We hired ********************** and Sons to strip and reroof our house. We never received a written contract which violated M.G.L.c. 142A. We did not have a start or finish date. We received only an estimate on June 20, 23 for $10,959 both in email and personally dropped off by the owner. The estimate included drip edge. We also assumed as a licensed contractor they would acquire any building permits since they are responsible for compliance. On June 27 we emailed ********************** and Sons to advise we got a delivery of materials but the drip edge is solid and we have vented drip edge. On June 28 at 1:31 pm we received a reply email saying they were coming tomorrow and will bring vented drip edge. The roofers and a ******* showed up about 7am on June 29. After the roof was stripped the ******* advised my husband that they were not going to replace the drip edge because there was nothing wrong with ours and we would save money on that. We were not looking to save money, we wanted a quality roof. They completed the roof that day about 4pm. We paid Mr. ********************** by check for the full amount of $10959 on June 30 in person when he stopped by after my husband asked how much we owe him. We expected the amount to be slightly lower because of the drip edge costs. We also informed him of a twisted shingle that needed to be fixed on our garage. He advised he would send someone by to fix it. We waited a couple of weeks for the building inspector to come by to inspect the roof and no one came. They also never came to fix the shingle. On July 24 we emailed ********************** and Sons asking if they had a copy of the building permit or if we needed to go to Town Hall. I also emailed Town Hall. I heard back from the town that we did not have a permit and we emailed ********************** and Sons to advise "We heard from the town that a building permit was not pulled. Not sure why and this needs to be fixed." On 7/25 they replied stating "Don't know? I submitted the paperwork earlier this morning. But had an issue with uploading a document. The clerk just emailed me with her email to send it to her for she will take care of loading. When ready I will print and drop at your house" Two weeks went by and I went into the ************************** on 8/9 to inquire, they stated the permit was not submitted but a draft was started and they didnt recall the part about him having to email the clerk a document. We immediately emailed ********************** and advised what they said. He replied the next day and said he submitted two permits ours and another and gave me the address, he will call Town Hall when they open. Later that morning he emailed to say he called ******* got voicemail and he will check on ours. He now will not respond to emails. As of Monday August 14 per the ************************** the permit has not been submitted. They did advise they spoke with Mr ********************** on Thursday August **************************************************** a draft form and had not been submitted, they also informed him of what was missing from the application in order for it to be submitted. We tried to be fair and give them a chance to fix things on their own but as of now we feel we are getting the run around. If the work was completed as it should have been they would have no problem with having it inspected.

This complaint is about a lot more than a building permit. We found out today our name was forged on the Property Owner Affidavit that was submitted with the permit application. We were never asked to sign that. Nothing has been done about the drip edge they didnt replace and we were charged for. They did fix the twisted shingle on the roof yesterday.

The issue appears to center around the vented drip edge that was not replaced when he roof was installed. As part of our normal instillation, if vented drip edge is present, *********** as it does not provide any additional service to remove and replace with new materials. The invoice that was paid had a cost for drip edge which was used for the edges of the roof not the *****. After reviewing the drawing and my quote. I owe the ******** $221 for the drip edge not used. General information the material cost for the vented drip **** is $46 per ************************************* the quote.

We are rejecting the business response because it is not common practice for all roofing contractors to not replace the old drip edge with new. If it is ********************** and Sons "common practice" we should have been advised of that before they stripped and reroofed our house. If we were advised of that up front we would have chosen another roofing contractor. We were lead to believe that the vented drip **** would be replaced. We have two emails regarding the vented drip edge. The first on June 27 when we emailed Mr. ********************** to advise we got a roofing materials delivery but the drip edge they dropped off looked solid. We advised him that we have vented drip edge and no other ventilation in our attic. His response that same day was "we'll swap it out".  The second email was on June 28 when he emailed and stated "coming there tomorrow will bring vented drip edge". Neither of these emails advise that they do not replace vented drip edge. They actually both suggest that it will be replaced. We are also still waiting for Mr ********************** to schedule the town building inspector to come out for inspection. The only person who can schedule the inspection is the person who pulled the permit. At this point we do not even know if our roof meets building code. If his work meets code we are not sure what the hold up on this is.

We are rejecting the response because it has been 10 days since we received the response saying he will contact the Town to close out the building permit at the end of the week. (last week) He still has not called for inspection to close out the permit.

I just talked to ******************* ************** I emailed a request to close out  the building permit as requested. However, I failed to read the fine print. Althought you can request a close out on the web. It is not acted upon and has to be called in to the office in person. I tried doing that this afternoon but was told tocall tomorrow morning before 10 to schedule. I will do just that in the morning.
