      On 11/29/2024 I had a consultation with **** ******* at A New You Med Spa about the weight loss program. I signed up for the program, opened a Care Credit account, and was charged $2,999.00 Immediately. Over the weekend I decided this was not a good choice for me. On Monday, Dec. 1st at 11:00 a.m., I physically went into the office and handed **** ******* my cancellation letter stating I wanted to cancel my participation in the weight loss program. I did this within the 3 days in person as stated in the contract. I have called the office on Dec. 16, January 6, & again on Jan. 8th. I left a message each time to return my call that I wanted a refund. I have not received any return phone calls. I have not spoken to or seen the doctor, I have not received any medical care and I have not received any weight loss drugs. I want my Care Credit account to be credited $2,699.00. I understand I have to pay the $300 consultant fee. I would like this money credited to my account within 5 business days of BBB contacting **** ******* with A New You Med Spa. As of January 13, 2025, I have not received any return calls or a credit to my account. Attached is a copy of the contract that states "If you cancel within 3 days, you are entitled to a full refund of all monies paid, minus services already rendered. "

      Good afternoon, 

      This case concerning ***** *********, is a little more complicated than just a typical return/refund.  She came in on 11/29/24 for her GLP-1 weight loss prescription medication consultation.  During this consultation she had her recent blood work already done (Blood work is a requirement for the medication to be prescribed). Typically the patient is given a Labcorp blood draw slip to take and have the blood work done prior to ordering the medication.  Ms ********* was able to pull her bloodwork up on her phone to show me the results. At that point I felt comfortable having her prescription written in her name and sent to the compound pharmacy.  We also discussed the fact that she was going for some other health related diagnostics and she asked "depending on the diagnosis... if she had to, could she still just hold onto the medicine until all of that was cleared up".  My answer was "Yes, absolutely!".  At that time, as is our normal protocol, her payment was charged to CareCredit in the amount of $2999 and all contract were signed. (see contracts)  After the consultation was finished Ms ********* left and I filled in all of the required paperwork and passed it directly to our doctor.  Our doctor approved the request for the prescription after reviewing the file.  At this point, the medication was ordered and paid for by our office.  

      On the afternoon of 12/2/25 Ms ********* brought a typed letter with her signature requesting cancel her contract.  During that visit I told her under the circumstances, I would forward it to the doctor and It shouldn't be a problem considering her pending health issues that had not been diagnosed as of that day.  After she left, I sent all of her paperwork and a explanation as to why she was requesting  the refund.  A few days later, I called Ms ********* and left a message hoping she was doing ok and that as soon as I heard back from the doctor and billing I would let her know.  A couple days later I called her again to let her know that I spoke with the doctor and left a message to call the office.  I have never once heard from her since she dropped the cancelation letter at our office.  The reason for the last call was to let her know that the doctor was willing to give her a partial refund (minus consultation fee $300, blood work diagnostics $100 and the $480  for the medication that was ordered in her name).  The main problem was that since the medication was prescribe in her name we need a letter from her doctor stating that is was unsafe for her to take the medication.  Reason being, that the medication came here in her name and must be recorded as rejected.  If the department of pharmacology were to audit our logs there must be a legit reason for destroying the bottle with her name on it and having it accounted for.  I also wanted to give her the option of holding onto the medication for use after she was medically cleared by her other doctor since she would be paying $880 for services rendered.   Still I haven't heard a word from her..,She went right to BBB instead of calling us to start the process to close out her account.  I never thought that she was feeling disgruntled.  I was doing her a favor because the yellow MEDIPAY receipts (see small yellow) acts as a medical no refund contract for doctors and medical profession offices.  ******* has an exclusive agreement with all credit card companies stating that this is a medical procedure and is 100% non refundable.    As I stated above, We were willing to offer her $2119 because of what she was going through medically.   I do not want this to be on our BBB record considering we nothing wrong.

      I am rejecting this response because:

      I am rejecting this response because: A new You Medical Spa did not return any of my phone calls and I followed the protocol to cancel according to their contract.  I called and left a message on Jan 3rd, Jan 7th and Jan 8th. I never received a message from them ever that is a bold face lie. I cancelled the contract in the allotted time frame in person to ***** ******* at that time my account should have been credited. A new You Med Spa did not take any blood from me so therefore I should not be charged a fee of $100 for blood work.
      I also cancelled according to their contract for treatment per their rules. I did not have an appt. with the doctor, I did not talk with the doctor and I did not receive any medication. Therefore I should not be charged the $480.00 for medication.
      Per their agreement "IF you cancel within 3 days, you are entitled to a full refund of all monies paid, minus services already rendered." IF for any reason you choose to not go forward with the weight loss program after the consultation with the doctor you are responsible for the $300 Consultation fee".  All I had was the consultation and it wasn't with the doctor. I want a refund of money except for the $300.00 consultation fee. 
      Why was weight loss medicine ordered when I clearly cancelled my contract? When I dropped of the cancellation letter to ***** ******* I was told the doctor would review it but the doctor was out of town for two weeks. I said at that time to her in person that I was CANCELLING my contract. There was no need to speak to the doctor about anything. 

      I did not need a letter from the doctor to join the program even after I told her of my medical issues. I do not need a doctors note to cancel the program. 
      I do not appreciate them trying to rip me off for charges I did not incur. I want my refund that I am entitled to per their contract agreement.  ***** ******* did not call me I have  one phone a cell phone and I have not received any calls or  any messages from her.
