    I am rejecting this response because:

    The subject matter is Contract Violation: Not Listing the property at ******* as required by P.9.2 of the attached agreement ("The property
    Shall be listed in *******...") and NOT Installing sign at the property.

    The reply of realtor is completely irrelevant to the subject matter as the contract does not require any “meeting of the minds”. Any
    professional realtor must understand how to list the property at ******* and cost of the listing Before signing the agreement.

    The cited ***** does not grant the realtor any right of contract termination and does not release him from contact obligations.

    The realtor must strictly comply with the signed contract but not provide "a professional courtesy" that is not defined in the contract  And I
    obviously do have the right to sue him for contract violation.

    I still expect the realtor to list the property at ******* and install his sign at the property as required by the contract.

    We are sorry we could not meet ****** ************** needs
    in listing his property.  David ******* signed
    ******** agreement to list his property and did so as a professional courtesy; it
    stated among other things that the Seller (*******) could cancel at any time if
    unhappy with service without payment. The agreement also stated the property to
    be listed on MLS and *******, David was of the understanding that ******* was
    of no cost to him and in further correspondence ****** mentioned that he has a *******
    listing already set up on the property. David did his best with listing it on
    MLS and had an extra-large sign ready to place on the property, only to still
    find the prior agents sign was still there and continued to stay there.

    Since the terms of the agreement were mutually misunderstood,
    it did not have “meeting of the minds” and was not valid to begin and ******
    could of extended his right to cancel without payement.

    ******** accusation is that we did not list on *******. David
    was under the assumption we would be listing on ******* for free. Everything
    that was signed was prepared by ****** and his expectations did not coincide
    with what was discussed on the phone.

    David also has texts from ****** threatening to sue him
    during that time. Attached is a text from ****** specifying the ******* listing
    was with another real estate agent.

    ******** property has been on the market over 20 times with
    many different agents, It is too bad we could not help him.

    As a real estate brokerage, we work with residential
    properties exclusively, doing a great job for over 20 years.  After
    looking at the agreement and the one sided additional terms along with this
    property being relisted over 20 times after it expired each time with different
    agents, I’m saddened that we are also another casualty of this situation.
     After also looking at the property pictures and the pricing, it is
    overpriced and needs a lot of work and will never sell for $729,900. It’s been
    on the market now for over a month with David doing extensive marketing with no
    interest; only one showing with feedback it was overpriced with a lot of work
    needed.

    The property is currently listed on MLS, David’s
    conversations with ****** were that it was already listed on ******* and it
    would be transferred, the mistake made was signing the agreement without
    clarity. The agreement will end in a few weeks (1/31/2025), we are providing 2
    options; 1st option: we will agree to list on ******* for the
    remainder few weeks, it will be canceled at the agreement end date- 2nd option, we will agree to pay ****** a one-time fee of $300.00; this one-time
    fee can be used towards his next real estate agent encounter. We will also
    place a sign there for the remainder few weeks once it’s acknowledged that the
    previous agent sign is removed from the property along with ******** “For Sale
    By Owner” sign is also removed.

    I am rejecting this response because:

    The contract clearly states the the property is being sold as commercial and it is supposed to be listed at MLS and ******* as commercial..

    The sign of previous realtor has been already removed from the property almost three months ago.

    Again, I request the realtor strictly comply with the contract requirements - to list the property at ******* and install his sign at the property. After this is done, I will remove "For sale by Owner" sign from the property.

    The contract does not require the realtor to pay any fee to the property owner.

    The property has been listed on ******* and a sign has been
    put in the front of this house, see attached pictures. The ******* listing will
    run to the end of our agreement and the sign will also be removed then. Seller
    can leave his personal sign attached to the front of the house as “Sell by
    Owner”. This acknowledges all the sellers concerns.

    After almost three months the property has been finally listed on ******* and a sign has been put in the front of this house for the remaining one month of the contract.
