      This company damaged 15 of my floor joists by drilling over 20 - 2 holes less two inches from the top. This does not meet code and can cause the joists to fail. After two months of arguments and threats they offered a solution that, they admit, does not meet code. They are also required to provide ventilation for the battery room. I sent them an estimate for repairs but of course they refuse to pay.

      Were truly sorry that you feel so negatively about your solar and battery system installation, but your analysis of the situation is incorrect. In a nutshell, we have supplied you with a stamped letter from a structural engineer certifying that your floor joists are sound and that they are not in danger of failing. This analysis has been reviewed and accepted by the town inspector, who also approved your project. In terms of the battery closet needing ventilation, your statement is also contradicted by documentation from the battery manufacturer. The battery in question does not need ventilation and adding ventilation would in fact negate the entire reason for building a battery room in the first place, as any ventilation would allow a fire to spread instead of containing it. This assessment is also accepted and agreed upon by the town inspector. 
      Finally, we should note that you had originally refused to make your final payment on this project despite the evidence noted above. As a result, our attorney contacted you and offered to go to mediation, which is spelled out as the way to handle any disagreement in the agreement we both signed. If we had gone that route, and you had a justifiable complaint, you could have won your case in mediation. However, you refused to do so and instead paid the last and final invoice in full. 
      In the end your system is fully approved and fully operational and is delivering exactly what your contracted for.

      Better Business Bureau:I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ********. Please add your rejection comments below; if you do not provide any details, your complaint will be closed as Answered. 

      The town inspector, *** ***********, has reopened this permit. The damage done by drilling 2 holes 1 1/4 from the top in over a dozen floor joists clearly do not meet code. He is also concerned about the ventilation. His original inspections only included the solar panels and battery room. Which, at the time, he questioned the exhaust fan. The manufacturer product data is attached. The batteries are installed ten feet from my daughters bedroom. This matter has also been turned over to the State. They are currently proceeding a claim in my behalf. This contractor did nothing but threaten me and my wife and then hired a lawyer who did the same. My wife and I are both retired and I am disabled. The threats became too much so we paid them against our will. This is a terrible way to treat customers.

      With all due respect, lets be clear about the facts because the town inspector has not reopened the permit. We have spoken to him since your post and he is satisfied with the stamped structural engineers letter as that supersedes the building code guidelines. Further, you can determine that fact by checking the towns website, Permiteyes. You can search by owner name and or address. Misrepresenting the truth to slander us is not a proper way to proceed. In terms of the battery room, that is work that you did as you pulled your own permit. Further, it is apparent that you have not had it inspected and closed  out that permit as you had told us.
      As we outlined in our last response, the agreed method of handling any disagreement is clearly spelled out in the agreement that you and your wife signed. Meaning, if you want to press a case you should move to mediation as we had suggested when you would not make the final payment. At that time, you declined to do so and instead paid your bill in full. There were no threats, just a clear statement of how the arbitration process is outlined in the agreement. You could of course also try to sue us, but as I believe our legal council outlined, you would almost certainly be told by any judge that you need to follow the prescribed process in our agreement.
      In the end, it is apparent that you are simply trying to defame and harass us. We suggest that you stop attempting to slander and defame us because, as we said before, your system is fully approved and fully operational and it is delivering what you are contracted for despite your misrepresentation of the truth.

      The manufactures literature (attached) clearly states ventilation is required. The engineers letter provided does not reflect actual field conditions. The analysis uses a 6 joist with only one hole in the middle. The contractor drilled three 2 holes in the 8 joists. There location at 1 1/4 below the top does not meet code. The local building inspection has reopened this issue and will be bringing an engineer and reinspecting.
