I bought these **** 10.5 sneaker Thur ********* not realizing that they use marketplace vendors. I picked what I thought leather thus water resistant breathable sneakers for my dad that end up been too small. The seller is unwilling to exchange the item for a bigger one ( forget not been water resistant and not leather as she states on the description) but wont ever exchange for even for a bigger size claiming all sales are final The sneakers are on their original box and labels. Ms. ******* provided all the proof we need.
Her upload shows that the item is marked as 'all sales final'. That is just above where she circled 'leather'. No where does it state on the item's description that the item is waterproof or water-resistant. I have no idea where she got that from.
The URL provided here, also shows that the item is clearly marked as "Sold By Built4Speed a ***** Marketplace seller". ****************************************************************
This system is not letting me upload my own photos of the screenshots, so you will have to go and see for yourself. If there is another way for me to do so, I would be happy to.
I would like to add that I even included a hand written thank you note while packing her item with care. I even reiterated my policy on it, but that was something she was already aware of, as she must have seen it since it was directly above the bullet point she circled in her upload.
I have done nothing wrong. I did not advertise falsely. I disclosed all the details about the item and it's terms of sale.

Ordered a pair of running shoes from ****** Turns out it was actually through their "Marketplace" which I was unaware of until after my purchase. The shoes arrived from "Built4Speed" in a used, half broken Famous Footwear box- on the invoice, Melissa R hand wrote "Sorry for the used, broken box". None of this would have been an issue if the shoes fit. I spoke with her through the Marketplace communication and told her they unfortunately did not fit. I asked for a refund/return label. She stated I would need to pay $9 for shipping/return label. I was totally okay with this. Tracking number indicated the shoes were returned to her on June 5th. Fast forward to June 21st and I have heard nothing nor received my refund. I reached out to her multiple times with no response via her "Built4Speed" website. I finally heard back from ***** who stated that she claims "The shoes were returned "too dirty" and will not be issuing a refund". This is ridiculous and ***** should do a better job vetting sellers before putting them on their Marketplace. Also, Melissa R, owner of "Built4Speed" is a ***** who will steal your money.Business Response

This is the exact email (a copy can be provided) that was sent to my account manager and the Customer Support department with ***** on June 7th:
Customer, ***********;*******, asked for authorization to return the size 7.5 Nike Air Max SC from her purchase order, *******.
Not a problem, I authorized it and sent a prepaid return label.
Package came in yesterday and the sneakers were dirty and worn; not how they were shipped out. She (******) stated they were too small, so this was not a quality issue on the return.
The sneakers are in my possession. Since I cannot relist and sell these (they've been worn) and I did not receive them back in the condition they went out in, I will not be issuing a refund.
Picture is attached (I have several more that I can forward), so if there is an issue in the future with the customer asking for a refund, that will have to be denied. I do not and will not authorize a refund from my end to ******. If need be, I can ship the item back to her. She would need to be charged for shipping though, since I have already spent a lot in shipping product to her and paying return postage.The following day, Customer Service stepped in, opened a case and took over from there. I was not to communicate after that with ******************, so that is why I have not responded to her. I do sincerely apologize to ****** that she is not happy but I too was not happy to receive items back that were used. This is how I make a living and I have expectations of receiving items back in the condition they were sent out in, so that I may sell that pair of sneakers again. ***********speaks of the "box" they were in. I can take a photo... they were shipped in a recycled material, heavy-duty shoe box lined with color-coordinated tissue paper. I am confused on how that was so terrible. I did write a personal note as to not having the original box, as that was damaged during shipping, but her sneakers were shipped well.
Again, I do not like having upset customers but ****** needs to understand that I have to protect myself and my business. I do not allow used products to be returned for refunds.

I am rejecting this response because:First of all.. a tracking number clearly indicates from UPS you received the shoes back on June 5th. You can try to lie and say you got them yesterdaybut I have a tracking receipt with proof of delivery on that date.
You know you are scamming and lying about the Nike shoes. They were NEVER worn on my end as THEY DID NOT FIT. I reached out to you multiple times trying to communicate with you in regards to my refund- I dont understand why the communication just ended? Once you got received my return you disappeared bc you had my money and your perfect product back that you could then resell to someone bc THEY WERE NEVER WORN! Why didnt you say anything to me about why you werent issuing a refund? Why have I had to go a million different directions trying to reach you regarding getting my money back? If the shoes were actually dirty- why wouldnt you have said something directly to me via email? If the shoes were worn and dirty WHY would I return them?! I bought them bc I wanted them.. why would I wear them and return them 7 days later!?
Its clear you must need the $135 dollars really bad to be putting your business and your reputation out there like this. You are SCAMMING people out of money- there are multiple other complaints made on BBB stating you did the exact same thing to them.
But again, Im sorry you are so desperate for $135 dollars.

I have already responded to all of her concerns and stand by my actions. The images are time and date stamped on my end, I can prove that. They were taken hours after the package was delivered to me; they were worn. I explained why I no longer was allowed to communicate with ****************** as well. I apologize that she does not like rules and policies. It is clear she has an issue across the board with following and reading instructions.

There are two options; issue a refund- or send me the shoes back that I paid for. If neither of those requests are met, you will be hearing from my attorney as what you are doing is illegal and called STEALING.Im not sure how this isnt clear to you. And Im not sure what world you live in to think what youre doing is normal business.

I bought **** shoes but were too small. I then contacted the seller to see if I could return and they approved the return. I returned the **** shoes and when they arrived the seller argues that the box was dented and that the merchandise was damaged. But the merchandise or **** shoes were brand new. They were not even worn. The seller sent me pictures of the box being dented but never took pictures of the shoes, therefore that for me is no proof of the **** shoes being damaged. If the shoes were actually damaged as they argue then they would have taken pictures of the shoes to prove to me that they were damaged, but because they were not damaged then they never took pictures of the shoes so they only took pictures of the dented box and base their argument on the dented package. And the box where I packaged the **** shoes was in good condition when I mailed it out. If the box got dented on the way that is out of my control pkus that is no guarantee that the merchandise is also damaged. I spent $90 dollars on these **** shoes and I am in no condition to give my money away to some rich business owners so they can ignore me and careless about my hard-earned money invested in their business so they can then turn around and decide not to refund me just because they don't want to. What I want is a fair treatment to customers plus for the plain reason that what I am saying is true and this is why I am seeking for a refund. I am in no condition to lose money on a merchant who is not fair and who does not care about his customers. If I were someone rich I would probably just forget about the $90 I spent on the **** shoes, but because I am not and because I do need that money back then this is why I have to now spend time on submitting this complaint to the BBB. ******************* returned damaged merchandise. The merchandise was not shipped to her in the condition it was returned. Plain and simple; items to be returned must be in the same condition as when they were sent out. She chose to encase the **** box, which is part of the merchandise, in layers of tape and made it impossible to resell the item; let alone get into the box easily. I did NOT send her the sneakers that way; not sure why she thought that was acceptable to do when she returned them.
I run my entire business by myself and kindly ask my customers to follow the directions on the packing slip for returning merchandise. At no time did ****************** state that the order was not coming back in the shape it was delivered to her in. I even sent her a pre-paid return label for the item, which was not necessary on my part, and had no way to recoup that cost. Now I have an item that is "damaged" and cannot be resold as brand new and I am out of pocket shipping fees.
I know she is not happy with the outcome, but she was fully aware of what was expected of her and she chose other wise. She will not be refunded.
