      i recieved a creidt inquiry alert from my credit card company stating that this business made a hard inquiry on my credit which cause my credit score to drop. I never gave consent to this inquiry and never heard of this business until the inquiry came through. I called the business and was told they have a right to make a hard inquiry on my credit if they are trying to collect a debt from a third party. This is completey this has now dropped my credit score beyond a threshold where I cannot get anycredit at this point. I hope this is no legal and want this to be resolved by the comapny being oenalized for teir unfair practices and compensated for the damage they have done.

      Dear BBB,

      Western Mass Credit received a phone call today, regarding this account. See attached permissible purpose and her contracts.

      Permissible Purposes under the **** Last Updated 11/9/20.  Creditors, asset buyers, debt collectors and other users of a consumer reports may only obtain a consumers credit report if they have a permissible purpose for accessing the report. Section 604 of the Fair Credit Reporting Act (****) details the purposes for which consumer reports may be furnished by a consumer reporting agency (***).1 The *** may only furnish a consumer report for one of the listed permissible purposes. Providing a consumer report for any other purpose is strictly prohibited.2 This document describes the permissible purposes for which a creditor, asset buyer, debt collector or other users may obtain a consumers credit report. The document cites opinions and interpretations of the ************************ (FTC) where applicable; however, it should be noted that the may be of limited weight as the **** now has the primary authority to interpret the ****. Debt Collection A consumer report may be obtained for the purpose of collecting on a consumers account.3 Although the **** does not specifically define collection of an account, case law on this issue concludes that collection of an account is equivalent to the collection of a debt.4 Thus, many courts have held that a debt collector has a permissible purpose to obtain a consumer report for the purpose of collecting a consumers debt.5  The Court of Appeals for the Ninth Circuit, however, has narrowed the scope of this permissible purpose. In a case stemming from a debt collector obtaining a consumers credit report pursuant to a claim for towing and impound fees, the appellate court concluded that debt collection is not a permissible purpose for pulling a consumer report unless the debt arose from a voluntary credit transaction.6 In light of this decision, a collector may need to determine whether the consumers debt emerged from the extension of credit prior to obtaining a consumer report.
