Date of transaction: ******** Amount of purchase: ******* What business committed to providing: CrowsNest Software Installation and custom implementation with server license and 15 seats and custom app. Nature of problem: Installation and implementation was to take place January 2022 for ******* Construction, LLC. As of March 26th the software was not at all functional and project was put on hold. Crows Nest Software project management team did not install software as contracted, rather sent highly technical instructions to me and promised customization to the software that never happened. I resigned my position at the client company but company is still owned by my family's trust and operated by my father. Company is still making payments of over $1,000 a month for software that does not work. Payments are made to a third party lender. Purchasing company does not have an IT team capable of the highly technical installation. The software contract only requires the ability for someone to have working knowledge of the windows operating system (which they have). Software company is responsible for all installation, implementation, and training for the software. Norman is now claiming that the implementation can take as long as 18 months. The software update and support expires in 12 months from the contract date. This would mean the implementation would exceed the software update and support contract. Dispute resolution: I requested a 50% refund for the software. The company is only offering a less than 10% refund ($4,000). I have been in conversation with Norman Fink, owner of NPF Consultants, as well as **** ********** president of Crow's Nest Software. **** ********* is insisting only a $4,000 settlement and pushing hard to continue the implementation project.
