    I engaged ***** ****** at the Vertex Companies to perform structural design and drafting services on 4/16/2024 for an addition to an existing structure (my garage) (contract attached). The contract notes that the fee for service is lump sum fee for phase 1, design and drafting services (page 3, section 3.0) Note that my home, and *****, are in **********, Vertex is headquartered in ****** Before entering into the agreement, it was identified and communicated that the type of foundation of the structure being designed may be such that Vertex could not draft a structural design. In the email exchange where the contract was signed (attached), I noted I would dig a hole by my garage to identify the foundation.I identified and shared that the type of foundation was indeed the type that he warned he would not be able to work with within a few days of the contract being signed (email attached). After several weeks (Amount of time I attribute to ***** being slow to respond to emails and calls throughout the engagement), ***** notified me that vertex could not create the structural design. No documents or form of deliverable was provided I was then invoiced for the entire deposit, and my $1,500 deposit would be returned. The invoice noted 50% of the work was completed, and half of the fee in our contract is equal to the deposit I provided at the beginning of the engagement. (invoice attached) When I contacted *****, which required multiple emails, voicemails, and calling Vertex's main phone line over 4 weeks, he finally answered my calls and cited that I am being billed for time spent designing other aspects of the structure, after we had determined the type of foundation was one which his firm could not work with. I am filing a complaint because I am being charged for unnecessary services performed after identifying conditions were such that the services could not be completed. No aspect of the services or evidence of work performed were ever delivered.

    I have not heard from the business in response to my complaint. 

    The last communication I had was in July when ***** said he would talk to his manager about my issue and get back to me. He has since not responded to email or call.
