    In March, I entered an agreement with New Life Hardscape to extend my back patio ,to put an apron at the beginning of my driveway and cement two granite posts in the driveway for a sum of $5850. On March 19, I gave ***** a deposit of $1750. Around March 27, he started the work on the back patio. Despite the contact saying full payment at the completion of work, he requested an additional $2000 of which I gave him on April 2. Once the back patio was complete, he started work on the apron and posts. He did not call DigSafe. I told him that ******* will be there to mark gas line because it runs in the area where he was working. Upon coming home from work, I noticed that he dug too close to the gas line. He did not stay the required 18 from the ***** Additionally, he dug so close that he came across the ribbon that indicates the pipe is nearby. Despite seeing the ribbon, he continued to dig. I told him that it was dangerous to dig and place anything that close to a gas line and requested that he remove the granite pieces which at that point were just being held up by rocks wedged in the hole. I told him to leave the holes and that I would fill them. Upon coming home , he filled the holes. I dont know with what. He asked for payment in full. I withheld $200 because the posts were still not cut and cemented in the ground. Despite it being contractor error, I paid him $100 for the digging. He was blatantly rude about me holding back some of the money. I came up with a new spot in the driveway which meets the 18 setback from pipeline. I told him that I would pay the agreed upon $300 to set posts in the ground, but he is refusing to fulfill the contract. After multiple attempts and reiterating that Ill be paying an additional $100, despite his error, he refuses to complete the work. I would like the posts set in cement at the agreed upon height as stated in contract and the sunken pavers fixed in the driveway.
