      While getting my car washed, the back visor/brake light on the rear back window was broken off almost completely. I went into their after a few days later to look at video, but was shown nothing that indicated that they weren't liable for the damage. I reached back out via phone call and email to no avail. I'd like to be compensated for the damages to my vehicle and I want to pursue this legally as well. The person that I spoke with in person at this location is named ***** as well.

      After looking more into this claim this is what we found.

       * The vehicle is approximately 14 years old  (2008 ***** CX-9)
      * The rear visor on this SUV was dislodged in the first few feet into the car wash when the long hanging cloths (miter cloth) touched the rear of the vehicle.
      * These cloths are about 6' long by 4" wide and drag over the roof and then fall on to the rear of the vehicle. Any pressure asserted is a result of gravity.
      * There was no malfunction of this equipment and we washed hundreds of vehicles both before and after this incident.
      * We had video surveillance of this incident and showed it to the customer.

      Our logical conclusion is that what ever clips hold this part onto the vehicle we ether rotted or had prior damage since the part was dislodged quite easily by nothing but the hanging cloth. We do our best but we cannot inspect or control the condition of vehicles that are brought to us. If we see something obvious we would either warn the customer or possible refuse to wash the vehicle. In this case there was nothing visible but we would have no idea if the rear of this vehicle had ever been repaired, worked on or if this was just old age.

      We therefore post a sign at the entrance of our wash that is clearly visible to all customers. It reads "We are responsible except for: Any part of the car that is loose, rotted or previously damaged, Modified or non factory items, Antenna & Lowered vehicles, Vehicles 10 years or older."

      The reason we identify vehicles that are 10 years or older is that molding and clips on these vehicles do not last for ever and there is more likely to be an issue that is a result of the age of the vehicle and not our equipment. In this case the vehicle was 14 years old. For these reasons we will not be responsible for the incident with this vehicle.

      Respectfully
