      I purchased a lifetime subscription to True Momentum in 2020 when **** Mampily was running the service. 2 years later he was fired and replaced by *** ****. 2 years after that, Banyan Hill terminated the service and moved all True Momentum subscribers to Extreme Fortunes. Extreme Fortunes is a small cap stock service. True Momentum is a mid cap stock service. So, Banyan Hill has changed the editor (I get that) and now reduced the service by combining small and mid cap stocks instead of fully dedicating a service to mid cap stocks. As soon as I heard about the change, I requested a refund of the lifetime membership. They refused. They then told me they treat lifetime memberships as 5 year terms. I was not in the service for 5 years anyway, so there should be value left on the subscription. They then said *** has been running the service for 2.5 years. I understand that too. But as soon as they changed the service, I wanted a refund. They did not advertise the service as a 5 year membership. They advertised it as a lifetime membership. They are scam artists.

      Thanks for your feedback. 

      As I explained when you and I spoke on the phone, you upgraded to a lifetime subscription to True Momentum four years ago having signed up for the service a year before that. It's true that we changed editors for this service a couple years into your subscription. If that was an issue for you at the time, you never made us aware of it. 

      Recently we've combined two of our services - True Momentum and Extreme Fortunes. We got rid of the True Momentum name and kept Extreme Fortunes. It's the same editor, and the same mid-cap recommendations. We've just added small cap recommendations to the service. 

      The liability on the account is a moot point and has nothing to do with the conversation you and I had. You aren't entitled to a refund because you are far, far past any refund period for this service. Changing the name and adding small cap recommendations to your mid cap recommendations is not a valid reason to cancel. There is no negative affect on your subscription, only positive. 

      There is no scam involved here. If you want to cancel the service, you can do so but there will be no refund.

      I want this company to stop sending me unsolicited emails. I’ve opted out of their emails multiple times yet I still receive multiple emails a day.

      I checked our fulfillment system. Your email address isn't on any of our lists, nor have you signed up for any of our services. 

      We aren't sending emails to the address you provided. 

      My recommendation would be to block the email address of the sender for the emails you are receiving. It's not Banyan Hill Publishing.

      I regret their response because they admit I’m not a customer but claim that they are not sending me emails. I’ve forwarded every email I’ve received from them to their support line, I’ve also opted out of every email they send and I have also blocked every email address that has sent me emails fro/from this company. As we all know they use email generators that have thousands of email addresses so it would be impossible for me to block everyone. At know time has this company reached out to me in response to the forwarded emails with requests to be removed from any and all their list. As most of theses fly by night companies do they will claim they cannot help and are not responsible for third party companies sending emails on their behalf. As clearly stated in the ******** act they are indeed responsible for advertising and emails from third part companies.

      We are not sending emails to this email address, nor have we ever. 

      We have been in business many years, as you know. 

      We do not have thousands of email addresses - we have one for subscribers and another for promotions. The provided email address is on neither of those lists. 

      We are *not* responsible under canned spam laws if someone is spoofing our business. We have no way of intervening on this person's behalf and, as far as I can tell, we have never received any examples of the emails they are claiming to receive. 

      BBB you are responsible for providing fair and balanced support for both customers and businesses. That is not happening here.

      This customer placed an order online for a $79 subscription. They chose that subscription price when they placed their order. 

      The customer's order was processed on 11/6. They contacted us the same day to cancel and refund the subscription, which we did. 

      The customer contacted us again on 11/8 for the status of the refund. Our agents confirmed the refund was processed on 11/7.

      We ask customers to allow up to 7 business days for the refund to process (that's based on the credit card provider, not on Banyan Hill). 

      This customer has been fully refunded, and I expect if they contact their credit card provider they can confirm the same. 

      There is no action for us to take, nor any reason for a BBB complaint.

      I requested a refund for a product that was discontinued. Attached is the correspondence where I was originally told the refund would be granted and subsequent correspondence where it was denied with no explanation (see attached email correspondence).

      I am rejecting this response because: I have not received any prorated refund to my **** account. I have spoke to the **** people and there is nothing, possibly they have the wrong account number. Please provide them with this **** number (****** ****** - **** ****** *****) and have them resubmit, as I indicated in my previous response, I was first told they would provide me with the prorated refund and then told no, there would be no refund. Very confusing and frustrating, consuming lots of time on my side and also with the BBB. Thanks again for your assistance, it's appreciated.

      As I said previously, we processed your refund to an **** on 7/3/23. I show the status as 'request outbound' so it looks like there is an issue on ****'s end. 

      I have our accounting team looking into it and will respond when I get more details from them.

      The ******** service was advertised as containing a fool-proof indicator of the market. This 75% prediction of a market movement is a bit much. Though advertised as providing double and triple digit winners, I did not see many. Since purchasing it on 5/11 for $995 I have taken dozens of trades and it total have net losses. I can hardly recall a double digit winner none the less triple digit winner. With this service I am happy to tread water. I have contacted them many times either through their contact form or phone calls. Specifically I received a note back on 8/11 that this service was non-refundable. I would not see that as valid since they did not perform as advertised. Finally on 1/4 I was promised a refund on a phone conversation. When I did not see a refund I called again, reported that I was promised a refund, and after a delay I was told that a refund was not possible. Reporting to BBB was a last resort since I was not able to work it out directly. Based on my contacts with them (above) I delayed until now to contact you. Even though there has been significant time it is still something that should indicate a refund.

      I inquired to several publishers online to get some information on self-publishing or going through an agent, stumbling upon Banyan ****.
      I never gave them any info besides an email and phone number, so I am lucky enough to have not lost any money to these folks. They spam you with Far right propaganda and pander to get donations for the republican party; I received an email about a so-called CEO of the company named Aaron *****--- seems they are using the background of an actual political science author but the image of some other man. This seems extremely shady, and others should be warned that this CEO does not exist. Several of these ads are 3rd party sold reading
      "This ad is sent on behalf of Banyan **** Publishing. **** *** ***** Delray Beach, FL 33482."
      This is bad business, selling people's data to 3rd parties.

      BBB - we are a company located in Florida and have a BBB profile there. I'm not sure why your email to our website didn't reach me, but I just received your email dated 12/21/22 today.



      The complaint provided to you is full of misinformation. We don't have that person's email address in our fulfillment system. We aren't sending anything to the email address they provided.



      It's possible that person signed up for our free eletter under a different address. If so, they would receive promotions from Banyan ****. We aren't politically affiliated and we certainly aren't soliciting funds for any political party. That's just patently false.



      Aaron ***** is our CEO's penname. Otherwise, I'm completely confused by the other information they provided and unsure of what BBB is asking us to do.
