    Had original work order for front walkway and back pool deck ($10,700) to be completed by Ecoworx (*********************). paid 2/3 amount ($7115.50). Between 9/12/2022-9/23/2022 he completed demo and new concrete front walkway but he did not seal due to unsatisfactory work (he acknowledged not good). he stated an option to remedy would be an overlay which we declined as this is not what we paid for. We then stopped progression to the pool deck work as the front was not done properly. Reasons included: foundation not to standard (no tamping or pea gravel), concrete did not properly stamp, cracks and chips throughout, improper grading leading to puddles of water, damaged our flower bed edging and lights, cut into driveway, cut into stone on our home. All of these concerns had been brought to his attention and on 9/28/2022 he sent us email stating we breached contract by stopping him from moving to pool and he would not refund us, but would do remedy the front walkway for an increase in price. We agreed to new the price of $6911.60 for remedy. 4/29/2023 he refunded us by check the amount due $203.90. However, since this time he has continued to not come remedy due to various excuses including weather, busy with other jobs, no workers. Last contact on 7/17/2023 he stated we will have to go back to original contract of front walkway and pool deck. In this last email, he is also stating he will do ****** slate stamp which was in the original work order; however, it was agreed upon both verbally and by messages that he would do flagstone stamp. The flagstone stamp is what he used in Sept 2022.

    : Continually twists the facts in an effort to shift the blame of work incompletion; the only fact that is relevant to this project is that the customer absolutely prevented Ecoworx from continuing to complete the project this fact has been confirmed multiple times by admission of the customer, by the customers attorney, and by many communications. Additionally,the customer recently refused to have the work completed by attempting to defraud an insurance company after we attempted to schedule the work back in (which we in fact had no legal obligation to do so). The customer only paid for exactly what he owed at that point of the work and never paid for a completed project.

    IRT: he completed demo and new concrete front walkway but he did not seal due to unsatisfactory work
    Its fact that we never completed work due to the customer not allowing us too.

    IRT: he stated an option to remedy would be an overlay which we declined as this is not what we paid for
    Its fact that a demo and repour was going to take place which you refused.

    IRT: foundation not to standard (no tamping or pea gravel)
    The foundation was compacted three times, and compacted to rejection of the recycled concrete.

    IRT: concrete did not properly stamp, cracks and chips throughout
    As noted, unfortunately the third party ready mix supplier delivered a hot load due to environmental factors completely out of our control which caused an extreme curing acceleration of the supplied concrete. This issue is not uncommon, and when this does happen the concrete is repoured - as noted the customer refused to have it repoured.

    IRT: damaged our flower bed edging and lights
    The customer left the edging (about a $20 value), and the light (a $5 push in ground solar light), inside of the construction zone.

    IRT: cut into driveway, cut into stone on our home
    The customer was notified that the driveway needed to be squared where the concrete met the asphalt and he agreed to the trimming [approximately 3 wide strip] of the area. As for cutting into the stone, we have no clue what he is referencing/referring to, and this is the first time that this has been mentioned by any communication (30+ communications to date).

    IRT: he sent us email stating we breached contract by stopping him from moving to pool and he would not refund us
    This is also false we were not moving to the pool area due to the fact the customer did not let us complete the walkway. There is no refund due, the customer only paid for what he owed up to the time he stopped the work.

    IRT: However, since this time he has continued to not come remedy due to various excuses including weather, busy with other jobs, no workers.
    Again, this is also false the customer refused to be scheduled (just recently) and has since attempted to defraud an insurance company.

    The fact that the customer, early on in communications, had threatened the reputation of Ecoworx (the intent) and has now committed libel statements (slanderous by intentionally naming myself) in an attempt to carry out his threats will not go unnoticed.

    I am rejecting this response because:
    Ecoworx performed work inadequately and changed the contract after we advised we no longer wanted him to do work on another part of the property. The change of contract increased the price of the work he already did and prompted a small refund which he provided. The work he already did still needed to be remedied and after he provided many excuses for nearly a year about why he could not remedy, he advised we would be returning to the original contract including the other project he was supposed to do on another part of the property. Following his poor work done on one part of our property, we could not allow him to do work in another area. 

    A claim was filed with the insurance company Ecoworx provided due to the poor work, standing water now forming in the transition area from my sidewalk to my driveway he cut into, and damage to the grout around the stone on the front of my home. The insurance company advised he was not covered at the time the work was done and I have no other insurance information for Ecoworx. Although the insurance was active at the time the information on it was sent, the insurance company advised the policy ended in June of 2022 approximately three months before he did the work at my home.

    Contracted with Ecoworx to pour a car port and steps, and a side walk. The car port and steps was 7,622.40 *************** the owner, was the person doing the work, the car port concrete has boot prints and the expansion lines are all crooked. The steps have white spots all over them and the work was done in a poor workmanship manner;. I paid Ecoworx for the car port and steps with the understanding that the car port and steps issues would be fixed. I then asked Ecoworx to pour a side walk for 7200.00  the side walk has areas that are round and smooth and the rest of the side walk is stamped concrete. I paid all of this except 2507.00, which i refused to pay until the work was finished. I have called *************** and text him about finishing the work, but he does not return my call or text.
