    I purchased a 2024 Eagle 200 EFI motorscooter from Baltimore Motorsports on January 6, 2025 (paid in full) amount of $1,800.00, and picked it up on February 2, 2025 brand new with only 1 mile on the odometer. I had tag and temporary registration, insurance, and tag in hand as I waited two hours for the mechanic and seller to franctically get the bike started. It took so long that I asked if I could have a different scooter but was denied as they kept working with it. Finally I was able to drive it home and the next day 02/03/25, It would not start up. I called *****, (**** **** **** and informed him that the bike would not start and when it did start it constantly kept cutting off and he did not respond. The bike kept cutting off every 15 to 50 miles from 02/02/25 until finally on 05/01/25. The bike has a total of 351 miles on the odometer. I have been keeping ***** informed, however, he does not want to assume responsibility. The bike is my only transportation. This bike is registered under Maryland Motor Vehicle Adminstration as ***************** because it is 168cc and has a road speed of 60 plus miles per hour. the state of this bike also falls within ******** statututes *******, to ******* of the "Maryland Lemon Law", because it is technically a class D motorcycle which 1. a new 2024 vehicle with 1 mile when possesed by owner. 2. has been driven/rode less than 1800 miles, 3. Has caused substantial decreases in use and selling equity because of th defects that it has/had since purchase date. Has been out of use for 21 days to the date of this BBB complaint. I wish that the owner would take some accountability since he has knowledge of the conditions of this bike before I drove drove it home on 02/02/25 and up to the date of this complaint. I am hoping that we can come to an agreement before I pursue futher litigation in this case.

    We take all customer concerns seriously and have thoroughly reviewed your complaint. However, after a detailed investigation, we believe that there are some inaccuracies in your account of the events, and we would like to address these matters directly.
    Firstly, regarding the issue of the scooter not starting and cutting off, our records show that the scooter was thoroughly inspected and successfully started by our team before it was handed over to you. At no point was there any indication that the scooter was in a defective or non-operational state when it left our dealership on February 2, 2025. Additionally, we have no record of any missed communications from ***** (**** **** **** and we believe all interactions have been properly documented. (I've attached a screenshot of the text message the customer sent. We responded promptly and requested that she bring the scooter back for us to inspect. However, instead of doing so, she chose to file a complaint. Therefore, her statement that we did not respond to her is untrue.)  
    You mentioned the scooter had 1 mile on the odometer when you picked it up, which aligns with our records. It is important to note that scooters can occasionally experience minor issues after being driven off the lot, but they are covered under our warranty, and we are always willing to work with customers to resolve any issues that arise.
    Furthermore, while you have cited Marylands Lemon Law, its essential to clarify that the scooter has only accumulated 351 miles as of your complaint date. According to the law, for a vehicle to be considered for a Lemon Law claim, it must meet specific criteria, including being out of service for an extended period or having had multiple repair attempts for the same issue. As we have not had the opportunity to inspect the scooter in person and determine the cause of the reported issues, it is premature to claim that the bike falls under Lemon Law provisions.
    We are committed to resolving any issues fairly and within our warranty guidelines. However, we must respectfully disagree with some of the points made in your complaint. We urge you to contact us directly so we can schedule an inspection of the scooter and address any concerns you may have.

    I am rejecting this response because: ***** left out important statements in which he have been trying to get me to assume all costs as well as involve my insurance company in towing costs which they had paid for the the seventh break down on 05/01. Though some of my claims and observations merely happened at the time of possession of the scooter on 02/02, still I feel that he could gave me the option to choose another scooter instead of wasting two hours trying to start a scooter that was clearly defective and could have the propensity to be a problem and unusable in the near future. I also have receipts of text and telephone conversations with a witness on my behalf that can attest to him trying to push the burden of this issue on me financially, which tells me that he is just trying to get me to fix the scooter myself and to assume all ofthe financial costs of his mistake.

    Also, he called me yesterday and text me with an attitude because he knows that I am reporting the facts. He also offered to pick up the scooter today at 2:00pm so that he can inspect and fix the problems with the scooter. I agreed and will wait to see if how things play out moving forward. However I would like to leave this complaint open until the agreements are met and I am satisfied with the results. Lastly I hope this can be resoved now and not end up in small claims court. Respectively.

    The owner of Baltimore Motorsports ***** decided to pick up the scooter and fix the issues at no charge to me. Everything was free because the scooter is still under warranty and had issues that the warranty covered. At this time I would like to close this case since my issues have been addressed and now my scooter/motorcycle is running and is ok.

    Thank you for helping me with this issue, I wholeheartedly, appreciate your help. I am also keeping record of this case after your office close it for future reference.
