    We have continued to contact glen the owner from leisure pools to correct the problems we have been having since he installed the pool. The skimmers we put in incorrectly unevenly and misaligned. The company had our pool not completely filled at once and over two day period the pool was filled which left a discolored ring line around the perimeter of the pool . He has told us he would make it right but we have been waiting on him to fix the issues and now and year and a half has gone by without fixing anything and promises that have not been rectified . He told us to do what we have to do was his last message to us. We would like our pool fixed but are realizing this will not happen.

    This ********* ***** complaint contains ZERO MERIT. The issues that the *****s have experienced with their pool are the result of their own decisions; and not the decisions nor the result of actions taken by Leisure Contracting, LLC. 
    I am attaching the following documents: 
    1. Attached Customer Experience Information from ********* *****. 
    1-A Response by Leisure Contracting. The ***** Statement from her attachment: 
    "The skimmers were (sic) put in incorrectly unevenly and misaligned." 
    Leisure Contracting: The attached Contract between Leisure Contracting, LLC and Shane & ********* ***** contains a reference to a Retaining Wall to be installed BY BUYER. ITEM # 55 on the face of the contract agreement. 
    Leisure Contracting: The attached "STANDARD SWM PLAN" is the property Stormwater Management Plan for the ***** Property that Mr. ***** provided to Leisure Contracting, LLC so that the pool design would integrate properly with the property's GROUND ELEVATION. Page 2 of this SWM PLAN is a BLOWUP of the section of the PLAN that illustrates the area where the pool was to be located. The elevations specified are 568'; 566'; 564'; and 562'. The pool design required a 3' high retaining wall in the shape of a large "C" between the pool and the patio off of the rear of the home. 
    Leisure Contracting: The attached Harford County Building Permit was issued to Shane ***** for the installation of the ***** Leisure Contracting, LLC swimming pool. Page 2 of this permit specifies an approval by the Harford County for the pool AND THE LOCATION OF THE Retaining Wall by Homeowner. It was located between the pool and the patio. 
    Leisure Contracting: The attached Construction Plan clearly illustrates the "Retaining Wall by Buyer" to be "C" shaped and located between the pool and existing patio. 
    Leisure Contracting: Unfortunately, Mr. and Mrs. ***** changed their mind on the day of excavation and refused to build the retaining wall where it was designed to be - between the pool and the patio. Because of this decision be the *****s, the steel frame for the new pool could only be secured 6" into the solid earth instead of the 3' 6" of solid earth that was represented in the Leisure Contracting, LLC pool plans for the ***** pool; and the SITE PLAN for the Harford County Permit for the *****s' pool needs to be revised by the homeowner because they did not follow the plan. The problem with the skimmer is that the skimmer MOVED 3" while shooting the heavy CONCRETE GUNITE due to only a 6" deep support caused by the homeowner deleting the retaining wall between the pool and the patio, allowing the pool to drop DEEPER INTO UNDISTURBED EARTH. 
    2. Attached Customer Experience Information from ********* *****. 
    2-B Response by Leisure Contracting. The ***** Statement from her attachment. 
    "The skimmers were (sic) put in incorrectly unevenly and misaligned." 
    Leisure Contracting: The skimmer in the deep end was discussed in 1-A Response by Leisure Contracting. That was caused by not enough solid earth because the homeowner deleted the retaining wall between the pool and the existing patio. 
    The 2-B skimmer is in the SHALLOW END of the pool where the solid earth was deeper. The problem with the shallow skimmer is that the concrete installer DID NOT ALIGN the skimmer lid parallel with the pool coping. The concrete installer was the *****s' personal concrete installer - nothing to do with Leisure Contracting. The *****s' concrete installer apparently was not familiar with pouring concrete on swimming pools. There is an EXTENSION COLLAR under the skimmer lid that keeps the concrete from falling into the open plumbing pipe, leading back to the pool equipment. This collar has a NOTCH. The oversized SQUARE SKIMMER LID has a protrusion that fits inside the collar NOTCH. Before pouring concrete the installer aligns the skimmer lid protrusion INTO THE COLLAR NOTCH. Then he rotates the skimmer lid to be parallel to the pool; removes the lid; and duct tapes the top of the open collar; pours the concrete; removes the tape; puts the skimmer lid on aligned with the collar and then it is perfect. The concrete installer MUST FIX HIS OWN MISTAKE. 
    3. Attached Customer Experience Information from ********* *****. 
    3-C Response by Leisure Contracting. The ***** Statement from her attachment.

    Leisure Contracting: The attached Contract between Leisure Contracting, LLC and Shane & ********* ***** contains a reference on ITEM # 57 that the buyer fills the pool - not LEISURE CONTRACTING. 
    Secondly, the December 15, 2020 Initial Pool Proposal for the *****s contained a specific note on page 2 of the proposal that filling of the pool is not included. 
    Thirdly, the December 30, 2020 revised Pool Proposal for the *****s also contained a specific note on page 2 of the proposal that filling of the pool is not included. 
    Fourthly, the January 9, 2021 FINAL POOL PROPOSAL for the *****s contained a specific note on page 2 of the proposal that filling of the pool is not included. 
    Plus, all we did was call two water companies until ****** ***** ******* agreed to fill the pool. Their phone number is 410-******** and/or 410-********. We DID NOT FILL THE POOL. The *****s filled their pool and paid the water company to fill their pool. In fact I told the *****s to throw their hose into the pool whenever the tanker left to get more water so that the water level would continue rising. To my knowledge the *****s NEVER PUT THEIR HOSE IN THE POOL. That "ring" around the pool is the *****s' fault. 
    Additionally, if you refer to the yellow highlighted area on our Limited Warranty printed on the back of our contract it states under LIMITATION AND EXCLUSIONS that the "plaster finish NOT GUARANTEED against staining or discoloration since such defects generally result from local water conditions..." 
    4. Customer asked me to get her some "Stain - Drop - Number - 2". Someone who 
    Mrs. ***** spoke with recommended Stain Drop number 2. I went to a supply store and purchased some for her. I didn't sell it to her. I gave it to her. She wanted me to install it and I refused. Installing any type of stain remover is not my expertise. I cautioned her not to do it because I have no idea how that will work. Mrs. ***** used it anyway and now the pool looks worse. I requested John Bereza, manufacturer of this stain remover to look at the photos of the ***** pool to see what is wrong with her installation of the stain remover. I have attached his critique. 
    5. Other problems that Mr. and Mrs. ***** have caused are using a concrete patio 
    installer who is not experienced with swimming pool decks. In addition to this installer not being able to properly set a skimmer he also neglected to install expansion joints around the skimmer and foam expansion between the patio and the flagstone coping which will cause the coping to become loose and the patio to crack. Not installing a retaining wall between the pool and the existing patio in the back of the house could cause the pool to CRACK from settlement of poor soil. See December 15, 2020 pool proposal, December 30, 2020 pool proposal; and Final pool proposal dated January 9, 2021 on page 2 under Broomed concrete pool patios.
