Contacted the company for a second time concerning an injury complaint from a car accident in September of 2024. I received a few arbitrary citations that have not been resolved yet. I was contacted by Attorney Juan P*** on October 2nd who identified himself as a "supervising attorney" that I see has another complaint concerning his level of dedication to clients and their cases. He cited the contingency contract several times indicating that his services were based on being paid and not in the interest of justice. He advised me that since their services are contingency-based, he would decline to take my case because he was unsure of the outcome of my case. I was under the assumption based on advertising that any attorney that I entered a contract with would fight for my case with the same level of urgency and concern regardless of the outcome. That was obviously not the case in my situation and I would like to find a way to prevent this from happening to someone else, and resolving my issue that I entered a contract for.Customer Answer

Saiontz & Kirk, P.A. was retained on September 16, 2024, to represent ******** ***** for injuries sustained in a motor vehicle accident. The contingency fee agreement signed by Mr. ***** when he retained our office contained an Acknowledgment (Paragraph 5), confirming that Saiontz & Kirk, P.A. reserved the right to withdraw from representation if, after investigation of the facts and circumstances, we determined that a successful resolution is unlikely or that the probable result is outweighed by the risks and costs associated with pursuing the claim. Following a careful consideration of the facts and circumstances, we spoke with Mr. ***** on October 1, 2024, and explained that we were unable to move forward with his claim. While we understand Mr. *****’s disappointment with our decision, and we have encouraged him to seek other legal counsel and wish him the best in his further pursuit of this matter.Initial Complaint

I was in a car accident July 21, 2023.
The police will call in a report was created. I called the lawyer for my injury asI was sitting at a red light when I was hit. I had an infant child in the car with me and we both went to the doctor. The law office of Saiontz & Kirk Immediately had me start physical therapy at a local physical therapy office. I am a full-time teacher so I had to go after work sometimes six 7 PM causing me to have a sitter for my 3yr daughter, in order to get my injuries updated for me. After about two or three months, I stopped attending Physical Therapy. My car was totaled two times by my insurance company And I was placed into a rental for several months because the two insurance companies could not come to an agreement on my car. The car mechanical work had to cost me over $1000 out of my own pocket The lawyers did not give me any feedback or resolve my case. I have not heard from them in several months and I’ve reached out to them via email and had another car situation resolved since this accident. No one has told me if my case has been updated. I had to go see a doctor again about my physical injuries and I sent paperwork and In March 2024 I was told it had an issue uploading. No other feedback was given to me prior or after in the past six months. Therefore, I’m riding because the company where I went to Physical Therapy probably received money. I’ve still not received any money from my car or my injuries and they are using my medical records in order to pay for the physical therapy and I’ve had no feedback from them.
I’m not even attending physical therapy and I have not attended this year. I would like help to get my case finalized and to receive the monies I was supposed to be returned for having to pay for my damages from my car out-of-pocket, although I hired a law firm to help me get the money from the insurance company. I’ve not heard from the insurance company of the woman who hit me or the law firm Saiontz & Kirk.Business Response

I have left messages, sent e-mails and sometimes it has been months before receiving any response from S****** and Kirk. Initial case manager refused to return calls, acknowledge correspondence, text messages or e-mails and was very condescending. I sent messages to client services no response. Months later talked to Attorney Juan P***, who assured me once the medical documentation was received, my case would be finalized (July 2023). Weeks later no response. September, I was transferred to Attorney Cody R**********. He informed me he was new to the office, would be finalizing my case within the week. He asked me for an impact statement. Impact statement was sent May 2023. Month later he sent an e-mail asking for the impact statement again. This let me know he had not finalized my case or reviewed my file. Left several messages no response. Frustrated, I sent e-mails and left voice messages to the founder, no response. Sent e-mails on their website, no response. October received a call from Scott G********, Manager of the Ligation Department. Apologizing for the failures of his office. Shortly after, Mr. R********** called, said he had no excuse, promised to wrap things up in a couple of days. Weeks passed no response. I contacted the agency and was told Mr. R********** quit. In November my case was transferred to the settlement department. Received a letter from Attorney Eric S******, not once have I received a phone call. Have talked to the case handler Pam S*****. It is mid-March. I have been back to work for over a year. The young man that rear-ended and totaled my vehicle was cited by the MD State Trooper. He was going too fast and not paying attention. I was seriously injured; have lost wages, medical bills and now a car payment. Really need Saiontz and Kirk to care, communicate and to fight aggressively on my behalf, since I was told the defendants insurance company accepted liability. My life is still being impacted by the car accident!Business Response

I talked to them about a class nation lawsuit. They sounded good at first. Then they had another law firm. Send me some paperwork. I was out of town working when I got back in town. It was past the due date I contacted them and they told me that it would be all right to send the paperwork in, well the paperwork told me to sign places but do not put my social or my name down among other things just sign it don’t date it or anything I seen it then I contacted them and asked them if they got it and they need anything else and what else do I need to do next? I got an email saying the other people were dropping me not a reason why or anything else That’s just fishy to me. Don’t make sense like they just want me to sign it so they can file it and get the money and I had to give it to me well I’ve already filed with another attorney and they’re looking into it so yeah, just fishy like they’re scam artistBusiness Response

Following an investigation and careful review of the circumstances surrounding his injury and exposure to the medication at issue in this litigation, correspondence was sent last month confirming that we are unable to move forward with any legal action on his behalf. car accident was January of 2022 and my medical treatment ended in March 2022. This company is neglectful with answering and being attentive to their clients for I’ve contacted them on many occasions with absolutely no response in return. After MONTHS, they gave the excuse of my case being tossed around at their firm because of employees leaving, granting me a “10%” discount… Then continued dragging their feet and asking for documents that I had sent to previous case managers there- leaving me to be so confused with who I was even “working” with because literally nobody ever answers me. At this point, my case was finally offered a final settlement last month in which I’ve signed. Now, crickets yet again with absolutely no response or update. Are they stealing my settlement? Where is the proof of what the real settlement offer was? Everything is just information they throw at you when they decide to contact you months later. I lost my career due to an accident and this law firm has completely neglected my entire case and my settlement that I’ve yet to receive. I do not believe they deserve any money from my settlement whatsoever. I have a pile of pain and suffering and lost wages that has created a domino effect from their lack of work. I am requesting my settlement immediately and a refund from them.Business Response

Saiontz & Kirk, P.A. represented ********* ******* for injuries in a motor vehicle accident that occurred in January 2022. As Ms. ******* points out in her complaint, following the investigation and handling of this matter by our office, a settlement was recently reached. Ms. ******* signed a detailed settlement disbursement statement and the insurance company release on May 1, 2023, which was promptly forwarded to the carrier so that the settlement funds could be obtained. Ms. *******'s settlement check was mailed to her on May 15, 2023, two days before this complaint was submitted to BBB. We have subsequently confirmed that this check was cashed on May 19. Following receipt of this complaint, our office made several attempts to reach Ms. ******* via telephone and email, to go over any additional questions or concerns she may have. A follow up correspondence was sent to her on May 21, 2023, enclosing another copy of the settlement disbursement statement she previously signed, which outlines how all of the funds were disbursed. We have not received any response from Ms. *******, but remain available to review any questions Ms. ******* may still have.Customer Answer

I am rejecting this response because:
There is no accountability being taken with lack of communication and financial setbacks to myself caused by the law office. There were handfuls of occasions where I was ignored, handed off to others without knowledge, and the amount of time between my treatment ending to the office finally doing their job to work towards a settlement was extensive. I deserve a partial refund at the VERY least.

I contacted Saiontz & Kirk, P.A. about a hernia mesh suit. They took my case and upfront seemed like they cared. after the paperwork was signed, they started ghosting me and calling me back without leaving a message. Never answering my calls or returning emails. They call from a random number every time too.
This is the most unprofessional law office I have worked with and I would advise others to go somewhere else.
My case is now locked with them and I just need to get contacted by them.Business Response

The original notification about this BBB complaint was not received by our office, but we did speak with Mr. ******** around the date this was filed. Mr. ******** had an incorrect phone number for our office, and the random calls described in the original complaint were not made by our office. Following receipt of this subsequent notification about the BBB complaint, we spoke with Mr. ******** again on March 16, 2023, and have confirmed that his prior concerns were addressed and he is aware of the status of this matter.

I sent a message to this law firm with a direct question asking "how do I submit a claim for the ************ settlement lawsuit", that question is really not that difficult to answer but according to this law firm, it's one of the most difficult questions to answer.
They sent me an email saying something along the lines, based on my message and they cannot represent my case...
Okay, I see the following issues with their email they sent me:
1.) There is no indication in my message that I want to be represented nor have I asked to be represented, correct?
2.) Cannot represent me? EVEN IF I asked to be represented, this law firm is representing everyone else for the **** recall...
So again, how do I submit a claim for the settlement? And don't ask me what claim because we know what claim I am referring too...Business Response

Mr. ************ contacted Saiontz & Kirk, P.A. regarding a potential claim involving a recalled ****************** machine. Our law firm represents individuals who are pursuing individual product liability claims after suffering specific injuries that we believe can be causally related to long-term exposure to particles released by the machine's sound abatement foam. Mr. ************ submitted information to our law firm through a web form intended for individuals seeking a free consultation and claim evaluation.
Following a review of the information submitted by Mr. ************, we did attempt to reach him by phone. After we were unable to reach him, an email was sent explaining that based on the information provided his claim does not appear to be one that our office could pursue. However, we did invite him to contact our office if there was additional information that may change our evaluation, and offered to schedule a time to discuss any questions in further detail.
Based on the information submitted to our office, it is our understanding that Mr. ************ already received a replacement machine and was only looking to pursue a "settlement refund case". Our office is not pursuing non-injury claims for individuals who only incurred economic damages from ownership of a recalled machine. Mr. ************ would need to contact the manufacturer directly or retain a different law firm to pursue a refund settlement.
