you for contacting us via the BBB's complaint system and allowing us the opportunity to answer any question/resolve any issues.According to your communications, the main issues that you were concerned about was resolving the incorrect reporting of several accounts in your credit reports which were included in a Bankruptcy filed in 2020 but, were still reporting as charge-offs or had late payments.You specifically advised us that there was a *** account that was included in Bankruptcy that was reporting 11 late payments, a repossession notation in the payment history, and charged-off status. As of today, 10/4/2023, the *** account was removed from your Experian credit report. Equifax and TransUnion are reporting the *** account as never late with 0 late payments and 0 charged-off/repossession statuses or remarks. The ********** **** account was removed from all 3 credit bureaus. And the remaining accounts which were included in Bankruptcy are all reporting as "Included in Bankruptcy", without any late payments, and no charged-off statuses/remarks.

      These results were achieved from several rounds of dispute letters to the credit reporting agencies, validation requests to ***** Nexis and LCI regarding the Bankruptcy public record to gather the appropriate documents to provide to the credit bureaus and furnishers, section 609 letters to the creditors reporting the inaccurate information in your credit reports, and complaint/removal requests to the CFPB for the inaccurate information.

      Attached, please find a copy of your credit reports from Equifax, Experian, and TransUnion dated today (10/4/2023), as well as the account details for the *** account as it was originally reporting when you enrolled in our services. Based on the the positive changes and the fact that we were able to achieve the exact results that you requested when enrolling in our services, we will be unable to provide you the refund that you requested. If you have any questions please do not hesitate to contact us at any time.
