      Contracted ******************* DBA All Phases Mechanical on 10/24/2023 to install a Vitodens 100-W Model VIEB1KE199 Gas furnace at *********************************** East Falmouth MA ***** The contract was for $17,090.00. We paid in full, $16,235.50 to receive a 5% discount.Parts were delivered by the supply house on 12/4/2023 after many emails and texts about when this job would be started.Installation was started by All Phases on or about 12/8/2023 after the furnace being delivered, the only work done was mounting the furnace on the wall (picture attached) and the hot water storage tank was disconnected and removed leaving the home with no hot water. The old furnace was not disconnected so the house had heat during the winter, but this making nonhabitual for use for 4 months. Then after many more requests by phone, text and Email as to when the job would be worked on again, we were told by All Phases that their attorney *************************** would be contacting us. **** sent an email on 1/29/2024 advising that **** is Bankrupt and cannot complete this job. We have been asking for $6245.00 the amount we were charged by another contractor and electrician for the work completed in April 2024 This cost us much more than $6245.00. As we lost the use of our home for 4 months. A $1200.00 Mass save rebate that we are now not eligible for and we have no warranty. In total my loss is around $10,000.00.

      When All Phases Mechanical started this project, a new boiler and all stock to complete the job was delivered.  At that time, All Phases Mechanical also fixed the customer's existing boiler so that it would run for them at no charge.  The only item left to complete was approximately $1500-$25000 worth of labor to complete job.  All Phases Mechanical did notify the customer that there were delays in they project and that the company had since downsized.  A settlement was negotiated with both parties to complete the the job for $1800 which the customer accepted but then ********************** was not given entry back into the property to complete the project.  The customer then informed ********************** that they had job completed by someone else and the $1800 settlement offer was still not responded to or accepted.  During this entire time, the new boiler was on site in the customer's possession so there is nothing that held them up from applying for the rebate from MassSave or registering the unit for warranty purposes.  The settlement offer of $1800 still stands.

      reopening my complaint because of non payment on an amount negotiated with BBB , All Phase Mechanical and myself.

      We have already offered and customer originally agreed for ********************** to pay customer $1800 to settle this matter completely.  Customer claims work has already been completed by another contractor.  Our offer of $1800 for total settlement still stands.  We will reach out to customer again today to offer this $1800 settlement and request confirmation in writing.
