    The last of August I purchased a My4s Yacht from David ******* which is the representative of Atlantic cruising yachts Saint Petersburg Florida. In the process you take the boat to do a survey the boat was in Miami, when we were out on the survey the generator quit working after 45 minutes. I made the four hour trip back to Saint Petersburg while David assured me that when I picked Up the yacht to drive it around south end of the Keys and back around to Saint Petersburg that the generator would be fixed and working ,verbally he told me that over the phone ,in order to move forward with the sale I need it to sign the papers accepting the boat, assuming the generator was fixed as he told me it was. When I drove the four hours to pick it up at this time the boat was in Fort Lauderdale I brought with my wife and two other people to go with me to bring it all the way around south in the Keys. After 45 Minutes The generator quit working again. it being a hot week coming up we, went back to the dock and asked for the generator be fixed. David assured me that it was fixed he took off and could not be reached by phone and a gentleman named Paul I was told was my go-to guy there in Fort Lauderdale. Paul was in the hospital and actually could be reached a little bit and was helpful. But in the meantime, they called a couple mechanics to repair the generator that they supposedly already fixed or at least David told me that they had repaired it already. When it was done it worked great and we went ahead and finished our trip over the next seven days. A couple weeks later they sent me a bill for repairing the generator that they told me they had already fixed and told me that I had signed off on it and presented me with a document where I signed and accepted the boat. The boat was in Fort Lauderdale David assured me that he had it fixed I am in Saint Petersburg Florida I had no choice but to sign off on it. I was presented with a threat to sue me over the $435 to repair it.

    Thank you for passing this along and bringing this matter to my attention.

    Mr. Powers purchased a used (previously owned) vessel from Mr. James ********** a third-party seller, with Atlantic Cruising Yachts ("ACY") acting as the Listing and Selling Broker. A copy of the Brokerage Contract is attached.

    As per the contract, ACY (the Broker) makes no representations or warranties concerning the condition of the vessel or its fitness for the intended use of the purchaser. The vessel was sold by the Seller (Mr. Kostowicz) "As-Is".

    In addition. Mr. Powers had an independent marine survey conducted by a third party to confirm the condition of the Vessel and its fitness for his intended use, prior to his acceptance of the Vessel (see attached Vessel Acceptance).

    After the acceptance of the vessel by My. Powers, at his request ACY assisted him with performing some service work on the generator. However at no time was this service offered for free by ACY, nor was ACY under any obligation to offer such services for free to Mr. Powers.

    Everything Chris **** said about the contract is true. What he does not say is that I call him , emailed him and even sent him twice old fashion paper mail.He chose not to respond. Atlantic cruising yachts represent themselves as being America's number one dealer so when you purchase something through them as a brokerage yacht worth 700,000 and the salesman tells you that it has been absolutely fixed and encourages you to sign the letter of acceptance knowing the boat is four hours away and you cannot go check it, You take his word for it and accept it and basically that is what David ******* did. David represents Atlantic cruising Yachts and he flat out lied to me about a repair being done which yes we did surveyed the yacht and the repair was called out and was supposed to be done and in this case it was not it was a flat out lie. The CEO of the company has refused to even talk about it or discuss it. I am trying to give them the opportunity to make it right before I write a review online. It is real simple he said the repair was done and it was not in when I asked them to complete it they call the company that did the work and then they said they were gonna sue me and else I paid for it.
