In 2023 the consignment shop, Gallery 56, located in Clinton, MA accepted property of mine on consignment and removed the property from my storage for which I paid them. As of now, numerous items consigned have never been offered for sale. Since at least Jan. of 2024 (see email downloaded with complaint) I have been asking the consignment shop to complete their accounting of my property accepted for consignment in 2023, still in in their possession and to offer that property never offered for sale.( see email downloaded with complaint) To date they have repeatedly, over and over again, dragged the process out of completing the offering of my property and accounting for it (see email downloaded with complaint) .They still have not fulfilled their obligations. On March 13th of this year (see email downloaded with complaint) they in effect acknowledged that they still have that property in their possession but they have not provided a complete list or photographs of it or offered it for sale (see email downloaded with complaint).

To & From Eric & myself.

I aked you earlier... but you failed to reply. Are the two items that were priced on March 13th out on the floor available for purchase?

From: "******************" <******************> To: ******************* Subject: Really? / Re: Tme Frame / Fw: confirm prices / Date: Wed, 30 Apr 2025:  Nancy, I find then timing of your most recent email questionable. Is your email for the benefit of BBB? I rather think so. You claim you have lost more space. Don't you have a lease? If you have indeed lost space ( for a second time) it is most unfortunate but as I have written, many times, you are obliged to fulfill your obligations after accepting my property on consignment. While I welcome that you write you will be finally sending me the photographs of my property, you still need to offer it in the customary manner. An agreement is an agreement. Eric

From: Nancy K******** <*******************> To: ****************** Subject: Re: Tme Frame / Fw: confirm prices / Date: Wed, 30 Apr 2025: Hi Eric, sorry I haven’t gotten back to you. On March 18th my landlord gave me 30 days to evacuate all the new space that I had for the past 2 1/2 years so I finished emptying all the rooms by April 16th. I lost a lot of square footage. There were five rooms altogether. I don’t know if you ever saw pictures of them quite lovely. At this point, I don’t have any space available for any more artwork to hang on the walls. I’ll be happy to take pictures of you paintings first thing next week and send them all to you so you can make plans for them. I wish the news was better. I have so many sad customers but still happy that we’re still in business. Thank you Nancy

"The response made to my complaint by the business was not satisfactory in any way. In my view it is a false narrative, another attempt by the business, in a very long series of attempts, to evade their obligations of completing the consignment process by offering in the customary manner the remaining property of mine picked up by the business (for which I paid them), property which they accepted on consignment in 2023. The business  in their response to The Better Business Bureau claims to have lost store space this past April and as a result they are unable to place on sale more of my property. The last time Gallery 56 priced property of mine was in July of 2024. What is the excuse for not having placed for sale any more of my property between then and the time of their alleged loss of store space this past April ( a period of 9 months) Though I have repeatedly asked the business, since 2023, for the complete accounting of my property still in their possession they have failed to do so. It appears in my view that they have stolen property of mine and I am considering contacting the police. I find the timing of the alleged loss of space by the business highly questionable if not outright false and purely for the benefit of BBB.They claim to have lost space for a second time. Don't they have a lease? If they have indeed lost space (for a second time) it is most unfortunate but as I have written them, many, many times, they are obliged to fulfill their obligations after accepting my property on consignment that they were paid to pick up.  An agreement is an agreement.

For the record, on March 13th @ 1:07 PM, the business owner emailed me stating that she would be sending me listings and photos of additional property of mine in their possession, never accounted for. The business owner never did so."
