Note: I filed claim with Attorney General's office which they accepted & directed it to Revere Consumers Affairs office for assistance since they agreed with my case. Ultimately Contractor has refused to cooperate and said many lies which I contradicted with evidence & proof. He never returned response to my last one despite providing full evidence & Independent Construction Supervisor's Evaluation Report stating all his work was faulty & must be replaced. I also sustained water damage to interior wall from his faulty installation of cedar side shingles. Quote received to fix his faulty installation & damages were $7635K. Contractor only offered $2000 against the $6299 I paid him which I didn't include the damages or the quote to repair. (IF HE REFUSES TO REIMBURSE ME $6299, I HAVE NO CHOICE TO PURSUE IN COURT FOR $7,635 per quote received). Also, my responses to him are thru the AG office which is a rebuttal to all his lies by providing evidence & proof. Case is now closed with AG. NOTE: Advanced Painting & Construction, Todd V NOW has a public record with AG office which is open to all public. Also, Contractor committed fraud by claiming he was Licensed & Insured which was false, a lie. Also refused to show me receipts or when I questioned charges & ridiculed me for asking. I was 70 yrs old & tricked by his deceitful lies. Originally he was willing to do patch job repairs which I refused to accept due to it all being installed wrong. As soon as I said I wanted a Building Permit pulled he refused to come back & blocked me. See attached for all work completed on approx 4/30/23 along with proof & evidence which will show what my home looked like due to his poor & faulty work. Please note contractor brought in issues that had nothing to do with this case and also said numerous lies to protect himself. My responses are to the AG office via Revere Consumer Affairs, may be confusing. I also have Ring videos as proof also but didn't attach.Customer Answer

On the inside cabinet she had me replace some rotted wood. She didn't want to pay a lot so she had me seam it so she's complaining about where one board meets the next. It's a seam. All same show. You can hide them. There's nothing you can do. She knows that next thing was the tub. She gave me $60 to go pick up caulking at home Depot. I showed her a picture of the caulking. It was a bathroom caulking for like $8 and I used it on her tub. I provided her a service. I don't know if she allowed it to cure or not properly. I told her to wait 30 hours. It's not my responsibility if home Depot Caulking fails her next complaint was on the exterior painting. She did not pay me $750. She paid me $600 to paint the siding. I prepped it. I primed it. I painted it. She inspected it and then paid me. Weeks later. She poked around with her fingers until she found a spot where it would come off and then said I didn't do it good enough so I repaired it. Her house is peeling all over the place. I am not responsible for her home. I prepped primed and painted it and I explained to her that the siding was failing and I showed her that a lot of paint was barely holding on to her house. The people who painted it before did not do a good job because of her house failing before I did it which she had it painted the year earlier. So less than one year later it's already peeling from another contractor. I won't warranty houses like that because they continue to peel and when it peeled it peeled down to bare wood which shows you that it's nothing to do with me. It's a fresh peel and her house will continue to peel again. She didn't pay $750. She paid $600. I have the contract on the lattice. She didn't pay $602 she paid $250 including me picking up the supplies. I tried to help her and give her an extremely cheap price and a good deal cuz at the time I cared about her we were friends. I offered to fix everything I offered to fix the shingles. She said nope. She wanted them all replaced with the expensive ones. Everything taken out and start from scratch. That's not reasonable on the exterior painting. There was nothing to touch up so I couldn't and I am not responsible for her touch-ups her house will continue to peel on the lattice. It was a simple repair. It warped a little bit. I offered to fix it and she said I want the lattice replaced. I told her it was brand new. I would fix it but I'm not replacing the lattice. She would not allow me to work on it unless I replaced it. She does this with everything she wants everything replaced from scratch and that's not reasonable. He complains about everything and threatens to sue. Everybody on the concrete work she did not pay $ 1,375 for concrete work that was for removing the bottom row of shingles for approximately 26 ft. Of shingles were removed and we put 1x12 israel on the bottom row where the shingles were. Plus we replaced the shingles plus we put a rain diverter in pointed out any concrete block which there wasn't much and then feathered in the cement. The concrete work was about $400 total so she's not telling the truth. She did not pay $13.75 for concrete work. That was a whole contract from miscellaneous work outside and she was told that her patio had sunk in and all the water was going into her sunroom. That's why she went to the insurance company. I showed her where the damage was coming in. She lied to the insurance company and told her company she had water and ice dams from the winter coming in on her deck. I told her that was not true. The water was coming in from her concrete patios. She got mad and told me to mind my business. I said okay so she lied to the insurance company to get her money. I put a change order in for $2,500 to the insurance company. She submitted it and she kept that money for herself so she never paid me $2,500 on the contract. She kept telling me the money hadn't come yet. She got the check and she cashed it. It was supposed to go to me. I have offered from the very first day she complained to come back. I told her there was one row of shingles that were improperly installed that I would replace them in prime caulk and paint everything. She wasn't happy. She really never is when I went there to do the work I started and she got mad and said I had to replace everything. She faked the heart attack. I called 911. It was too much for me. I had to leave. I told her I would never come back and then she kept saying stuff about me on ******** and texting me. So I blocked her one day a month or so. Later I saw her message on my email begging me to come back and to make it right. I called her and said I'd be willing to if she wouldn't act. So bizarre. We made an appointment to meet. We talked about what we were going to do. She agreed on the day I came to start the repair. She went right back to her old self and said everything had to be replaced. She wanted me to tear it all out and throw it all away. I refused. She started yelling at me and I said I couldn't do it. I'm leaving and she assaulted me. That was the end for me. At that point, I realized that it wasn't safe or healthy to be around this woman. I've never worked with anybody like this in the entire life. I've been in business for over 40 years. I've never even had a complaint from anybody until this lady. She has gone on to ******** and social media and has attacked me 7 days a week for over a year with multiple threats from her all the time and yet she wants me still to come back and repair everything the way she commands. Yet she's telling everybody on ******** not the high of me cuz I'll ruin their house but she wants me to come back and still do the work for her and I will never go back to that woman's house as long as I'm alive. I have all the contracts for everything. She's not telling the truth about the money. I'm not giving her any. She kept the $2,500. She has destroyed my name on ******** which took 5 years to build but she wants me to come back and do work. It's the most bizarre thing I've ever been through in my life. She has called my wife. She has called my sister. She has called my daughter. If you get on the wrong side of **** parole she will make you pay. I'm getting a lawyer and I'm going to file defamation of character and slander charges against her cuz she won't stop everything I have said in this message. I have all the contracts, all the text messages and all the ******** information. I no longer can get my own work because of what she has done to my reputation. It's not even my reputation. She goes on everyday and make sure that anybody hiring. She tells my name, my company and my home address I am not sure what else to add to this or what to even do. She's not even asking for the right amount of money. She swindled the insurance company and now she's trying to swindle me. If there's any way I can. To: BBB 6/22/24: I’m not accepting Contractor’s response based on notice I received from BBB on 6/4/24 after being closed out 4/23/24. He’s already received all evidence & exhibits through myself, the Attorney General’s (AG) office & through BBB complaint. Not once has he submitted any evidence/proof of all statements he’s made nor did he ever to the AG office. 99.5% of what he has said are all perjurious statements. Before he makes any further false statements he must provide evidence/proof. All evidence submitted to him from myself, the AG office & from BBB disproves, contradicts & rebuts every one of his perjurious statements. His credibility is poor due to saying such perjurious statements without any evidence & proof.
In my response below I’ll refer to original Exhibits submitted with Original BBB 2/28/24 complaint. Otherwise, I’ll add new Exhibits as add’l evidence to prove he’s being perjurious & rebut his response to BBB as False. Fraud charges listed below.
Also submitted as evidence to AG Office & BBB complaint, is Letter by Independent Construction Supervisor Consultant I hired to submit an Evaluation Report of Todd’s work. It clearly states his work must be replaced due to Faulty installation.
NOTE: I had asked for Building Permit to be pulled per text 8/27/23 1:44pm, he said he wasn’t OK & blocked me from texting or calling permanently. He knew Building Inspector would’ve made him remove ALL his faulty work. For now I’m asking he reimburse me for all funds I paid him for 100% faulty & failing work, $6,299.
FRAUD committed:
#1- Claiming he is a “Fully Licensed and Insured Contractor” as evidenced on all of his invoices going back to February 2022 which was a lie. See Exhibits #1-3 as samplings of invoices billed
#2- Advertising on his Facebook & to people on Facebook Community pages who’s looking for a contractor he’s fully Licensed and Insured (evidence will be submitted to Comm of Mass Consumer Protection & Business Regulation).
#3- Deceived me into securing Contracts by outright lying to me. I asked IF he was knowledgeable & experienced in this type of outside work in working with concrete against home’s foundation, installing cedar side shingles & his answer was ‘YES’ as he nodded his head. I hired him based on his expertise & knowledge he said he had & being ‘Fully Licensed & Insured Contractor”
#4-Knowingly contracting beyond the scope of the false Registered Contractor since he was never Licensed to begin with
#5-Overcharged me for materials and stole what was left over. Namely Brand name Tyvek house wrap, Ben Moore exterior primer & other various materials since he left nothing at my home
#6-Charged me for full price Brand name materials but used Generic name; namely brand name Tyvek (based on price)
#7-Failed to inform me & have on hand all materials on hand; namely the Red Premium Cedar shingles before he proceeded to tear off 2 complete rows of Red Premium Cedar in perfect condition (50 sq ft).
#8-Deceived & tricked me by failing to inform or explain differences in Cedar shingles to me by installing Inferior grade White Cedar Side Shingles, Grade C Seconds (2nds) instead of Red Premium Cedar which matched my home. On day he arrived, he showed me a package of Shingles without any labels attached & asked if they were Ok. Being a layperson not knowing anything about shingles, I said, “I guess so, what would I know”. Then he proceeded to install. He deliberately tore off Label stapled to package which said, “Second Clear Shingles are meant for Secondary Buildings like Sheds, Garages, Gazebos, etc. THEY ARE NOT RECOMMENDED TO BE USED ON RESIDENTIAL DWELLINGS.” See Original Exhibit #2 att to BBB 2/24 complaint. Him being a professionally “fully Licensed & Insured contractor” I assumed he’d do the job correctly.
#9-Took advantage of an elderly person age 70 by committing all this fraud listed above. Ridiculed me for questioning charges on his invoices. I asked for receipts on text messages but he totally ignored me.
My Response in reference to all his untruthful statements:
I. CABINETRY WORK-$100: 100% Untrue, “she had me seam”. He’s the contractor, not me; I paid him $500. See att Exhibit #1 above Inv/Quote received on 2/23/23 for $500 for Line item breakdown & Original Exhibit #6 attached to my 2/28/24 complaint (photos of him working & the “seam”). On Exhibit #1, Line item’s #2-4 breakdown clearly says: “#2-Cut out section of cabinet to remove damaged wood. Check for damaged inside & determine if more work is needed. Evaluate if needed.” #3-Replace damaged part, nail and glue then feather in wood with filler so will blend in. #4-Put base board back then sand cabinet face and side plus base board. Spot prime and caulk as needed”. Based on his invoice, he decided to proceed as he saw fit. In Original Exhibit #6 (photos) attached to BBB 2/28/24 complaint, he’s leaning over the long 41” long or 3’5” he cut out. My photos are proof of this. And, If he properly feathered & blended in the Seam he created by adding new piece of wood, in only a few months the seam would not be very obvious with paint peeling away from it. More proof he didn’t have knowledge to do it right like any “Fully Licensed and Insured” contractor. He never returned to fix; I got a quote for $100 for the repair & asking reimbursement.
II. BATHROOM SINK & TUB RE-CAULKING-$60: Tub sloppily done & both sink & tub failed as evidenced in Original Exhibit #5 (all photos) att to BBB 2/28/24 complaint; Exhibit #2 above, Inv/Quote sent by email dtd 2/26/23 for $500; & Exhibit #4 att, Screenshots of text messages dtd 2/28 & 3/1. All he has said are untruthful. Invoice proves he had a lot of work to do upon arrival for $500. Per Exhibit #4 att my text messages, it totally contradicts him by saying he showed me caulking beforehand; why would I ever ask him to go Home Depot to get caulking when in fact he had all other supplies with him? And then per Exhibit #4 att my texting him I found a tube of caulking on floor that says ‘not meant for showers & won’t be steam resistant’. In text I then asked him, what caulking did he use?? (How could he show it to me beforehand??, why would I ask?) He responded back with photo of what caulking he said he used which was different. Why the discrepancy? Chronologically it doesn’t make sense. He’s being untruthful & dishonest by saying he showed me beforehand. I couldn’t figure out why when I found on floor what he did used. When he returned next day to complete back half of bathroom sink he “forgot” to do, I asked him why he’d have that caulking not meant for bathrooms & not steam resistant on floor. He said he just had it with him & shrugged his shoulders, didn’t make sense but I let it go trusting him. As I said, chronologically doesn’t make sense. Also, he’s dishonest by saying ‘he told me to wait 30 hrs’ before showering’. All caulking with today’s technology cures within 24 hrs with some saying in 30 min. In my 24 years at this house whenever bathroom was caulked I always waited at least 24 hours if not more. All 100% untrue what he has said.
III. EXTERIOR PAINTING, SHINGLES ABOVE DECK-$750- See att Exhibit #5 Invoice for $750 for Exterior painting; Exhibit #6 Cancelled copy of cancelled Ck #1189 dtd 4/21/230; & Original Exhibit #4 att to 2/28/24 BBB complaint (photos of failed/poor job). UNTRUTHS:
#1) “She found a spot & he repaired it”. FALSE. He NEVER came back to repair any of the $6,299 I paid him to do which all failed. Original Exhibit #4 photos (taken on 6/2/23)attached to 2/28/24 complaint shows he missed see numerous areas never done & missed. Photos taken only 1.5 mos later. Per Ring Videos dtd 6/2/23 & 6/23/23 are the ONLY 2x he ever came.
#2) FALSE: I never inspected it closely, only from my Patio door since it was a cold day. It wasn’t until I was lying down on my lounge chair on 5/29 I saw it peeling & 1 complete area missed which I sent him text per attached Exhibit #7 (1st text 5/29 @ 909PM). He was supposed to come over that day to look at all other damages but pulled a NO SHOW.
#3) FALSE: My house was peeling all over the place & I had it painted less than a year ago. Truth: My house was professionally painted in Sept 2020 (2.5 yrs b4) by Prismic Painting & a 3 yr warranty. Prismic returned to go over any areas he himself wasn’t happy with & repainted. I only hired Todd to do above deck area because I constantly looked at it & wanted it to look nice & he was already here doing other major work. Note: In 24 yrs I’ve been here, my house was painted 2x; in 2007 & again 13 yrs later in 2020. All houses need to be repainted every 10 yrs or so. All pro painters give either from 1 yr to 3 yr warranties but not Todd Vickery.
#4) FALSE: Todd is untruthful by saying he showed me all these areas that were peeling & I told him he didn’t do a good enough job; I would never tell any contractor that, very impolite to do so.
IV. LATTICE WORK: See Exhibit #8 att, Invoice dtd 4/25/23 for $1,182; Exhibit #9 copy of cancelled ck #1191 dtd 4/25/23 for $1182; Original Exhibit #3 attached to 2/28/24 BBB complaint (photos of bowed lattice, poor workmanship on splintered frame & damage to my deck railing. On invoice, it’s broken down of what Lattice work costs are as follows: $225 Labor; Stock, 1st slip $303 (Lattice & pressure treated screws, plastic trim strips) & 2nd slip $74 (more plastic strips). $205 + 303 + 74= $602. Was also submitted to him via the AG office which he never bothered to view. I NEVER told him to replace lattice, let him provide proof, I accepted a repair.
V. CEDAR SIDE SHINGLES, $4,412: NOTE: Per Todd’s statement of concrete being only $400: See Exhibit #3 above, Line item #’s 1 & 4 were NEVER done. Leaves only Line item’s #2 being all shingles, Line item #3 being all concrete. New cost Grade C cedar side shingles changes from $3,512 to $4,412 ($975 diff) & concrete being $400. GRAND TOTAL $6,299 REMAINS SAME
- Todd has seen all photos, every Ring video, through emailing, texting, through the AG’S Office & again through BBB. This is all a duplication. See Original Exhibit #2 attached to 2/28/24 complaint (photos of 100% faulty & shoddy installation), evidence proves he installed them 100% faulty as shown in all photos. Also confirmed by Independent Consultant Construction Supervisor I hired for an Evaluation Report, see Exhibit Letter att to Original 2/28 BB complaint. This evidence proves he is NOT telling truth. He continues to say all these Untruths, perjurious statements without providing any evidence & ignoring my evidences. Through deceit & trickery he also installed wrong Cedar side shingles, White Cedar Side Shingles, Grade C Seconds (2nds) instead of Red Premium Cedar. He never explained any differences or different grades (I have no knowledge, I left it up to the professional. 1st thing I said to him when he showed me completed job, “those zig-zagged jagged edges need to go, they don’t match & they’re ugly”. I also pointed out cracks & holes. Numerous times I’ve sent texts, emails but he continuously chose to lie & say they’re fine.
Complete job was botched from Wrong shingles he deceived me on & to the faulty failed installation which all photos attached to BBB complaint prove he lacked knowledge & he knew it was. Its 100% False he said he’d replace them. See Exhibit #10 (on Exhibit #7) numerous Texts from 6/1/23 him saying either: he “wasn’t replacing”, “is doing it his way”, or he’s “not changing them”. It’s also proved on Ring Videos 6/1 & 6/23/23 saying he wasn’t replacing. He said everything was fine.
On 6/23 Ring video it shows I had anxiety attack & fainted due to his denial. EMT’s have proof I fainted from panic attack.
And, see Exhibit #10, p.2 (1st text), 6/10 @ 1255am me saying, “I’m more than willing to pay difference of $300” (White Cedar Grade C 2nds to the correct Red Premium cedar which is on my home).
And, you cannot seal Cedar shingles once they’ve been primed & painted. He should know better than to say he’d come to seal them. More proof he lacked knowledge & lied to me.
27 times I told him in texts, phone calls & emails cedar stains can be seen behind the flashing meaning rains are getting in causing damage. He chose to ignore & didn’t bother to come & look. Dates told were: 5/24/23 613pm; 5/26 901pm; 5/27 223pm; 6/3 550pm #2; 6/5 1456pm; 6/13 637pm; 6/13 518pm #6; 6/13 824pm 2nd to last para; 6/14 331pm; 6/17 449pm 6/18 1134pm; 6/22 1121am; 6/23 1103am; 6/23 1202pm; 6/23 201pm; 6/26 907am 3rd para; 6/28 657pm; 6/28 1043pm; 6/29 836pm; 6/30 1116am; 7/3 143pm #5-6; 7/4 632pm; 7/7 1126am; 7/9 819am; 7/20 1235pm; 8/26 607am; 8/27 1224pm. He can confirm these on his texts.
OTHER UNTRUTH STATEMENTS MADE BY CONTRACTOR:
-“Shingles were only 25 sq. ft.” FALSE. It’s 50 sq ft he purchased. See Exhibit #11, Invoice 4/11/23, $1,675. There’s charged Line item for $300 for Shingles & House wrap ($86/pkg, 25sq ft; per Exhibit #10, @ 12:31m) x 2 pkgs = $172. Tyvek House wrap @ Home Depot is approx $93. Add in tax & rounded up by unknown % comes to $300. To prove overcharge of Brand name Tyvek, 1 roll Tyvek is 495 sq ft (& he needed only 50 sq ft). See att Exhibit #12, Inv dtd 4/4/23 for $1,697 for 2nd roll of Tyvek called House wrap. Leftover is 940 sq ft. Numerous texts were sent asking him but he always ignored & never sent response.
-“Never paid for Flashing”: FALSE. I did pay; it is billed on Exhibit #12 Invoice attached. Listed under Supplies for repair, Line #2
-Patio sunk: FALSE. He’s being untruthful by saying my patio has sunk. He’s trying to cover up his major mistakes. I do have 1 3’ wide area on far-left side near patio doors which slanted towards the foundation a bit. I had no problem with that area & was dry.
-I lied to Insurance Co saying what source of water damage was: FALSE. Not one insurance company would accept my word nor his word to actual cause of source; that’s why they have their own Insurance Adjusters to determine & use special equipment to determine source of water. Todd had absolutely no involvement with my Insurance claim for water damage under flooring of my Sunroom except to submit a quote after Insurance estimate was received along with 3 other contractor quotes. He wasn’t present when claim was filed mid-February 2023 NOR when Adjuster was here with special equipment to determine water source. He knows he is being 100% dishonest by making these statements.
I went with Todd, Advanced Painting because he was the cheapest. Again, I asked Todd if he was experienced with Concrete work & house foundation, shingles, etc & he said he was very experienced & had the expertise. And, based on him being the cheapest & “Fully Licensed & Insured”, I hired him.
-He submitted change order for $2500 work done but I never paid. FALSE. Truth & facts are: (Work started Monday, 4/3/23)
Original quote submitted 3/13/23. Sometime later I then ask if he could add a little extra $’s to help to defer whatever outside work may entail & me @ 70 yrs old & being on fixed income. He agrees to help.
On 3/28/23 he submits 2nd quote for identical work on 3/28/23 & I submit to insurance co. so work can commence on 4/3/23.
Suddenly Contractor now says months later in responses to AG office & to my BBB complaint he submitted change order $2500 for extra for work done but not paid for? HA! How can that be!
How can Contractor claim he performed extra work & didn't get paid when in fact he didn't start job until 4/3, a few days later??
His character: To further prove how dishonest he is…, see Exhibit #13 (shown on attached Exhibit #’s 7, page of text messages), last message. Todd had himself experienced water damage on his 2nd floor at house & even sent me photos. On this text 3/10/23 2:26pm he outright admitted to committing fraud by saying, “I’ll do it on the weekend with one of my helpers and I’ll put all the money in my pocket. I would never let a contractor to come in my house it would drive me crazy”. Since ins co requires Letter of Completion, Todd faked it.
He also spread slanderous statements on Social media whereas I only let it be known not to hire him due to poor workmanship & posted photos as proof. His slanderous comments had nothing to do with his work. He even claimed I was “in love” with him. These will be printed for the courts charging him with Slander while my comments were strictly related to business.Customer Answer

He knew Building Inspector would’ve made him remove ALL his faulty work. For now I’m asking he reimburse me for all funds I paid him for 100% faulty & failing work, $6,299.
FRAUD committed:
#1- Claiming he is a “Fully Licensed and Insured Contractor” as evidenced on all of his invoices going back to February 2022 which was a lie. See Exhibits #1-3 as samplings of invoices billed
#2- Advertising on his Facebook & to people on Facebook Community pages who’s looking for a contractor he’s fully Licensed and Insured (evidence will be submitted to Comm of Mass Consumer Protection & Business Regulation).
#3- Deceived me into securing Contracts by outright lying to me. I asked IF he was knowledgeable & experienced in this type of outside work in working with concrete against home’s foundation, installing cedar side shingles & his answer was ‘YES’ as he nodded his head. I hired him based on his expertise & knowledge he said he had & being ‘Fully Licensed & Insured Contractor”
#4-Knowingly contracting beyond the scope of the false Registered Contractor since he was never Licensed to begin with
#5-Overcharged me for materials and stole what was left over. Namely Brand name Tyvek house wrap, Ben Moore exterior primer & other various materials since he left nothing at my home
#6-Charged me for full price Brand name materials but used Generic name; namely brand name Tyvek (based on price)
#7-Failed to inform me & have on hand all materials on hand; namely the Red Premium Cedar shingles before he proceeded to tear off 2 complete rows of Red Premium Cedar in perfect condition (50 sq ft).
#8-Deceived & tricked me by failing to inform or explain differences in Cedar shingles to me by installing Inferior grade White Cedar Side Shingles, Grade C Seconds (2nds) instead of Red Premium Cedar which matched my home. On day he arrived, he showed me a package of Shingles without any labels attached & asked if they were Ok. Being a layperson not knowing anything about shingles, I said, “I guess so, what would I know”. Then he proceeded to install. He deliberately tore off Label stapled to package which said, “Second Clear Shingles are meant for Secondary Buildings like Sheds, Garages, Gazebos, etc. THEY ARE NOT RECOMMENDED TO BE USED ON RESIDENTIAL DWELLINGS.” See Original Exhibit #2 att to BBB 2/24 complaint. Him being a professionally “fully Licensed & Insured contractor” I assumed he’d do the job correctly.
#9-Took advantage of an elderly person age 70 by committing all this fraud listed above. Ridiculed me for questioning charges on his invoices. I asked for receipts on text messages but he totally ignored me.
My Response in reference to all his untruthful statements:
I. CABINETRY WORK-$100: 100% Untrue, “she had me seam”. He’s the contractor, not me; I paid him $500. See att Exhibit #1 above Inv/Quote received on 2/23/23 for $500 for Line item breakdown & Original Exhibit #6 attached to my 2/28/24 complaint (photos of him working & the “seam”). On Exhibit #1, Line item’s #2-4 breakdown clearly says: “#2-Cut out section of cabinet to remove damaged wood. Check for damaged inside & determine if more work is needed. Evaluate if needed.” #3-Replace damaged part, nail and glue then feather in wood with filler so will blend in. #4-Put base board back then sand cabinet face and side plus base board. Spot prime and caulk as needed”. Based on his invoice, he decided to proceed as he saw fit. In Original Exhibit #6 (photos) attached to BBB 2/28/24 complaint, he’s leaning over the long 41” long or 3’5” he cut out. My photos are proof of this. And, If he properly feathered & blended in the Seam he created by adding new piece of wood, in only a few months the seam would not be very obvious with paint peeling away from it. More proof he didn’t have knowledge to do it right like any “Fully Licensed and Insured” contractor. He never returned to fix; I got a quote for $100 for the repair & asking reimbursement.
II. BATHROOM SINK & TUB RE-CAULKING-$60: Tub sloppily done & both sink & tub failed as evidenced in Original Exhibit #5 (all photos) att to BBB 2/28/24 complaint; Exhibit #2 above, Inv/Quote sent by email dtd 2/26/23 for $500; & Exhibit #4 att, Screenshots of text messages dtd 2/28 & 3/1. All he has said are untruthful. Invoice proves he had a lot of work to do upon arrival for $500. Per Exhibit #4 att my text messages, it totally contradicts him by saying he showed me caulking beforehand; why would I ever ask him to go Home Depot to get caulking when in fact he had all other supplies with him? And then per Exhibit #4 att my texting him I found a tube of caulking on floor that says ‘not meant for showers & won’t be steam resistant’. In text I then asked him, what caulking did he use?? (How could he show it to me beforehand??, why would I ask?) He responded back with photo of what caulking he said he used which was different. Why the discrepancy? Chronologically it doesn’t make sense. He’s being untruthful & dishonest by saying he showed me beforehand. I couldn’t figure out why when I found on floor what he did used. When he returned next day to complete back half of bathroom sink he “forgot” to do, I asked him why he’d have that caulking not meant for bathrooms & not steam resistant on floor. He said he just had it with him & shrugged his shoulders, didn’t make sense but I let it go trusting him. As I said, chronologically doesn’t make sense. Also, he’s dishonest by saying ‘he told me to wait 30 hrs’ before showering’. All caulking with today’s technology cures within 24 hrs with some saying in 30 min. In my 24 years at this house whenever bathroom was caulked I always waited at least 24 hours if not more. All 100% untrue what he has said.
III. EXTERIOR PAINTING, SHINGLES ABOVE DECK-$750- See att Exhibit #5 Invoice for $750 for Exterior painting; Exhibit #6 Cancelled copy of cancelled Ck #1189 dtd 4/21/230; & Original Exhibit #4 att to 2/28/24 BBB complaint (photos of failed/poor job). UNTRUTHS:
#1) “She found a spot & he repaired it”. FALSE. He NEVER came back to repair any of the $6,299 I paid him to do which all failed. Original Exhibit #4 photos (taken on 6/2/23)attached to 2/28/24 complaint shows he missed see numerous areas never done & missed. Photos taken only 1.5 mos later. Per Ring Videos dtd 6/2/23 & 6/23/23 are the ONLY 2x he ever came.
#2) FALSE: I never inspected it closely, only from my Patio door since it was a cold day. It wasn’t until I was lying down on my lounge chair on 5/29 I saw it peeling & 1 complete area missed which I sent him text per attached Exhibit #7 (1st text 5/29 @ 909PM). He was supposed to come over that day to look at all other damages but pulled a NO SHOW.
#3) FALSE: My house was peeling all over the place & I had it painted less than a year ago. Truth: My house was professionally painted in Sept 2020 (2.5 yrs b4) by Prismic Painting & a 3 yr warranty. Prismic returned to go over any areas he himself wasn’t happy with & repainted. I only hired Todd to do above deck area because I constantly looked at it & wanted it to look nice & he was already here doing other major work. Note: In 24 yrs I’ve been here, my house was painted 2x; in 2007 & again 13 yrs later in 2020. All houses need to be repainted every 10 yrs or so. All pro painters give either from 1 yr to 3 yr warranties but not Todd V******.
#4) FALSE: Todd is untruthful by saying he showed me all these areas that were peeling & I told him he didn’t do a good enough job; I would never tell any contractor that, very impolite to do so.
IV. LATTICE WORK: See Exhibit #8 att, Invoice dtd 4/25/23 for $1,182; Exhibit #9 copy of cancelled ck #1191 dtd 4/25/23 for $1182; Original Exhibit #3 attached to 2/28/24 BBB complaint (photos of bowed lattice, poor workmanship on splintered frame & damage to my deck railing. On invoice, it’s broken down of what Lattice work costs are as follows: $225 Labor; Stock, 1st slip $303 (Lattice & pressure treated screws, plastic trim strips) & 2nd slip $74 (more plastic strips). $205 + 303 + 74= $602. Was also submitted to him via the AG office which he never bothered to view. I NEVER told him to replace lattice, let him provide proof, I accepted a repair.
V. CEDAR SIDE SHINGLES, $4,412: NOTE: Per Todd’s statement of concrete being only $400: See Exhibit #3 above, Line item #’s 1 & 4 were NEVER done. Leaves only Line item’s #2 being all shingles, Line item #3 being all concrete. New cost Grade C cedar side shingles changes from $3,512 to $4,412 ($975 diff) & concrete being $400. GRAND TOTAL $6,299 REMAINS SAME
- Todd has seen all photos, every Ring video, through emailing, texting, through the AG’S Office & again through BBB. This is all a duplication. See Original Exhibit #2 attached to 2/28/24 complaint (photos of 100% faulty & shoddy installation), evidence proves he installed them 100% faulty as shown in all photos. Also confirmed by Independent Consultant Construction Supervisor I hired for an Evaluation Report, see Exhibit Letter att to Original 2/28 BB complaint. This evidence proves he is NOT telling truth. He continues to say all these Untruths, perjurious statements without providing any evidence & ignoring my evidences. Through deceit & tr****** he also installed wrong Cedar side shingles, White Cedar Side Shingles, Grade C Seconds (2nds) instead of Red Premium Cedar. He never explained any differences or different grades (I have no knowledge, I left it up to the professional. 1st thing I said to him when he showed me completed job, “those zig-zagged jagged edges need to go, they don’t match & they’re ugly”. I also pointed out cracks & holes. Numerous times I’ve sent texts, emails but he continuously chose to lie & say they’re fine.
Complete job was botched from Wrong shingles he deceived me on & to the faulty failed installation which all photos attached to BBB complaint prove he lacked knowledge & he knew it was. Its 100% False he said he’d replace them. See Exhibit #10 (on Exhibit #7) numerous Texts from 6/1/23 him saying either: he “wasn’t replacing”, “is doing it his way”, or he’s “not changing them”. It’s also proved on Ring Videos 6/1 & 6/23/23 saying he wasn’t replacing. He said everything was fine.
On 6/23 Ring video it shows I had anxiety attack & fainted due to his denial. EMT’s have proof I fainted from panic attack.
And, see Exhibit #10, p.2 (1st text), 6/10 @ 1255am me saying, “I’m more than willing to pay difference of $300” (White Cedar Grade C 2nds to the correct Red Premium cedar which is on my home).
And, you cannot seal Cedar shingles once they’ve been primed & painted. He should know better than to say he’d come to seal them. More proof he lacked knowledge & lied to me.
27 times I told him in texts, phone calls & emails cedar stains can be seen behind the flashing meaning rains are getting in causing damage. He chose to ignore & didn’t bother to come & look. Dates told were: 5/24/23 613pm; 5/26 901pm; 5/27 223pm; 6/3 550pm #2; 6/5 1456pm; 6/13 637pm; 6/13 518pm #6; 6/13 824pm 2nd to last para; 6/14 331pm; 6/17 449pm 6/18 1134pm; 6/22 1121am; 6/23 1103am; 6/23 1202pm; 6/23 201pm; 6/26 907am 3rd para; 6/28 657pm; 6/28 1043pm; 6/29 836pm; 6/30 1116am; 7/3 143pm #5-6; 7/4 632pm; 7/7 1126am; 7/9 819am; 7/20 1235pm; 8/26 607am; 8/27 1224pm. He can confirm these on his texts.
OTHER UNTRUTH STATEMENTS MADE BY CONTRACTOR:
-“Shingles were only 25 sq. ft.” FALSE. It’s 50 sq ft he purchased. See Exhibit #11, Invoice 4/11/23, $1,675. There’s charged Line item for $300 for Shingles & House wrap ($86/pkg, 25sq ft; per Exhibit #10, @ 12:31m) x 2 pkgs = $172. Tyvek House wrap @ Home Depot is approx $93. Add in tax & rounded up by unknown % comes to $300. To prove overcharge of Brand name Tyvek, 1 roll Tyvek is 495 sq ft (& he needed only 50 sq ft). See att Exhibit #12, Inv dtd 4/4/23 for $1,697 for 2nd roll of Tyvek called House wrap. Leftover is 940 sq ft. Numerous texts were sent asking him but he always ignored & never sent response.
-“Never paid for Flashing”: FALSE. I did pay; it is billed on Exhibit #12 Invoice attached. Listed under Supplies for repair, Line #2
-Patio sunk: FALSE. He’s being untruthful by saying my patio has sunk. He’s trying to cover up his major mistakes. I do have 1 3’ wide area on far-left side near patio doors which slanted towards the foundation a bit. I had no problem with that area & was dry.
-I lied to Insurance Co saying what source of water damage was: FALSE. Not one insurance company would accept my word nor his word to actual cause of source; that’s why they have their own Insurance Adjusters to determine & use special equipment to determine source of water. Todd had absolutely no involvement with my Insurance claim for water damage under flooring of my Sunroom except to submit a quote after Insurance estimate was received along with 3 other contractor quotes. He wasn’t present when claim was filed mid-February 2023 NOR when Adjuster was here with special equipment to determine water source. He knows he is being 100% dishonest by making these statements.
I went with Todd, Advanced Painting because he was the cheapest. Again, I asked Todd if he was experienced with Concrete work & house foundation, shingles, etc & he said he was very experienced & had the expertise. And, based on him being the cheapest & “Fully Licensed & Insured”, I hired him.
-He submitted change order for $2500 work done but I never paid. FALSE. Truth & facts are: (Work started Monday, 4/3/23)
Original quote submitted 3/13/23. Sometime later I then ask if he could add a little extra $’s to help to defer whatever outside work may entail & me @ 70 yrs old & being on fixed income. He agrees to help.
On 3/28/23 he submits 2nd quote for identical work on 3/28/23 & I submit to insurance co. so work can commence on 4/3/23.
Suddenly Contractor now says months later in responses to AG office & to my BBB complaint he submitted change order $2500 for extra for work done but not paid for? HA! How can that be!
How can Contractor claim he performed extra work & didn't get paid when in fact he didn't start job until 4/3, a few days later??
His character: To further prove how dishonest he is…, see Exhibit #13 (shown on attached Exhibit #’s 7, page of text messages), last message. Todd had himself experienced water damage on his 2nd floor at house & even sent me photos. On this text 3/10/23 2:26pm he outright admitted to committing fraud by saying, “I’ll do it on the weekend with one of my helpers and I’ll put all the money in my pocket. I would never let a contractor to come in my house it would drive me crazy”. Since ins co requires Letter of Completion, Todd faked it.
He also spread slanderous statements on Social media whereas I only let it be known not to hire him due to poor workmanship & posted photos as proof. His slanderous comments had nothing to do with his work. He even claimed I was “in love” with him. These will be printed for the courts charging him with Slander while my comments were strictly related to business.
