      I bought a new construction home from *********************************** Shanti Acquisition and Development LLC in November 2022. ****** misrepresented the house on the listings, and had his real estate broker do the same, by advertising the house as having two common lawns in the back of the complex that all 8 units in the *** could access. The cost for this land was built into the sale price of the home. Aftewr closing on the house, we discovered that the common land was deeded to the two units in the rear of the development that directly abut the lawns, and the other 6/8 of the units in the *** have no access to the land we paid for.Additionally, ****** agreed to repair issues that arose during our home inspection that were included in the purchase and sale agreement that he signed. He also signed an additional document our bank required before closing stating the repairs had been made. ****** did not make the repairs, however, and now denies agreeing to make them, despite signing the two documents stating he would/did make them.Also, our house is under a builder's warranty and ****** is ignoring our requests to have claims that are covered under the warranty resolved. He knows that it is cheaper for us to pay out of pocket to make the repairs than it is to get a lawyer and hold him accountable. He knows that if he does not make the repairs we cannot do anything without retaining a lawyer and pursuing litigation to hold him liable.Lastly, the manner in which ****** went about getting the approvals to build our development are highly corrupt and display nepotism to the highest degree. The local neighborhood and abutters groups spoke out against the construction of our development since there was a historical building on the lot prior, that they wished to preserve. ****** had his friend on the zoning board overrule all the neighborhood groups and approve the development. Shortly thereafter, the zoning board member's real estate company was given all 8 listings.

      I have not heard from the business in response to my complaint.

       

      This is what ******************************* does.  He ignores people he has an obligation to provide services to or anyone and anything that is inconvenient to him because he is an ego maniac that thinks hes above us ***** little customers of his.  He is already off working on his next development and lining up a new lot of customers to scam.

      This is all lip service and basically a copy and paste from their website before it was taken down after receiving my honest and fair review of their services.

      Lets readdress the facts:

      The land that was advertised as being common, which we paid for, does not belong to us.  The owners of that land have since erected fencing around it and it is their private property which they retain exclusive rights to.  What ****** said about other owners being able to access other peoples property with their consent is a sorry excuse for his nefarious business dealings, and he knows it.  The bottom line upfront is it was advertised as being common and it is not.  Do you let your neighbors kids play in your lawn or do you let your kids walk down the street to play on someone elses private property without their consent?  No, you dont, because this is not a socialist country we live in and owners assume legal liability should something happen to my children while playing on their private property . ******************************* misrepresented this land intentionally to maximize his profits because that is the kind of person ****** is.  He will take advantage of anyone to maximize his profits, as he did to us and the five other owners in our HOA he wronged to make a few extra bucks on his poorly constructed homes.

      The part about certain builders warranty claims not being within the scope of the warranty is not the case with us.  When an **** system does not work because it was installed improperly it is to be fixed, under the warranty ****** provided.  He can spew falsehoods all he wants but the fact of the matter remains; this is a coverable claim.  One that can be fixed for $1200-$1500.  We spoke with his **** contractor yesterday that was here fixing another units improperly installed ****.  Why would their units **** be covered under the same exact warranty as us, but ours not be?  Do not fall for Solmons claim.  Id be happy to provide you with the builders warranty to prove this.  I have the warranty and unfortunately it is not worth the paper it is printed on because I have yet to meet a person capable of holding ******************************* to account. 

      What ****** said about it taking time to fix issues is semi true; sure it takes time to get the right people to respond.  And ****** has had since August to fix our well documented issue.  We were dealing with a lack of AC at the time the claim was initiated and now we are dealing with a lack of proper heat with regard to the same issue.  This is unsatisfactory.  Also, I spoke with the **** contractor yesterday.  They said they can fix it whenever but the issue is they refuse to do anymore work for ****** until he pays them for previous jobs they have done for him.  Yesterday, they said the reason they are back working is because ****** paid them some of the money they are owed, but are still owed more.  *********** too.  If you look at the ************** permit page you will see ****** has a slew of other developments in the works now.  He has money to get those underway but not to fix a minor issue with us?  Proof in the pudding; ****** only cares about making sales and he already made ours.  Now he is off building a new crop of  homes to do the same thing to his next batch of buyers and will presumably leave them holding a useless warranty ****** will find excuse after excuse to not uphold.


      ******, this whole complaint can be dropped and your BBB rating remain where it is now, which is an undeserved A-, if you send ***** from Purple **** over to fix our **** system like you did with unit 36 next door to us yesterday.  Tomorrow marks the one year anniversary of us buying this house and the expiration of our warranty, assuming the house does not crumble on top of us tonight.  We have other issues we can claim but are willing to let them go if you get your guy in here to fix our ****.  You want us to drop this issue?  Swallow your pride, show a single shred of integrity, and get someone in here to fix our **** and I will leave you alone with regard to the **** matter.

      Thank you for providing your feedback. I want to clarify that there is no commitment allowing the use of a property belonging to your neighbor. Prior to the purchase, both your attorney and Shanti's attorney thoroughly examined all agreements, making this point invalid.

      Additionally, every house we sell undergoes inspection, adhering to standards set by the **************. Inspections are conducted by both private and government authorities to ensure safety standards are met. This process is consistent for all houses built in ******, whether built by Shanti or another entity. Consequently, the claim that the house is poorly constructed is also invalid. The purchase agreement is lawfully made between the buyer and seller, ensuring that the buyer receives what was agreed upon.

      Regarding maintenance, we have a longstanding relationship with a regular vendor. Our in-house technicians and outsourced vendors are dispatched for maintenance as needed. We apologize if immediate attention was not possible due to a high volume of requests and technician availability. Rest assured, we are making concerted efforts to address maintenance requests promptly.

      As with any company, payments are processed after careful review through proper channels. It is crucial to pass bills promptly to maintain positive working relationships with our vendors.

      We appreciate your understanding and cooperation as we strive to address your concerns and maintain a high standard of service.

      ******, again, this still does not address the fact  that you and your realtor misrepresented the property by advertising the land as common when it was in fact, not common.  This is a sleazy move.  See the picture I attached to my original complaint to refresh your memory.

       

      You did not uphold your purchase and sale agreement because you did not fix issues YOU agreed to fix from the P&S.  Id be happy to provide the P&S agreement to this complaint and let the BBB be the judge.

       

      All you have to do is get your guy in here to fix the **** that was installed improperly, those are your **** vendors words not mine, and I will drop this complaint.  Anything short of that is insufficient.
