      My home owners insurance carrier hired an engineer to inspect and write a reort on some structural issues Ive been having. The engineering firm said they would be able sign an affidavit stating they wrote the report so I could submit as evidence against the home builder (as insurance denied claim). Carrier approved claims adjustor and engineer to sign affidavit. Adjustor dis and informed engineer he has permission to from carrier and adjustor. Now engineer will not respond to any emails, despite me fulfilling his request. His report and name have already been submitted to opposing counsel, and a notarized affidavit is likely to avoid the need for trial, which would require more time and effort on the part of the engineer.

      To Whom It May ****************** complainant, *************************, is not a client or customer of *******************************************.  There is and has been no contractual agreement (verbal or written) between the complainant and AEGIS.  Our client, the insurance company, did provide their approval for AEGIS to sign the noted affidavit; however, the insurance company declined to pay our costs for processing the affidavit and any subsequent costs associated with responding to subpoenas, depositions, or court appearances.  This is because the insurance company declined coverage for his insurance claim and the dispute resides between the complainant and a third party (the complainant's contractor).  ************* company's approval for AEGIS to sign the affidavit does not obligate AEGIS in any way to sign the affidavit or perform any other services for the complainant.    

      We did have a dialogue with the complainant prior to his filing of this complaint.  We also communicated by telephone after the complaint was filed and before obtaining knowledge of it.  In that telephone conversation, AEGIS agreed to sign the affidavit and cooperate with the complainant if he withdrew the BBB complaint; and if he agreed to enter into an agreement for our services (at our customary rates) in the event we are compelled to respond to subpoenas, appear at deposition(s), and/or appear in court.  The complainant did not inform AEGIS of his BBB complaint at the time of that telephone conversation when we made a good faith effort to move forward and assist the complainant.

      We are aware that the complainant has not withdrawn his BBB complaint, as agreed to by the complainant.  As such, we have not sent to him a written agreement outlining our services and rates for his approval.  

      Once again, there is no contractual agreement (verbal or written) between AEGIS the complainant.  As such, we have no legal or contractual obligations to do what he asked; and the complainant has not basis to file a BBB complaint against AEGIS.  Nonetheless, if the complainant withdraws the BBB complaint we remain willing to submit a written agreement to him for our services including our billing rates, and to execute the affidavit if the agreement is signed.

      I have reviewed the response submitted by the business and, as I noted in my message yesterday, the issue of has been resolved and were working towards other matters. I attempted to withdraw the complaint, and was told complaints cannot be withdrawn.
