On May 21, 2024, I signed a contract with Ivy and Web, LLC, for design work, to be completed in six weeks. A deposit was made of $2,550.After more than five weeks, only two design assets had been delivered. Over the course of the final weekend before it was due, a flurry of emails and deliverables came in, all of substandard quality. The design firm agreed the work was substandard. With only four days till the agreed upon deadline, I decided to end the contract. There was no credible way for the design firm to complete the work, and even if so, the work had been unacceptable. The firm now states that all the outstanding deliverables, including a 30-page deck and brand guidelines, were "80% done" and though they will not be delivered to me, I still am required to pay for them. This was not an hourly contract but a contract based on deliverables. Both the firm and I agreed the deliverables were below standard and not complete. Now the firm is threatening to go to a collections agency if I don't remit pay for this "80%" which appears nowhere in the contract that I can see.I have offered to pay half of the total amount, but that was rejected. I now seek full reimbursement as I can not use a half finished or even 80% finished deliverable. Please help.

I am rejecting this response because:

The business is making wild claims regarding "theft" and "stealing", which are indeed actionable.

This design firm provided me with a timeline of deliverables that it did not follow, presenting work that it agreed in writing was not complete. That was a breach of contract, which in the contract clearly states that I as the client was fully justified in cancelling. When I said I was unhappy with the work, the company replied that it would go to a collections agency. There was no offer to mediate the dispute.

I have moved on from this company. I could not use any of its work. It wasted my time, breached its own contract, threatened its client and is now actively trying to damage my reputation. This is not any kind of business or industry norm.

I paid the firm with the expectation it would take my feedback and send me complete deliverables on time. The firm worked at total of four days on my project and the results are obvious. I paid $2,550 for this, and have zero to show for it. As evidence that the company's work was unacceptable, unfinished and therefore not useable in any way, I hired another design firm and the work was completed in under two weeks. I then was able to launch my business, without using any of this design firm's self-described incomplete work.

It is clear the firm has no intention of remedying this, instead relying on bogus threats of collections agencies (not applicable in contract disputes) and a lawyer that I have not heard from and has no basis to contact me.

    Sincerely,
